Act In favours off Mr George Weeymss

Annent The petition given in and presented to the Lords off Her Majesties privie Councill By Mr George Weeymess Minister off the Gospell at Fearnie in Angus Shewing That wher the Late Reverend Mr John Spalding sometyme Minister off Dundie Haveing revised and transcribed with his own hand a Collectione off excellent sermons preached by him on the sacrament off the Lords supper fitted for the whole occasiones relating therto Togither with a considerable number off speeches befoir, att, and after the Tables and some others off his works, all methodically digested and designed by him for the press in his lyfetyme and at his death appointed by him to be printed, and which since have been persued and approven by seaverall’s off the most learned and Godly Ministers and others in the natione and Judged by them to be off singular usse not only For the Ministrie But most proper to be published For the good and advantadge off all sober and pious persones And that the petitioner2 sone in Law to the said Mr Spalding and haveing his papers in his custody and at his disposeall, Hath for the publict good upon his own proper Chairges and Expensses undertaken the publishing off the Forsaid sermons and other works in a book in Quarto to be Intituled Synaxis Sacra etc Which is to be printed by Mistres Anderson Her Majesties printer in Edinburgh And Therfor creaveing to the effect afftermentioned As the said petitione Bears The Lords off Her Majesties privie Councill Haveing considered the above petitione Given into them By Mr George Weeymss Minister off the Gospell at Fearn in Angus And the samen with ane attestatione under the hands off Mr David Ramsay Mr John Glassfoord, and Mr James Robertsone Ministers off the Gospell Being read in their presence, The saids Lords Heirby grant leicence and warrant to the petitioner and his assignyes For printing a book in quarto Entituled Synaxis Sacra, or a Collection off excellent Sermons on the Sacrament off the Lords supper By the late Reverend Mr John Spalding sometyme Minister off Dundee and dischairges any other persone To print end sell or Import any off the saids books or sermons Dureing the space off Nynteen years From the day and date heirof without the petitioner or his assignyes their warrand or Commission under the pain off seazing upon and farder under the paine off Five hundereth merks scotts to be payed by the Contraveeners to the said petitioner or his Forsaids besyds the Seazure and Forfaulture forsaid.

Annent The petition given in and presented to the Lords off Her Majesties privie Councill By Captaine Robert Hamiltoun in Earle of Orkney’s Regiment off Foot Shewing That wher Robert Hamiltoun sone to the Deceast John Hamiltoun in Inchgorthick Haveing been imprisoned by warrand From their Lordships And he being content to goe aboard to serve in the Earle off Orkneys redgement and in the petitioners Companie as appears by his Declaratione herewith produced And Therfor Creaving to the effect after mentioned As the said petitione bears The Lords off Her Majesties privie Councill Haveing Considered the above petitione given into them by Captain Robert Hamiltoun in the Earle of Orkneys Regiment off Foot And the samen with ane Consent duely subscrived by a Magistrat under the hand of Robert Hamiltoune in Inch Gorthick Being read in ther presence The saids Lords Doe heirby Give order and warrant to the Magistrats of Edinburgh and keepers off their Tolbuith to set the persone off the said Robert Hamiltoune at Liberty Furth therof To goe aboard and serve in the Earle off Orkneys Regiment and in the petitioners Companie upon payment allwayes off the house dews to the keeper off the Tolbuith of Edinburgh wher he is a prisoner.

Warrant anent Levieing of Seamen

The Lords of her Majesties privy Councill haveing heard a Representation made to them by the Lord high Chancelor That the Captains of two of her Majesties men of Warr Lying in the Road of Leith had desired his Lordship to move to the Councill board, That the Same incourragment might be granted to them for engaging Seamen volunteirs to serve aboard her Majesties fleett; which is granted to the Land officers for makeing up recruites to the forces under her Majesties pay in Flanders and that the Magistrats of all the Seatounes betwixt the Toune of Stirling And the burgh of Aberdeen inclussive upon the rive of Clyde Comprehending Glasgow and Air and from Eymouth to Leith might be advertised to make publict intimation by beatting of Drums or otherwayes within their respective burghs; That all Such able Seamen who by their oun free consent given before a Magistrat Conforme to the Lawes and acts of parliament are willing to serve aboard her Majesties Fleet doe repair to the Toun of Leith betwixt and the […] day of May nixt to come; And ther offer themselves to the saids Captains for the said Service who therupon before Carieing them aboard shall at the Sight of the Magistrats of Leith pay and delyver to each of the said Seamen; The Soume of Fourtie Shilling Sterling before they shall be allowed to Ship or Caried aboard any of the said seamen The Lords of her Majesties privy Councill Considering That it may be for the advancement of her Majesties Service and for the intrest and security of this Kingdome alse well as of her Majesties other dominions Ordaines the Magistrates of the respective burghes and Seatounes within the bounds forsaid or any other persones haveing Warrand from the saids Captains of the saids two men of Warr To beat Drums within the respective bounds of the saids burghs and Seatounes for intimating to all able Seamen who by their oun free Consent given before a Magistrat are willing to Serve aboard her Majesties fleett That they repair to Leith betwixt the said […] day of May nixt to come; And ther offer themselves to the saids Captaines of the Men of Warr or any of them upon their paying to each of the said Samen Fourty Shilling Sterling money of England of free bounty and Levie money before their giveing aboard of any of the Saids men of Warr And Ordaines all Magistrates and others within the burghs and Sea-tounes forsaid To give their Concurrence to the Saids Captaines of the Men of Warr and others Imployed by them for secureing the persones of any such seamen who shall willingly engage with and be payed by them in maner forsaid upon the saids Captines their oun proper charges and expences and prohibits and Discharges any disorders or abusses to be Committed by the saids Captaines and other persones to be Imployed by them in takeing on and Secureing of the saids seamen as above; But allwayes to keep themselves within the bounds the Law prescrybes. Anent the petition given in to the Lords of her Majesties privy Councill be William Earle of Dalhoussie Shewing That wher her Majestie haveing granted to the petitioner ane warrand for ane Commissio nto be Shirriff principall of the Shirrifdome of Edinburgh dated the twentie fourth day of February Last In which the Secretaries servants have Ommitted to insert the Clause ordaineing the Same to pass the great Seall per Saltum Upon which accompt the director of the Chancelory Scrouples to extend the said Commission without the saids Lords warrand for that effect, And Seing the saids Lords were in use to interpose their authority in the Like cases And Therfore humbly Supplicating the Saids Lords to the effect aftermentioned The Lords of her Majesties privy Councill haveing Considered the above petition given in to them by William Earle of Dalhousie; And the samen being read in their presence The saids Lords Doe hereby Ordaine the Commission In favors of the petitioner to be Shirreff principall of the Shirrifdome of Edinburgh dated the twenty fourth day of February Last to pass the great seall per Saltum and Grants warrand to the director of her Majesties Chancelary and his deputes for wryting out the Samen And to the Lord high Chancelor and the keeper of the great Seall under his Lordship for appending the Samen therto without passing any other register or seall.

Act In favours of Lawrance Crawfoord of Jordanhill for stoping the Importatione of Irish Horses and Catle and seiseing them when Imported

Anent the Memorandum given in to the Lords of her Majesties privy Councill be Lawrance Crafurd of Jordanhill Representing that the Lords of her Majesties privy Councill Haveing by their act and Commission Impowered the said Jordanhill to seize all Irish victuall that should be Imported upon the western Coasts and to punish the Importers Conforme to the rules therby appointed; The saids Lords did designe to extend their said Commission to him as to Irish horses and Catle also; But the Councill did adjourne that day without haveing the whole matter in their vein; And Seeing it will be much easier for the publict expence to have the whole power Lodged in the person of one man the same waiters and servants being able at the same time and place to prevent the Importation of both And Therfore Humbly Craveing that the saids Lords would add the power of Seizeing the saids horses and Catle to their former act and Commission In favors of the said Jordanhill to the effect he might not only Seize any such that shall hereafter be Imported and Otherwayes punish the Importers Conforme to the rules prescribed But also might take tryall why So many have been of Late Imported and by whom and whose Connivance and make report therof to the saids Lords of Councill in due time As the Memorandum bears The Lords of her Majesties privy Councill Haveing Considered the above Memorandum by way of petition given in to them by Lawrance Crafurd of Jordonhill; And the Samen being read in their presence The saids Lords doe hereby Grant instruction and give power and warrand to the said Lawrance Crafurd of Jordanhill for puting the Law’s and acts of parliament made against the Importing of Irish horsses and Catle from Ireland to due and Lawfull execution; And the saids Lords doe hereby appoint the Clerks of Councill to wryt to him for that effect And Recommends to the Lords of the Thesaury That they give instructiones to the Collectors and waiters at the severall Seaports for that same end.
