Act and Remitt Mr James Southerland.

Anent a Petition given in to the Lords of their majesties privy Councill be Mr James Southerland Professor of Botanie at Edinburgh Shewing That quheras the Lords by their act of the second of February Jaj vjc nyntie thrie years were pleased to appoint twentie five punds sterlling of the readiest of the fynes Imposed be the saids Lords to be bestowed on the expences of the physicall garden And other twentie five punds sterlling as additionall Sallery, The petitioner as Botoonick professor, And the petitioner haveing since that time applyed himself dilligently in Cultivating the said garden and inriching it with many Varities, not without Considerable expence both of time and money, And that the samen requyres a Constant out giveing to work men And for seeds plants and Correspondance with professors abroad And that now is the seasone of provisiones of what is necessary wherin the petitioner hath Imployed himself in all dutie And Therfore Humbly Craveing the saids Lords would appoint the said twentie five punds sterlling for his additionall sallery to be payed to the petitioner whose need requyres it, And to appoint the other twentie five punds sterlling to be payed in and to nominat a Committie of the saids Lords number who shall direct the petitioner in bestowing therof, as shall be found most expedient for its true end as the said petition bears The Lords of ther Majesties privy Councill Haveing heard this petition given in to them be the above Mr James Southerland, They Recomend to the Lords Commissioners of their majesties thesaurie, To Cause payment be made to the petitioner of the above Soume of Twentie four punds sterling for expences upon the physick Garden both for this present year Jaj vjc nyntie thrie years.

The Lords of their Majesties privy Councill doe heirby give order and Warrand to the Clerks of privy Councill to deliver up the bonds of Cautionrie granted be George Davidsone, Maltman in Leith, James Maxwell of Kirkconnell, Samuell Mcclelland merchant, James Blaikwood Hew Neilsone, Mr William Thomsone John Maxwell and […] Riddoch as Cautioners for Mr George Gordon, Robert Davidson Alexander Chrichtoune, James Hepburne and Stiven Maxuell alledged to be preists should transport themselves furth of their majesties dominions in the fleet under the Convoy of the man of warr then Lying in Leith road betwixt and the twentie of May then nixt or sooner if the man or warr and Fleet should saill or otherwayes that the should present themselves to the Lord high Chancelor the said day, In respect the saids Lords have seen ane instrument under the hands of Malcome Alexander nottar publict dated the seventh day of May last bearing that upon that day the above Cautioners did put aboard for two ships called the providence of Leith and the Charles of Borowstouness in the Road of Leith the above alledged preists in order to their transportatione furth of their Majesties dominions And appoints the Lord advocat to see the said instrument before the bonds be given up.
Nota This was never extracted nor the bonds given out Because the Lord advocat was not satisfied with the instrument produced.

Act Bartleman anent two prisoners with the Turks.

Anent a Petition given in to the Lords of their Majesties privy Councill be John Barthellmew in Keirhill in name and be half of John Bartemew and James Key now prisoners in Algeirs with the turks Shewing That the said Archibald Barthellemew and James Key who wer borne within the bounds of the presbytrie of Linlithgow and being Seamen to their trade were in December Jaj vjc nyntie one taken prisoners by the Turks and are keeped ever since prisoners at Algeirs under most grivious and inhumane bondadge and Slaverie and that the said Archibald Bartlemew and James Key have no means goods or moneyes wherwith to pay ther ransome, Which would Amount to thrie hundred dollers, And Seing it was the saids Lords Laudable practise in the like Caices to grant recomendationes for ane piouse and Charitable Collectione to be gathered at such Church doors as the saids Lords should appoint upon the finding Caution that the Collectiones shall be applyed for Ransomeing the prisoners of for returneing the moneyes Collected to be disposed of according to the saids Lords Directories And Therfore humbly Suplicating to the effect aftermentioned The Lords of their majesties privey Councill haveing Considered this petitione given in to them be the above John Bartleman with the Certificats produced therwith They heirby Allow a volunter Collectione to be made at the Church doors of all the parishes within the presbytries of Edinburgh, Dalkeith, Hadingtoune and Linlithgow for ransomeing the above Archibald Bartleman and James Key from ther slaverie Upon Sabath the twentie sixth day of November nixt to come and appoints the saids Collectiones to be payed in to the above John Bartleman In Respect he hath given bond and found Caution acted in the books of privy Councill that the Collectiones2 to be delivered in to him shall be applyed for Ransomeing the above prisoners Or otherwayes that they shall be returned and Delivered to the Clerks of privy Councill to be Disposed upon according as the Lords therof shall give order, And Recomends to the ministers of the severall parishes within the respective presbytries forsaids to make intimatione publictly from their pulpits of this act upon the saboth day Imediatly preceiding the day above appointed for makeing the saids Collectiones.

The Lords of their majesties privy Councill doe heirby Recommend to the Earle of Forfar, The Viscount of Tarbat, The Lords Ross, Beilhaven and Polwart Lord Enstruther and Laird of Grant or any thrie of them whom they declair to be a suficient quorum of the wholl to call for and examine Daniall Nicolsone writer in Edinburgh, Doctor John Eliot, Mr Joseph Cleilland writter and Marion Maxwell relict of the umquhill David Pringle Chirurgeon in Edinburgh all prisoners in the Tolbooth of Edinburgh, Robert Wishart […] and all such other persones as they shall think fitt anent a Contrivance of the fathering upon Jean lands the said Daniall his wyfe and Margrat Lands her Sister a designe of poyseoneing him the said Daniall, And alse anent2 A true designe of poysoneing the said Jean, And alse anent the forgeing of a recept of poyson be the saids Jean And Margrat Lands to the said John Eliot, And to Consider the examinationes allready taken and papers in the Lord Advocat and the solicitors hands anent this matter, and to take what farder tryall they can to find out the truth of this wicked Contryvance, With power to the said Comittie or their quorum to cause seaze upon and secure in prison all such persones as they shall find ground to suspect guilty of or accessory to the Samen and to modifie such ane aliement to the Said Jean Lands spouse to the said Daniall and such ane Soume to the said Margrat Lands for defraying what charges and expences she has been at or shall be put to in this affair to be payed be the said Daniall as they shall think fitt, The said Margrat finding Cautione to refound incaice he shall be found Innocent and the saids Lords of privy Councill doe approve of the Lord Advocat his haveing put the said Marion Maxwell at first under baill and now in prison since the presumptiones of her guilt are arisen to a greater clearnes, And appoints the bond given be her and Mr James Anderson wryter to the signet her Cautioner dated the seventh of october instant to be given up to the said Cautioner, And Recomends to the Lord Advocat and appoints their Majesties Solicitor to attend and be present at the said Committie, And Recommends to the Committie to make the report to the Councill at their first meetting in november nixt.
