The Lords of their Majesties privy Councill Haveing Considered the petition given in to them be the noblmen gentlmen heritors of the shyre of Midlothian wherupon ther is a former stopp of the date the thrid of August Last They of new Doe heirby Stopp the effect of the act of the toune Councill of Edinburgh Complained upon in the said petition And Discharges the same to put to executione untill the thrid day of October nixt to come And Declairs that the brewers in the yeard heads are to doe as formerly before emitting of the said act or proclamation of the toune Councill untill the said day.

Act Charles Stewart of Bigtoune

Anent a petition given in to the Lords of their majesties privy Councill be Charles Stewart younger of Bigtoune for himself and fiftein more of the heritors of Zetland Shewing That quher the said Charles for himself and as Commissioner for the forsaid number of heritors hath raised letters before the saids Lords against the said Commissioners of Supply of these bounds, and Mr John Mitchell ther Collector for oppressione and exorbitant exactiones under the Collour of Levieing of the Supplie to the heavie prejudice of the saids heritors and others They one the other hand hath raised a reconventione upon no other ground save that they alledged themselves to be standared and Calumniat by the forsaid Lybell Albeit they be able to prove it in every point And therin have called not only the said Charles Stewart raised of the forsaid Lybell as Commissioner consitute by the rest Bot his woll fiftein constituents on purpose to vex them by bringing them from Zetland in the harvest and winter seasons, And seing that the said reconvention is evidently groundles, And that as they have Commissionat the forsaid Charles Stewart to pursue for them so they are content to Impower him to answer in their name with ane oblidgment to undergoe any censure or punishment that can be incurred be the said reconvention And Therfore Humbly Craveing the saids Lords would Declair that it should be sufficient for them to make their appearance to the said reconventione by the said Charles Stewart or any other they should name instructed and qualified in maner forsaid And therby to releive the petitioners of the great vexatione and expenses as the comeing from Zetland to Edinburgh upon the forsaid pretended reconventione Must needs Occasion as the said petitione bears The Lords of their Majesties privy Councill haveing Considered the above petition given in to to2 them by Charles Stewart of Bigtoune, They heirby allow any one of the defenders who is Responsall person Called in the Lybell at the instance of the Commissioners of Supply in Orkney and Zetland To Compeir for the haill defenders, The said person Compeiring allwayes sisting himself in name of the haill defenders and becomeing bound and Lyable to satisfie and fulfill any sentance that shall be pronunced in the said proces not only against himself, Bot alsoe against the haill defenders cited or any of them.

Act In favors of the heritors of South Leith.

Anent the petition given in to the Lords of their majesties privy Councill be the kirk session and heritors of the parish of South Leith Humbly Shewing That wheras in pursuance of the saids Lords proclamatione2 founded on the acts of parliament anent the poor and beggers They hade after publict and tymeous intimation mett and in their said meettings sett doune and mett execut account of what Charges the maintaineing of their poor would requyre, And of the fonds in the hands and manadgment of the kirk session that might be therto applyed, And what is wanting to be supplyed by the heritors and other inhabitants of the place, All which they hade done with ther best care and with the consent of all the heritors that keeped their meetting and of the magistrats of the place concurring with them, And doe heirwith also produce extracts of the forsaids overtures and lists agrees upon for the ends forsaids Wherby wanting on their part to bring this Laudable work to a Just accomplishment Nevertheless it is of veritie that ther are severall heritors and inhabitants Refractory who have not only refused payment of the Small thing3 Imposed upon them bot have also abstracted ther weekly Charity at the kirk door this half year bygone and are not Likely in time comeing to behave better Wherfore necessar it is that they have the saids Lords authority Interposed in this matter and that letters may be directed upon the forsaid rolls alse weell for bygones as in time comeing to cause them to make payment or that the saids Lords would allow the magistrats of burghs and the sheriff of Landwart to poynd sumarly for that end, and that no suspension be granted except upon payment or if granted Otherwayes to declare and certifie that the persone Suspending if the suspensione be discussed in his contrary shall by the same Decreet be Decerned each of them in the Soume of twentie punds Scots for expenses and damnadges it being visibly Imposible to effectuat so good a work at a low rate, And Therfore Humbly Craveing to the effect underwritten as the petition it self at more length bears With the which petition the petitioners of the quotta land upon the heritors and Act In favors of the heritors of South Leith.

Anent the petition given in to the Lords of their majesties privy Councill be the kirk session and heritors of the parish of South Leith Humbly Shewing That wheras in pursuance of the saids Lords proclamatione2 founded on the acts of parliament anent the poor and beggers They hade after publict and tymeous intimation mett and in their said meettings sett doune and mett execut account of what Charges the maintaineing of their poor would requyre, And of the fonds in the hands and manadgment of the kirk session that might be therto applyed, And what is wanting to be supplyed by the heritors and other inhabitants of the place, All which they hade done with ther best care and with the consent of all the heritors that keeped their meetting and of the magistrats of the place concurring with them, And doe heirwith also produce extracts of the forsaids overtures and lists agrees upon for the ends forsaids Wherby wanting on their part to bring this Laudable work to a Just accomplishment Nevertheless it is of veritie that ther are severall heritors and inhabitants Refractory who have not only refused payment of the Small thing3 Imposed upon them bot have also abstracted ther weekly Charity at the kirk door this half year bygone and are not Likely in time comeing to behave better Wherfore necessar it is that they have the saids Lords authority Interposed in this matter and that letters may be directed upon the forsaid rolls alse weell for bygones as in time comeing to cause them to make payment or that the saids Lords would allow the magistrats of burghs and the sheriff of Landwart to poynd sumarly for that end, and that no suspension be granted except upon payment or if granted Otherwayes to declare and certifie that the persone Suspending if the suspensione be discussed in his contrary shall by the same Decreet be Decerned each of them in the Soume of twentie punds Scots for expenses and damnadges it being visibly Imposible to effectuat so good a work at a low rate, And Therfore Humbly Craveing to the effect underwritten as the petition it self at more length bears With the which petition the petitioners of the quotta land upon the heritors and Anent a Petition given in to the Lords of their Majesties privy Councill be Mr Alexander Pittcairne principall of the new Collodge of St Androwes Shewing That quher the petitioner by ane Decreet before the Lords dated the tenth day of February Jaj vjc Nyntie one obtained ane warrand to pursue for the writtes of the old Collodges and the writtes belonging to the university in comon And with all ane obligatione under the magistrats of St Androwes their hands quherin they are oblidged to preserve these writtes untill they were called for they haveing been depositat in their hands and taken out of the respective Collodges whill the visitation was readie to depose (and Imediatly therafter deposed) The heads of the Collodge and other members of that university Bot because Doctor Skeen as provest of the old Collodge hade in his Custody the writtes belonging to that Collodge and as rector pre tempore the writtes of the university all standing under his seall The petitioner would not medle with the papers untill the Doctor Delivered them upon oath as he was appoynted by the saids Lords act and Decreet forsaid notwithstanding quherof and letters of horning passing therupon, He still refused to doe the same Bot the case of the old Collodge and university calling for the present use of severall papers The petitioners requyred the writtes according to the saids Lords act from the Magistrats of St Androwes (who before that hade pressed the petitioner from day to day to receive these writtes and Mr Violand to receive the writtes belonging to the new Collodge as being a burthen to them and depryveing them of the most usefull rume in their prison) yet then they refused to deliver them up upon what and whose sugestione the petitioner will not determine, Bot the new Collodge Since the petitioners entrie haveing received Collodge Since the petitioners entrie haveing received so much prejudice through the want of these papers And Therfore Humbly Craveing the saids Lords would appoint and Command the magistrats of St Androwes furth with to deliver up the petitioner those papers belonging to the new Collodge petitioner these papers belonging to the new Collodge as the petition bears.
