Liberatione Mr Nicolas Dunbar

Anent the petitione Given into the Lords of there majesties privie Councill be Mr Nicholas Dunbar prisoner of warr in the Canongate Tolbooth Shewing That whereas the petitioner he been prisoner of warr since the surrender of the Castle of Fedderett upon Capitulatione Recorded in the Saids Lords there books and subscryved be the Duke of Hamiltone Containing in the secund article promise of Libertie for goeing abroad to such as might desyre it And to such as would stay at home Liberty upon baill of peaceable behaviour And sieing this hes been granted to others of his Circumstances And therefore Craveing that the saids Lords would be pleased to grant to the petitioner aither Liberty to goe abroad and ane Competent tyme for provydeing himself amongst his freinds not haveing where with to be transported and mantained or otherwayes Libertie to Live amongst them at home upon baill of peaceable behaviour Recomending the house dues to the theasurie The petitioner being there Lordships alimented prisoner And in case there Lordships grant nether, That he may be allowed the benefite to walk abroad some houres of the day for his health being most Infirme He Finding baill to returne in due tyme And to ordaine Sir Patrick Murray to continow the payment of his former aliment at tuelve Shilling per diem As the said petitione bears The Saids Lords off there majestyes privie Councill Haveing considered this petitione Given in to them be the above Nicholas Dunbar They hereby Giver order and warrand to the magistrats off Edinburgh Bailzies of the Canongate and to the Keeper of there tolbooth To sett the petitioner at Liberty furth thereoff In respect he hes found sufficient Cautione acted in the books of privie Councill That he shall Live peaceablie and with all submissione to the present government of there majestyes King William and Queen Mary And that he shall not act Consult nor contryve any thing in prejudice thereof And that he shall not converse with rebells And that he shall appear befor the saids Lords of privie Councill when called for under the penaltie of Fyve Hundreth [pounds] Scotts money In case he shall transgress in any pairt of the premises And recomends to the Lords Comissioners of there Majestyes theasurie to cause payment be made to James Hamiltoun keeper of the tolbooth of the Canongate of the petitioners house dues.

Concerning the petition given into the lords of their majesties’ privy council by Mr Nicholas Dunbar, prisoner of war in the Canongate tolbooth, showing that whereas the petitioner has been prisoner of war since the surrender of the castle of Fedderate upon capitulation recorded in the said lords their books and subscribed be [William Hamilton] the duke of Hamilton, containing in the second article promise of liberty for going abroad to such as might desire it, and to such as would stay at home liberty upon bail of peaceable behaviour, and seeing this has been granted to others of his circumstances, and therefore craving that the said lords would be pleased to grant to the petitioner either liberty to go abroad and a competent time for providing himself amongst his friends, not having wherewithal to be transported and maintained, or otherwise liberty to live amongst them at home upon bail of peaceable behaviour, recommending the house dues to the treasury, the petitioner being their lordships’ alimented prisoner. And in case their lordships grant neither, that he may be allowed the benefit to walk abroad some hours of the day for his health, being most infirm, he finding bail to return in due time. And to ordain Sir Patrick Murray to continue the payment of his former aliment at twelve shillings per day, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Nicholas Dunbar, they hereby give order and warrant to the magistrates of Edinburgh, bailies of the Canongate, and to the keeper of their tolbooth, to set the petitioner at liberty forth thereof, in respect he has found sufficient caution acted in the books of privy council that he shall live peaceably and with all submission to the present government of their majesties King William and Queen Mary, and that he shall not act, consult, nor contrive anything in prejudice thereof, and that he shall not converse with rebels, and that he shall appear before the said lords of privy council when called for under the penalty of five hundred pounds Scots in case he shall transgress in any part of the premises. And recommends to the lord commissioners of their majesties’ treasury to cause payment [to] be made to James Hamilton, keeper of the tolbooth of the Canongate, of the petitioner’s house dues.
