Act in favors of the Inhabitants within the Shyre of Aberdeen

The Lords of their Majesties privy Councill haveing Considered the accompts given In to them as resting be their majesties forces to the inhabitants within the shyre of Aberdeen and severall Presbytries therof aftermentioned with the instructiones and verificationes of these accompts Togither with a petitione given in be the Commissioners of Supplie for the said shyre of Aberdeen Craveing that it might be recomended to the Lords of thesaurie to make payment of the totall soume of the saids accompts without Defauliatione, And that it might be reserved to the petitioners to insist in menner underwritten The saids Lords Finds that their are a great many articles of the saids accompts either in instructed or not in the termes of the proclamatione and acts of Councill made anent the inbringing instructing and allowing of the accompts resting be the forces to the Countrey and particularly that they are not in the termes of the act of Councill of the date the nynth day of Jully last And Therfore the saids Lords Rejects all these articles And They Find That besydes the articles respected as said is Ther are resting be their majesties forces as they are after stated in Companies Troops or Regiments to the inhabitants of the said shyre of Aberdeen and six severall presbytries therof following as the samen are placed in order after sett doune viz The presbytrie of Ellon, Aberdeen, Offord, Kincardin-Oneill, Garioch and Turreff the articles and sommes following, Which they find to be suficiently verified and proven aither by recepts tickets or subscryved accompts under the hands of the persones souldiers or officers to whom the samen was furnished, or by the oathes and depositiones of the persones furnishers taken before the Commissioners of the Supplie for the said shyre of Aberdeen Conforme to the saids recept, tickets subscryved accompts and Reports of the saids Commissioners before whom the forsaid Depositiones ware taken subscryved by those Commisioners all produced to and Considered be the saids 2 Lords And First They Find that ther is resting be the saids Forces to the inhabitants of the said shyre of Aberdeen within the said Presbytrie of Ellon as Followes Imprimis By the Lord Cardross his Regiment of Dragoons the Soume of Twentie two punds four shilling scots Item by the Master of Forbes his Troop of horse, Two Hundred and fiftie one pund Sixtein shilling Eight penies money forsaid, Item by my Lord Elphingstoune his troop Eleven shilling two pennies Extending the Soumes forsaid resting to the inhabitants of the said Presbytrie of Ellen To the Soume of Two Hundred Seventie four punds Eleven shilling ten pennies And Finds that ther is resting to the inhabitants of the said shyre of Aberdeen within the said presbytrie of Aberdeen as followes viz By the Lord Rollo his troop of horse the soume of Thrie hundred seventie seven punds two shilling scots money Item by the Lord Cardross his Regiement of Dragoons ten pund thrie shilling Eight penies scots Item by Captaine Home of Nynwalls his troop in the said Regiment Fiftie pund seventein shilling thrie pennies Item by Captain Muir his troop in the said due by their majesties forces as they are stated upon the severall Companies Troops and regiments in maner above sett doune to the inhabitants of the said shyre of Aberdein within the severall Presbytries therof abovementioned altogither in the haill to the soume of five thousand and sixtie nyne pund thrie shilling five pennies scots, And the saids Lords Finds that the haill articles quherof this soume is made up ware all furnished befor the act of parliament of the date the tenth day of september Jaj vjc nyntie years, appoynting thrie moneths cess, and herth money for payment of the soumes resting be their majesties forces to the Countrey, And bygone arreirs due to the army and that the said articles are al in the termes of the said act of Councill of the date the nynth day of Jully last by past And the saids Lords Finds that the said soume of Five Thousand and sixtie nyne pund thrie shilling four pennies is to be payed to the saids inhabitants of the said shyre of Aberdeen out of the thrie moneths Cess and hearth money appoynted by the above act of Parliament, And Recommends to the Lords Commissioners of their majesties thesaurie to cause payment of the same to be made to them accordingly, And besydes the articles abovewritten The saids Lords Finds it suficiently instructed by the oath and Depositione of Alexander Burnet Chamberlan of Meldrum taken by two Commissioners of Supplie within the said shyre of Aberdein produced to and Considered by the saids Lords That ther was ten bolls of great oats with the Fodder taken off the said Alexander Burnet his Lands by order of the Lord Cardross in September Jaj vjc nyntie years and Caried away to Aberdeen and other places wher he did appoint by Countrey horsses at ten merks the boll Is ane Hundreth merks Scots And the saids Lords Finds that the said soume of ane hundred merks is to be paye to the said Alexander Burnet out of the said thrie moneths cess and hearth money And Recomends him to the Lords of their Majesties thesaurie for payment of the same accordingly, And Reserves to the said Commissioner of Supply to insist for the remaines of the accompts resting to the said shyre by the forces under English pay Whither for corne and straw meat and drink voluntarly furnished to them or for cornes eaten and distroyed be them, or Catle Sheep and others taken by them and also Reserves actiones against the army for debts contracted by them since the tenth day of September Jaj vjc nyntie.
