Act

Liberation Earle of Aboyne.

The Lords of their Majesties Privy Council, having Considered the Petitione givin in to them be Charles Earle of Aboyne, They herby give order and warrand to Lieutennent Collonell Erskin Lieutennent Governor of the Castle of Stirling, and in his absence the nixt Commanding officer there, To sett the Petitioner at Liberty furth therof, And in case his Effairs so require, allowes him imediatly after his Liberation from the said Castle, straight to repair to the Toun of Edinburgh and remaine therat for the space of Tuenty dayes or less as he shall think fitt, He keeping within the Toun dureing his abode therat, And ordaines him within the said space of Tuenty dayes and imediatly affor his departure from the said Citty to repaire straight to one or other of the Earle of Strathmore his houses of Glames or Castl-lyon, wher the said Earle shall be residing for the tyme, And with Consent and at the Earnest desire of the said Earle of Strathmore Confynes the said Earle of Aboyne to Either of the saids houses within which the Lord Strathmore shall Reside from tyme to tyme and six myles about the same. And Discharges him to goe 3 without the bounds of his Confynment, And befor his Liberation Ordaines him to give bond and find sufficient Cautione acted in the books of the privy Councill That he shall give Exact obedience to the present sentance in Every poynt. And that he shall appear befor the Lords of their Majesties privy Council when called for, and in the mean tyme that he shall live peaceably under and with all submission to the present Government of their Majesties King William and Qween Mary, And that he shall not Act, Consult, nor contrive any thing in prejudice therof, nor converse or Correspond with any rebells under the penalty of one Thousand pound sterlin in case he shall transgress in any parte of the Premisses.

Robert Currie admitted Macer

A Commission under the privy seall in favors of Robert Currie To be one of the Macers of privy Council and Exchequer, being Read was ordered to be Recorded, And the said Robert being Called In, did swear and signe the oath of Alledgance and signe the Assurance to their Majesties King William and Queen Mary. And the Lord Chancellor having administerat to him the oath De fideli He was Receaved and Entered to his office. Followes the Tenor of the Commission. William and Mary Be the grace of God King and Queen of great Brittan, France and Ireland, Defenders of the faith, To the Lords Commissioners of our Theasurie and Exchequer, Lords of our privy Council, and to all and sundry our Leidges and subjects whom it Effeirs To whose knouledge these presents shall come, Greeting. Witt ye us with the speciall advice and consent of our Right Trustie and right weel beloved Cousin and Counsellor John Earle of Tweeddale Lord High Chancellor, Our right trustie and intirly beloved Coussine and Counsellor William Duke of Hamilton Lord presedent of our privy Council, Our right trustie and welbeloved Cousins and Counsellors James Earle of Drumlangrig, John Earle of Cassills, George Earle of Linlithgow and John Earle of Breadalbane, And of our right trusty and wellbeloved Counsellor, Alexander Lord Raith our Theasurer Deputt Lords Commissioners of Theasurie, And als with advice and Consent of the rest of the Lords and others of our Exchequer of our Antient Kingdom of Scotland. Forasmuch as we being Informed that the office and place of ane of our Macers befor our privy Council and Exchequer Commissions and Serjants at armes is now Vacant in our hands and at our Royall gift and disposition, By and through the decease of Francis Naismeth Late Macer and Serjant at armes in the said office, And Likwayes being informed that Robert Currie wryter in Edinburgh is a person fittly and aptly qualified to succeed therin, Therfor witt ye us with advice and Consent forsaid To have nominat, made, Constitute, Created, appointed and ordained, Lykas we with consent forsaid by these presents, nominat, make, constitute, creat, appoint and ordaine the said Robert Currie one of the Macers befor our privy Council Exchequer and Commissions and likwayes a Serjant at armes (Dureing our Pleasure) Giving, granting and disponeing to him dureing the said space, The forsaid office and place, with all the fees, pensions, Emoluments, Causualities, profeits and dewties. As also all the Liberties, Immunities and priviledges pertaining or that are or shall be any wayes knoun to appertaine and belong therto, or that ever were possessed and Enjoyed be the deceast John Henderson, the said deceast Francis Nesmith or any of their predicessors in the said offices. And particularly (without prejudice of the said generallity) The Sallarie and pension of Fyftie pound sterling yearly conferred on Each Macer Imployed in the said station by our most royall predicessors, payable the way and maner specified in their gifts therof or orders and warrants granted theranent, with full power to the said Robert Currie (Dureing the space forsaid) To Exerce the said office and to Intromet with and uplift the said fees, sallaries, pensions, profits, deuties, Causwallities and others particularly and generally above specified belonging therto and to bruik and Enjoy the said Liberties, Imunities and priviledges attending the said office, and to doe what else the said deceast John Henderson and Francis Nesmith or any of their predicessors therin or any other Macer and Serjant at armes hes done, does or may doe in the like cases, And that freely, quietly, well and peace without any revocation Contradiction, obstacle, impediment or gaincalling whatsomever. And we with consent2 forsaid, Hereby ordaine the Lords of our Theasurie Theasurers principall and Deput for the tyme, generall receavers, collectors and others Concerned, To satisfy and pay the said Robert Currie the saids fees, sallary and pention at the usuall terms and dureing the said space, Commenceing his Entry therto at the term of mertimes last, and so furth yearly and termly in tyme comeing, For quhich these presents shal be to one or all of them a sufficient warrant. And further ordaines the Lords auditors for the tyme of the saids Lords Commissioners of our Theasurie, Theaserers principall and Deput, generall Receavers and Collectors to discount and allow the said payment in the said accompts yearly, and for which also these presents shal be to them a sufficient Uarrant. And moreover we (with consent forsaid) Hereby recomend to the Lords of our privy Council Exchequer and Commissioners aforsaid to admitt and Receave the said Robert Currie upon sight hereof to the said Respective offices, and take his oath De fideli, and others prescrybed by our lawes according to the order and Custome observed by them in the like cases. The Lord Advocat Having acquanted the Councell That upon Informatione Ther uould Come Letters containing matters of moment Against the Government to the post office direct under a Cover to a Certaine persone ordors was Given to the postmaster to take nottice of the persone who should call for such Letters And accordingly Agnas Scott Relict of […] Brysone merchant in Edinburgh Having Called for such Letters was seazed And being brought before the Lord Advocat and Lord Justice clerk and examined Acknowledges she was not to have delyvered the Letters (quherof some were in Cyphers) to the persones to whom they were directed nor would she have brought them to such as their Lordships But refuised to tell to whom she would have delyvered them Their Lordships did Committ her to prisone wher she having remained severall dayes still refuising they alloued her to be at Liberty upon bale The Councell alloues of what the saids Lords have done in this matter And Recommends to the Lord Viscount Tarbat The Lord Beilhaven and Lord Funtainhall to Call for and examine the saids Mistress Brysone and Endeavour to find out this matter And particularly to whom the showld have been delyvered and how it may be redd And Recommends to the Lord Advocat and Lord Justice Clark to meet uith the forsaid Committee and to Report to the Councell

The Councell Being Informed That their Majesties forces are not tymeously nor sufficiently provyded uith Corne and straw Did Call for Sir Alexander Bruce of Broomhall Commissarie Generall who is by Contract uith the Lords of the Thesaury bound for provisione to the Forces and to have the same in magazine And Having appeared He alleadged That pairtly by the scarcitie of straw this year and pairtly by unwillingnes of the poeple to sell or otherwayes He Cannot Get provisiones no not for ready money and extraordinary pryces The Councell Having Considered the Contract betuixt the Lords of the Thesaury and the Commissary Generall uith the Fourth Act of the last sessione of this Currant parliament made for the due payment and furnishing of the forces They Recommend verbally to Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this Kingdome to affoord what ease or help he Can to the Commissary by quartering the troopes at as Great a distance and in as small numbers as safely may be done And the Councell did verbally Intimat to Sir Alexander Bruce the principall tackseman and Hamiltoune of Barntoune one of his Cautioners That they take care the forces be speedily and sufficiently provyded for as they uill be Ansuerable And if they Cannot Gett provisions For payment of ready money appoyntes them to Condescend upon the porsones particularly by their names who have been in use to sell Corne Hay and straw to merchants Innkeepers and others and have to sell And who being requyred by them to sell upon payment of ready money at reasonable rates Have notwithstanding refused And appoyntes the Commissaries to condescend upon the pryces offered by them and refuised by the Country

The Lords of their Majesties privie Councell Doe Heirby Recommend to Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this Kingdome to send such detatchments of their Majesties foot souldiers as shall be Aggried upon Betuixt the said Sir Thomas and Leivtennant Collonell John Areskine Deputy Governour of the Castle of Stirline to attend and keep guaird uithin the said castle uith the garrisone ther for the security of the prisoners of the said Castle till farder order of Councell

The Earle of Leven Acquants the Councell He uill fyre the Guns of the castle at the Kings landing in England

The Earle of Leven Governour of the Castle of Edinburgh Acquanted the Lords of their Majesties privy Councell That it hes been the Constant Custome when his Majestie Returns from Forraigne Countries to fyre a Round of the Guns of the said Castle which at this tyme may now happen to be In tyme of vaccance when the Councell is not sitting And desyred that their Lordships might not be allarmed at the shooting of the Castle when the post brings account of his Majesties being Landed in England
