Liberatione Captain Johnstoun

Anent the petitione Given in to the Lords of there majesties privie Councill be Captain Johnstoun present prisoner in the tolbooth of Edinburgh Shewing That whereas the petitioner Continowes ane prisoner of warr since the surrender of the Castle of Fedderett to Collonell James Buchan And there being act of Councill in the petitioners favours That who should find baill for Fyve Hundreth merks to Live peaceablie in the Kingdome should be Liberate from prisone and the petitioner haveing in Apryll Last presented ane petitione to the saids Lords Craveing that there Lordships might ordaine there Clerks to receave the forsaid bail which there Lordships were pleased to grant to others of the Lyke Circumstances The saids Lords were pleased to delay to give ansuer to the said petitione untill some tyme in maij or Junij last And now that the forsaid tyme is expyred And that the petitioner hes been this Tuenty moneths bygone prisoner to the great prejudice and destructione of his health And therefore Craveing that the saids Lords would be pleased to considder the premises And grant warrand to there Clerks to receave the forsaid baill from the petitioner Recomending the house dues to the theasurie The petitioner being there Lordships alimented prisoner or else grant the petitioner Libertie to walk abroad some houres in the day for his health which the saids Lords have been pleased to grant to others of the petitioners Circumstances And the petitioner is content aither to goe with ane Centrie or find Cautione as aforsaid As the said petitione bears The Saids Lords of there majesties privie Councill haveing considered this petitione Given in to them be the above Captain Johnstoun They hereby give order and warrand to the magistrats of Edinburgh and keeper of there tolbooth To sett the petitioner at Liberty furth thereof He first befor his Liberatione giveing bond and finding sufficient Cautione acted in the books of privie Councill That he shall Live peaceablie and with all submissione to the present government under there majestyes King William and Queen Mary And that he shall not act Consult or contryve any thing in prejudice thereof And that he shall not converse nor Correspond with any rebells And that he shall not depairt furth of the toun of Edinburgh and suburbs therof and shall appear befor the Lords of there majestyes Councill when Called for under the penalty of Fyve Hundreth merks And Recomends to the Lords of there majestyes theasurie to Cause satisfactione to be made to the maister of the tolbooth for the petitioners house dues.

Liberation of Captain Johnstoun

Concerning the petition given in to the lords of their majesties’ privy council by Captain Johnstoun, present prisoner in the tolbooth of Edinburgh, showing that whereas the petitioner continues a prisoner of war since the surrender of the Castle of Federate to Colonel James Buchan and there being act of council in the petitioner’s favour that who should find bail for five hundred merks to live peaceably in the kingdom should be liberated from prison and the petitioner having in April last presented a petition to the said lords craving that their lordships might ordain their clerks to receive the forsaid bail which there lordships were pleased to grant to others of the like circumstances, the said lords were pleased to delay to give answer to the said petition until some time in May or June last, and now that the forsaid time is expired and that the petitioner has been this twenty months bygone prisoner, to the great prejudice and destruction of his health, and therefore craving that the said lords would be pleased to consider the premises, and grant warrant to their clerks to receive the forsaid bail from the petitioner recommending the house dues to the treasury, the petitioner being their Lordships alimented prisoner, or else grant the petitioner liberty to walk abroad some hours in the day for his health, which the said lords have been pleased to grant to others of the petitioner’s circumstances, and the petitioner is content either to go with ane sentry or find caution as aforesaid, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Captain Johnstoun they hereby give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth to set the petitioner at liberty furth thereof, he first before his liberation giving bond and finding sufficient caution acted in the books of privy council that he shall live peaceably and with all submission to the present government under their majesties King William and Queen Mary, and that he shall not act, consult or contrive anything in prejudice thereof, and that he shall not converse or correspond with any rebels, and that he shall not depart furth of the town of Edinburgh and suburbs thereof, and shall appear before the lords of their majesties’ council when called for under the penalty of five hundred merks and recommends to the lords of their majesties’ treasury to cause satisfaction to be made to the master of the tolbooth for the petitioner’s house dues.
