Act James Irvine Macer

Anent the petitione given in to the Lords of their Majesties privie Counsell Be James Irvine macer Sheuing That the petitioner Having fallen into the misfortune in Letting yesterday Androw Baird escape out of the Committie room It is Humblie represented to his Grace and their Lordships That he Having at the present juncture three Gentlemen in custody And not knouing that any of them were In any worse Circumstance then ane other Ther Came Into the Committie room such ane Croud of poeple their Lordships sitting in Councell and George Weir the other macer Carrying Gairletoune to prisone that the said Andrew Baird made his escape For It is nottourly knouen that the petitioner hes been very valitudinary all this uinter being sick near unto death His Grace and the saids Lords knoues He did nevar fall into the lyke misfortune of before And therfore Humblie Craving his Grace and their Lordships to take the premisses to their consideratione and to sett the petitioner at Liberty as the said petitione bears Their Majesties High Commissioner and Lords of privie Counsell having Considered this petitione Given In to them Be the above James Irvine They heirby Give ordor and uarrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett the petitioner at Liberty furth therof And Have depryved and heirby depryves the said James off his office untill He produce and cause secure the persone of the said Androw Baird whom He suffered to escape by his negligence

Their Majesties High Commissioner and Lords of privie Councell Doe Heirby Recommend to the Lord Strathnaver and Sir James Muncreiff to meet uith Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this kingdome to Concerte uith him what armes will be necessary for their regiments And Recommends to the Lords Commissioners of their Majesties Thesaury to Give out for the use of these regiments such Arms as shall be Condescended upon by them upon the obleidgement of the said Lord Strathnever and Sir James Muncreiff to restore the same when requyred

Their Majesties High Commissioner and Lords of privy Councell Doe Heirby Recommend to the Earle of Drumlangrig Earls of Argyle Leven Annandale and Forfar Lord Viscount Stair Lord Raith Thesaurer depute Lord Carmichaell Lord Beilhaven Lord Polluarth Lord Secretarie Lord Advocat Lord Justice Clark Mr Frances Muntgomery Sir John Maxuell and Sir Thomas Livingstoune or any fyve of them who are Heirby declared to be a Quorum To Consider what measures and methods are propper to be taken for securing the peace of the Natione and putting the same In a posture of defence suitable to the present exigences And to Consider what persones are fitt to be nominat for administrating the oath of alleadgance and assurance to the persons who are appoynted to take the same Before such as the Counsell shall nominat And to report to the Councell the morrow at their meeting in the forenoon

Act for Imprisoning Captain Maitland

The uhich day Captaine James Maitland who is under bale before the Lords of privie Councell That he shall Live peaceably under his Majesties government and appear before the Councell when called for Being charged upon his bond to appear as said is And Having appeared accordingly and Having refuised to suear and signe the oath of alleadgance and signe the assurance to their Majesties King William and Queen Mary appoynted by Act of parliament Their Majesties High Commissioner and Lords of privie Counsell Doe Heirby Give ordor and warrand to the Macers of privie Councell to Carry him prisoner to the tolbooth of Edinburgh untill he find other sufficient Cautione then William Douglas taylior in Edinburgh his former Cautioner That He shall Enter himself prisoner uithin the Castle of Stirling at any tyme before elapsing of teusday nixt the threttieth day of May Instant And In the mean tyme that he shall Live peaceably under and uith all submissione to the government of their Majesties King William and Queen Mary And that he shall not Act consult or contryve any thing in prejudice therof nor shall not converse or Correspond uith rebells under the penaltie of five Thousand merks scotts money Contained in his former bond In case He shall transgress in any part of the premisses And upon receaving of a new bond appoyntes the Clerks of privie Counsell to Give up the former bond And to sign a warrand for the Magistrats of Edinburgh to sett the said Captain James Maitland at Liberty

The which day Leivtennant Collonell Winrhame under bale Before the Lords of privie Counsell That he shall Live peacably under their Majesties Government and appear before the Councell when called for Being charged upon his bond to appear as said is And having appeared accordingly and refuised to suear and signe the oath of alleadgance and signe the assurance to their Majesties appoynted by Act of Parliament Their Majesties High Commissioner and Lords of privie Councell Doe Heirby appoynte the said Leivt Collonell Winrhame to Enter himself prisoner uithin the castle of Stirling at any tyme before elapsing of Satturnday the third of Junij nixt And ther to Continow prisoner till farder ordor of Councell And alloues the Clarks of Councell to Give up the former bond given be the said Leivt Collonell and his Cautioners In respect The Councell Hes taken the said Leivt Collonell his verball parroll of honour that he shall enter himself prisoner in the said castle betuixt and the tyme forsaid

Their Majesties High Commissioner and Lords of privie Counsell Doe Heirby Recommend to the Lords Commissioners of their Majesties Thesaurie To Cause payment be made to John Reid and William Burne servitors to Sir William Baird younger of Newbyth of the soume of Tuenty pounds sterline for apprehending James Midletoune And the Lyke soume of Tuenty pounds sterline for apprehending William Nicolsone tuo of the rebells who were in the bass and taken by them And that as the reuard promised by the Councell to the apprehenders of the saids tuo rebells And Recommends to the saids Lords Commissioners of their Majesties Thesaury to Consider what reuard they think fitt to be Given to the saids John Reid and William Burne for apprehending of William Wotham whom they took in Company with the saids tuo rebells And Cause payment be made to them of the same
