Anent the petitione given in to the Lords of there majestyes privie Councill be Robert Clerk prisoner in the tolbooth of Edinburgh Shewing That the petitioner Haveing by there Lordships order been closs prisoner these tuenty Four dayes bygone for his procureing and furnishing severall corrosive drugs to Doctor Mcghie for makeing Mr Pains escape And he haveing made ane Ingenous Confession of all he knew of the said matter and particularly his knowledge of the said designe which he shall not presume to alleviat or plead any excuse for only that it wes not the effect of any evill will or prejudice to the government But of too much facility of nature and youth And since he hes now suffered tuenty four dayes Closs Imprisonement to the great prejudice of his health and ruine of his Imployment And that he hade no other accessione to the forsaid designe then what he hes alreadie freely acknowledged And therefor Craveing that there Lordships would be pleased out of there Clemencie to pass by the petitioners rash and unwarrantable follie In Councealling the forsaid designe of makeing Mr Pains Escape And to ordain the petitioner to be sett at Liberty upon his finding Cautione To ansuer when called as the said petitione bears The saids Lords of there majestyes privie Councill Haveing considered this petitione given in to them be the above Robert Clerk They hereby Give order and warrand to the Magistrats of Edinburgh and keeper of there tolbooth to sett the petitioner at Liberty furth thereof In respect he hes found sufficient Cautione acted in the books of privie Councill that he shall Live peaceably and with all submission under there Majesties King William and Queen Mary and that he shall not act consult nor contryve any thing in prejudice thereof And that he shall not converse nor correspond with any of there saids majestyes rebells And that he shall appear before the saids Lords of privie Councill when called for under the penalty of Fifty pound sterling

Concerning the petition given in to the lords of their majesties’ privy council by Robert Clerk, prisoner in the tolbooth of Edinburgh, shewing that the petitioner, having by their lordships’ order been close prisoner these twenty-four days bygone for his procuring and furnishing several corrosive drugs to Dr McGhie for making Mr [Neville] Payne’s escape, and he having made an ingenuous confession of all he knew of the said matter and particularly his knowledge of the said design which he shall not presume to alleviate or plead any excuse for, only that it was not the effect of any evil will or prejudice to the government but of too much facility of nature and youth, and since he has now suffered twenty-four days’ close imprisonement to the great prejudice of his health and ruin of his employment and that he hade no other accession to the foresaid design then what he has already freely acknowledged, and therefore craving that their lordships would be pleased out of their clemency to pass by the petitioner’s rash and unwarrantable folly in concealing the foresaid design of making Mr Payne’s escape, and to ordain the petitioner to be sett at liberty upon his finding cautione to answer when called as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Robert Clerk, they hereby give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth to set the petitioner at liberty furth thereof in respect he has found sufficient caution acted in the books of privy council that he shall live peaceably and with all submission under their majesties King William and Queen Mary and that he shall not act consult nor contrive anything in prejudice thereof, and that he shall not converse nor correspond with any of their said majesties’ rebels, and that he shall appear before the said lords of privy council when called for under the penalty of £50 sterling.
