Articles and Instructiones for Major Robert Reid and […] according to which and noe otheruayes they are to treat with Michaell Midletoune and the other rebells in the Bass For surrendering and delyvering up therof notwithstanding of the Commission granted to them in Generall termes by the privie Councell for treating uith the saids rebells
primo That ther be ane Ample act of freedome and Indempnity to the said Michaell Midletoune and to all the other persones presently in the said Island of the Bass under his Command for their Lifes Liberties and fortunes And of all past and done by them or any of them against this present government or to the prejudice of any particular persone by sea or Land since their seising and holding out of the said Island of the Bass for the defence or supplie therof For nothing of all which they shall be questioned by any persone or persones at any tyme heirafter Secundo That such persons to be sett doun in List who are Imprisoned upon account of the Bass whither sentenced to death or not with all others who have been in the said garrisone and have Left it since the first day of January Jaj vic nyntie three shall be Indemnified freed and sett at Libertie with this declaratione That noe person whatsoever shall be for heirafter questioned or molested for having Corresponded uith or supplied the said garrisone in any tyme past Tertio That the said Michaell Midletoune uith the other persons in the said Garrisone under his Command shall march out of the said Island uithin tuenty four houres After signing the said Capitulatione uith their suords only And that Boats shall be furnished to them for their safe transport to the shoare at Castletoun Quarto The said Michaell Midletoune and haill other persons uithin the said Island are uithin tuelve houres after the signing the said Capitulatione to delyver up to your possessione the said Island of the Bass uith the Cannon haill armes and amunitione stores boats and others belonging to the said Island or uithin the samen except the suords worne by the saids persones themselves when they come out and the goods afterspecified Quinto That the said Michaell Midletoune shall Condescend under his hand upon the names and designationes of these persones Comprehended in this Capitulatione who are to departe out of this Kingdome for France betuixt and the fixed day aftermentioned wind and weather serving who shall have passes granted to them accordingly for their safe transport betuixt and the said day And Lykewise shall Condescend under his hand upon the names and designationes of the persones forsaids who are to remaine uithin this Kingdome That protectiones may accordingly be given to them upon their Granting bond obleidging themselves to Live peacably uith all submission in the ordinary forme Sexto The said Michaell Midletoune and other persones in the Bass shall be alloued the space of Eight dayes tyme after signing the Capitulatione for transporting out of the Bass the Masts, netts anchors Cables salt and other Goods belonging to themselves and not made use of for the Cran or boats presently Imployed at the Bass And they shall be alloued ane bark or Convenient boats for transporting the saids goods uithout stopp or hinderance and shall be alloued to dispose of them for their oune advantadge Septimo Captain Ferdinando’s men not exceeding the number of Ten are to be alloued a competent aliment untill their going out of the Kingdome which is to be betuixt and the […] day of […] wind and weather serving which is to be the fixed day both for them and these mentioned in the fifth article And a sufficient ship uith provisions shall be ordered for their transport to Dunkirk or Haverdegrace Gratis Octavo upon the offer of this Capitulatione (if accepted) Hostages be presently Delyvered for performance and the Capitulation signed Conforme to the Commission of Councell That possession of the Bass be taken by yow And the persones therin be Carryed ashoar as above And that they repaire to Edinburgh uith all Conveniency Ther to remaine till protections be given to such as are to remaine uithin the Countrey And a ship be made ready for transporting them who are to goe to France and passes granted to them for that effect Nono That the List mentioned in the second article be transmitted to my Lord Chancellor and aggreed to by his Lordship before it be accorded to or the treaty Concluded sic subscribitur Tueeddale cancel: Southerland Annandall Forfar Tarbat Strathnaver Ross Carmichaell Poluarth James Steuart Adam Cockburne Frances Montgomery T Livingstoun John Hall

The Lords of their Majesties privie Councell Considering that they have Lately Emitted a proclamatione In pursuance of the Act of parliament Jaj vic nyntie three anent the taking of horses and armes from such as shall not suear the oath of alleadgance and subscribe the assurance Have thought fitt at this tyme and untill further order to regulat the execution of this proclamatione as folloues viz that the same is not to be putt in executione against any tennents or Labourers for his having or keeping of draught horses plough horse or any other sort of Labouring horse pertaining to himself as ouner thogh above the value mentioned in the Act of parliament or for having of armes beyond the allouance of the said Act And this ordinance of Councell all shirreffs and their deputs baillies of regalities and other officers of the Lau mentioned in the said proclamatione are heirby requyred to observe untill further order as they uill be ansuerable And alloues thir presents to be printed And ordaines printed Coppies therof to be transmitted by their Majesties Sollicitor to the shirreffs and other magistrats forsaids sic subscribitur Tueeddale cancel Southerland Annandale2 Forfar Beilhaven Poluarth James Steuart Adam Cockburn F: Muntgomery

Committee anent a Rable in Edinburgh

The Lords of their Majesties privie Councell doe heirby Recommend to the Earle of Forfar the Laird of Grant and Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this kingdome To take tryall anent the rable which was Lately in Edinburgh or Cannongate and examine the persons alleadged guiltie of or accessione therto whither in prisone or out of prisone and such persons as Can give Evidence against them as the Committie shall receave Informatione from the Magistrats of Edinburgh with pouer to the said Committie to Give sentence against any four of the persons whom they shall find guilty to goe to Flanders as souldiers in their Majesties service And to delyver them to the officers who have Imprisoned four seamen as souldiers to be Carryed abroad by these officers In place of the seamen who are to serve aboard a fyreship presently ordered by the Councell to be sent out against the rebells in the Bass And Recommends to the Committie to reserve one of the persons who shall be found most guilty of the rable to be punished as a publict example to deterr others from being guilty of the Lyke cryme in tyme coming And Recommends to their Majesties advocat to meet uith the said Committie And declares any tuo of the said Committie to be a sufficient quorum In caise the Lord Advocat be present And Recommends to them to meet this day at three In the afternoon

Commission Captain Adams against the Bass

The Lords of their Majesties privie Councell Considering that the Isle and rock of the Bass and rebells therin who have Long held out may now be in some straits for want of privisions And as is Informed are in dayly expectation to be succoured and releived by some of the Enemies ships or vessells that may arryve therat As also that the rebells in the said Island Have of Late had the boldnes to seize a bark uithin the firth For which reasons The saids Lords have already given Commissione for Commanding tuo severall shipps or friggotts furnished and outreiked for watching the said Isle And sesing all shipps bound therto And seing it may be usefull and necessary both for defence of the ships outreicked And for preventing any releiff which may come to the saids rebells from any of their Majesties enemies That a fyreship be reicked out and putt to sea They Have thought good to outreik such a ship And in absence of the Duke of Hamilton Lord High Admirall and in the present exigence to Give Commission to the persone afternamed to Command the said fyreship for to watch the said Bass And to hinder all manner of provisions or supplies to be brought or Entered into it And Lykeuayes to secure the ships and vessells belonging to his Majesties Leidges that may be in hazard from their attacks and surprises and the saids Lords Having speciall Confidence and trust in the Loyaltie Cowrage and good conduct of […] Adams Leivtennant to the artillery Company Have therfore nominated and appointed And heirby nominat and appoint The said Leivtennant Adams to be Captaine of the ship called the […] uith all amunitione and matterialls proportionable as a fyre ship Commissionat in their Majesties service To the speciall effect underwryten allenarly Giving Granting and Committing to the said Captain […] Full pouer warrand Commission and charge to saile furth the forsaid fyreship provyded as above to watch the forsaid Island and fort of the Bass And for that end to Cruise betuixt St Abbs head and Fifeness day and night uith all care and dilligence And to seise all shipps whatsoever great or small bound or Justly suspect to be bound for the said Isle and fort of the Bass or to any other port uithin the Firth For the supplying and releiving therof uith any sorts of provisions of men victuall armes amunitione or others whatsoever And if need beis upon resistance to fight sink burne and destroy or otheruayes overmaster the saids shipps or vessells And to burne and Consume the said fyreship itself and matterialls therin as he shall see Cause upon the saids Enemy and shipps or vessells And Lykeuayes to seise all shipps boats or vessells whatsomever coming from the Bass And in case of resistance to fight sink burne and destroy or otherwayes overmaster them And to burne and Consume the said fyreship as above And Generally to watch and shutt up the said rock and Island and rebells therin uith all possible care and stricknes and use all manner of hostility against them for that effect And to reduce them by all methods possible And ordaines the said Captaine to preserve harmles and skaithles all shipps and vessells whatsomever uith their goods and Loading belonging to their Majesties good subjects or alleyes from all attempts and violences from the saids rebells or any other their Majesties enemies As also Gives full pouer and Commission to the said Captaine […] to seise all shipps and vessells belonging to Enemies in proppertie or having Commission from them uithin the Firth or bounds above appointed for the said fyreships Cruising And that if need beis by fighting destroying or otheruayes overmastering the saids Enemies as he shall see Cause And to bring the shipps or vessells so over mastered and apprehended to any port or harbour uithin this kingdome uithout breaking bulk or altering the propperty therof To be proceeded against and Judged according to Law in the high Court of admirality in this Kingdome or such other Court or Courts as by a particular and speciall warrand and Commission shall be sufficiently authorized to doe the samen And to the effect that after such proceedings and adjudicationes the saids enemies ships and goods be sold and disposed of as of right appertaining provyded alwayes that of such shipps and vessells as also out of waires and merchandise whatsoever found aboard the saids vessells as shall be Judged Laufull prise Ther be payed to the Lord high Admirall the tenths or to any who shall have sufficient warrand and pouer to receave the same And the Remainder to be disposed off by the Lords of their Majesties thesaury for their Majesties use authorizing the said […] Generallie to doe and performe all and every thing touards the executione of the haill premisses as is necessary and requisite promitting to hold firme and stable all and whatsoever shall be Laufullie done by the said Captain […] by vertue of these presents and ordaines this Commission to Continow and Endure ay and while the The Lords of their Majesties privie Councell doe heirby approve of what the Lord High Chancelor hes done in Recommending to Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this Kingdome To Cause Carray auay from the Isle of the May the sheep or Coues which were therin and2 feeding therupon And to remove the garrisone which hes been keeped in the said Island In respect the rebells in the Bass have at severall tymes supplied themselves uith sheeps or other Catle from that Island And discharges […] Cunyngham of Barns who is propriator of the said Island to putt or suffer to be putt therinto any Sheeps or other beasts which if seised by the saids rebells may be usefull or helpful unto them so long as the said Island shall Continow in the hands of the rebells And ordaines him to find Caution for that effect in the Councell books under the paine and penaltie of being Judged and treated as ane Corresponder uith the rebells in the said Island And ordaines Letters of horning to be direct heiron at the Instance of their Majesties Sollicitor for charging the said […] Cunynghame of Barnes to the effect forsaid upon tuenty four hours if he be uithin the burgh of Edinburgh otheruayes within six dayes
