Act Margrat Forbes for a stipend

Anent a Petition given in to the Lords of ther majesties privy Councill be Margrat Forbes relict of Mr Robert Rait minister at Marykirk Shewing That wher the petitioners said deceast husband haveing served the cure at the said kirk for the space of Twelue years to the satisfactione of all his parishioners untill the year Jaj vjc nyntie two that it pleased God to Call him by death and haveing left behind him severall small Childreen and litle or nothing wherupon to mantain the petitioner or them, So that the petitioner are redacted to extream want and povertie and for suplieing ther present necessities the petitioner made application to the Patron of the said kirk of Mary-Kirk for ane half years stipend viz from Whitsunday to mertmiss Jaj vjc nyntie two years Which is yet unuplifted and haveing Obtained ther Consent for uplifting and intromitting with the said half years stipend as will appear by their factory and Concent theirwith produced, yet the heritor and others Lyable in payment therof refuses to pay the same to the petitioner unles the said Lords interpose their authoritie therto And Therfore Humbly Craveing the saids Lords to Consider the premises and the indigent Conditione of the petitioner and her poor fatherles Childreen and to allow her the said half years stipend by interposeing their Lordships authoritie to the forsaid Consent of the Patron And Ordaineing letters of horning to be direct against the heritors and others Lyable in payment therof for that effects as the said petition bears The Lords of their Majesties privy Councill haveing Considered this petitione Given in to them be the above Margrat Forbes with the gift and Consent mentioned therin and produced therwith They heirby allow the petitioner the stipend of the above Kirk of Marykirk for that half year from Whitsunday to mertimes Jaj vjc nyntie two years and Ordaines her to be readiely answered obeyed and payed therof be the heritors wodsetters Lyfrenters titullars tacksmen of teynds tennents possessors and others Lyable in payment of the said half years steipend, And Ordaines Letters of horning under the signet of Councill to be direct at the petitioners instance against them for that effect upon productione of a decreet of Localitie and incace ther be no decreet of Localitie Ordaines these lyable to make payment of their respective proportiones of the said half years stipend according as the same shall be determined by the Judge ordinary.

Anent a Petition given in to the Lords of ther Majesties privy Councill be Mr John Watsone minister at Whitinghame Shewing That quher ther being ane great necessitie for building ane stone bridge over the watter of Whitinghame through the want of which severall persones have perished and lost ther lifes in Crossing the said watter (any bridges of timber that have been laid over being allwayes Carried away with every speat) and ther being half ane year vaccand stipend of the said parish of Whitinghame before the petitioners entrie viz the last half years stipend Jaj vjc and nyntie thrie which the Viscount of Kingstoune patron of the said paroch has freely bestowed on the petitioner becaus of the paines the petitioner was at in preaching frequently to them befor the petitioners admissione nevertheless the petitioner is weell satisfied that the forsaid half years vaccand stipend be raither Imployed for so Charitable and so necessar a work as the building of the said bridge And Therfore humbly Craveing the saids Lords to interpone their authoritie to his uplifting the forsaid half years vaccand stipend to be Imployed towards the beuilding the said stonbridge as the petition bears The Lords of their majesties privy Councill haveing Considered this petitione given in to them be the above Mr John Watsone with the patrons gift produced therwith They heirby allow the petitioner the stipend of the above kirk of Whitinghame for the last half of the cropt and year of God Jaj vjc nyntie thrie, And Ordaines him to be readily answered obeyed and payed therof be the heritors fewers wodsetters Lyfrentars titulars tacksmen of teynds tennents possessors and others Lyable in payment of the same And Ordaines letters of horning under the signet of the Councill to be direct at the petitioners instance against them for that effect upon productione of a decreet of Locality and in caice ther be no decreet of Localitie Ordaines these Lyable to make payment of their respective proportiones of the said half years stipend according as the same shall be determined by the Judge ordinary The petitioner allwayes before extracting heirof giving bond and finding suficient Cautione acted in the books of privy Councill that he shall build ane stone bridge over the watter of Whitinghame out of the first end of the said half years stipend so farr as the same will extend for that effect.

Act In Favors of the shire of Edinburgh

Anent a Petitione given in to the Lords of ther majesties privy Councill be the Commissioners of Supply and Justices of peace in the shire of Edinburgh Shewing That wher the petitioners have made in ther care to see to the reparation and upholding of the bridges and Cassyes within the shire Conforme to the trust Committed to them But the repair about the City of Edinburgh being So great the high wayes and bridges needs frequent repairatione and requyres more Expences then can be affoorded, and unles the saids Lords hade allowed a small pettie custome of six penies on ilk loaded Cart and two penies on ilk Loaded horss passing throw the high wayes Which the petitioners have Imployed upon repairatione therof. The highwayes hade been altogither unpassible, notwithstanding that ther was severall soumes laid on of Consent with the Cess of the shyre for the helping of the high wayes and bridges, and the forsaid Custome being to expyre in Jully nixt, The petitioners after a full meeting did think it ther dutie to make ther address to the saids Lords to continue the said small Custome of six penies and two penies respective on loads and Carts passing the highwayes To the end the samen with the bridges may be repaired and keeped in good caice by the litle thing that it produces, Which is but small and insignificant Espeally seing that ther is no other way but the said Custome and the vaccant stipends have being denyed by the saids Lords albeit the petitioners have applyed for that effect upon the act of parliament anno Jaj vjc Eightie five And Therfore humbly Craveing the saids Lords to Continue the forsaid pettie Custome and grant ane act therfore in the petitioners favors for the space of seven years or so many years as the saids Lords thinks fitt and which shall be Carefully manadged and Imployed by the petitioners for the end forsaid as the said petitione at more length bears Which petition being read in presence of the saids Lords upon the twentie one day of June instant They allowed the magistrats of Edinburgh and others concerned to see and answer the same, and in the mean time Recomended to a Comittie of their oun number To Call for and meet with the petitioners and the magistrats of Edinburgh and to take tryall what part of the high wayes about Edinburgh doe belong to the shire and what to the toune, and to redd marches betwixt the shire and toune as to the bounds to be repaired by each partie Conforme wherto the Committie haveing accordingly mett and haveing Called for the heritors and the toune They Returned their report in the termes Following viz That the Committie haveing heard the Commissioners of supply and the magistrats of Edinburgh anent the marches of the high wayes to be repaired be either partie They of Consent of both parties Finds that as to the wayes beyond the west port, The shire is to repair what is be west the Bryriebank Which is the way leading for wrights houses to the way leading to the Colt bridge which Is the only way in difference betwixt the parties all the otherwayes being all ready adjusted betwixt them And that all the wayes leading to the toune of Edinburgh Is to be repaired by the product of the pettie Custome of these wayes in the first place, And the supperplus of these Customes if any be Is to be Imployed for repairing the rest of the highwayes and bridges within the shire And It is Farder the oppinion of the Committie That the Custome petitioned for be Continued for seven year or such other space as the Lords of privy Councill shall think fitt, Comenceing from the first of Jully nixt, and in testimony of the Consent both of the shire and toune of Edinburgh The Lord Hatton as Impowered by the shire and baillie William Mainzies as Impowered by the toune have with the Comittie subscryved this report as the said Report subscryved by the Committie and alse by the Lord Hattoune and Baillie Meinzies at more length bears And the saids Lords haveing this day Considered the forsaid petition with the above report They heirby approve therof and appoynted the same to be ingrossed heirin And the saids Lords Continues the said Imposition of six pennies on ilk Loaded Cart, and two penies on ilk Loaded horss passing throw the above high wayes for the space of thrie years yet to runn Commenceing frae the first day of Jully nixt to be Imployed for the repaireing the said high wayes And Recomends to such of the Commissioners of supply within the shire of Edinburgh as are members of the privy Councill with the Earles of Linlithgow and Annandale added to them To Consider how the above Impositione has been Imployed as to bygones and to see the same Imployed as above appointed in time comeing.

Anent the petitione Given in to the Lords of their majesties privie Councell By Frances Lady Seaforth Sheuing That their Lordships being favourablie pleased tuo years agoe or therby To allow the petitioner to stay uith her husband in the Castle of Edinburgh wher he is prisoner And to allow them Servants to attend them as other prisoners of quality in the Lyke Circumstance And the petitioner Having Caused furnish the family uith Drink sometymes from the sutlary and sometymes by bringing in drink of her oune yet Sir William Hope Leivtenant Governour of the Castle of Edinburgh upon what pretence or warrand The petitioner knoues not Hes Lately stopped and discharged the bringing in any drink for their family wherby The petitioner Judges herself heavily prejudged And seing It was never refuised to persons of quality who are prisoners in such Circumstances to furnish themselves after what manner they thought fitt uith drink and other necessaries And therfore it is Humblie expected that their Lordships will not allow the petitioner and family to be singularly used Especiallie seing the same is done out of peik and prejudice by the said Sir William Hope And therfore Humblie Craving to the effect underwryten as the said petitione bears The Saids Lords of their Majesties privie Councell Having Considered this petitione given in to them by the said Countess of Seaforth and ansuers made therto by Sir William Hope And both parties and their advocats Being Called The said Countes Compearing personallie uith Mr John Kincaid her advocat And the said Sir William Hope Compearing also personallie uith Sir James Steuart, their majesties Advocat, and Sir James Ogilvie their majesties sollicitor his advocats Both parties advocats being heard att the barr They heirby ordaine the said Sir William Hope Leivtenant Governour to Give free access and Entery for drink and other necessars to be brought in to the Earle of Seaforths family in tyme coming

Anent the petitione given In to the Lords of their majesties privie Councell By Sir William Bruce of Kinross sheuing That wher the petitioner hes been by their Lordships sentence Confyned to his oune house at Kinross these severall months bygone which he hath exactly keeped And seing he hath severall affairs at Law and others that necessarly requyre his presence at Edinburgh as is nottour to many of their Lordships And therfore Humbly Craving their Lordships to allow the petitioner for some tyme to Come to Edinburgh as their Lordships shall think fitt And he is Content to Find Cautione to returne to his Confynment at the day their Lordships shall appoint and Keep the samen as their Lordships have already ordained as the said petition bears The saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby allow the petitioner to Come to Edinburgh for attending his affairs untill the tenth day of Agust nixt In respect the petitioner Hath given bond and Found sufficient Cautione acted in the books of privy Councell That he shall returne to and abyde uithin the place of his said Confynment against the said day and not goe uithout the bounds of the same under the penaltie of fyve Hundreth pounds sterling In caise he shall transgress In any pairt of the premisses

Anent the petitione given In to the Lords of their majesties privie Councell By Sir William Bruce of Kinross sheuing That wher the petitioner hes been by their Lordships sentence Confyned to his oune house at Kinross these severall months bygone which he hath exactly keeped And seing he hath severall affairs at Law and others that necessarly requyre his presence at Edinburgh as is nottour to many of their Lordships And therfore Humbly Craving their Lordships to allow the petitioner for some tyme to Come to Edinburgh as their Lordships shall think fitt And he is Content to Find Cautione to returne to his Confynment at the day their Lordships shall appoint and Keep the samen as their Lordships have already ordained as the said petition bears The saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby allow the petitioner to Come to Edinburgh for attending his affairs untill the tenth day of Agust nixt In respect the petitioner Hath given bond and Found sufficient Cautione acted in the books of privy Councell That he shall returne to and abyde uithin the place of his said Confynment against the said day and not goe uithout the bounds of the same under the penaltie of fyve Hundreth pounds sterling In caise he shall transgress In any pairt of the premisses
