Act Heretors of Enstruther wester for stipend

Anent the petitione Given in to the Lords of there Majesties privie Councill be Mr Robert Weems of Graingemuir patrone of the paroch kirk of Enstruther Wester and Remanent Heretors and Gentlemen of the said paroch And Bailzies and Councill of the Burgh of Enstruther Wester Shewing That where the said kirk is still vacant be the depositione of Mr Thomas Auchinlect Late minister there in anno Jaj vjc and Eightie nyne And the said kirk being old and ruinous in the rooff and walls And the manse quyt ruinat And with all the Landward paroch verie Small and Inconsiderable And the burgh altogether depauperat and few Inhabitants therein In respect of the totall decay of trade and Comerce The Heretors are not able to repair and rebuild the said old kirk and manse unles they would repair upwards of tuo years rent of there Lands in the paroch which would be verie hard And the petitioners being unanimously willing and desyreous to have the kirk and manse repaired and planted They are desyrous to bestow the small stipend and rent of the gleib which is the smallest within the presbitrie of St Andrews for the vacant cropts Jaj vjc and nytie, Jaj vjc and nyntie one and Jaj vjc and nyntie tuo years for the saids reparationes and other pious uses within the said paroch which will be most charitable works and altho by Law patrones are allowed to dispose of vacant stipends for pious uses within the paroch with consent of the heretors yet the petitioner the said patrone would not take on him to doe any thing therein without the saids Lords there authoritie and approbatione And therefore Craveing to the effect underwreitten As the said petitione bears The Saids Lords of there majesties privie Councill Haveing considered this petitione Given into them be the above Mr Robert Weems and others They hereby allow the stipend of the above kirk of Enstruther Wester and rent of the Gleeb for the years Jaj vjc and nyntie Jaj vjc and nyntie one and Jaj vjc and nyntie tuo To be Imployed for repairing of the said kirk and manse and other pious uses within the said paroch And nominates and appointed Mr Robert Smith of Giblestoun to be factor for up lifting the saids three years stipends and rent of the gleeb dureing the saids years And ordaines the present heretors wodsetters Lyfrenters possessors and others Lyable in payment of the saids stipends And the possessers of the said Gleeb And Intromitters with the rent thereof dureing the saids years To make make2 payment to the said factor of the samen And ordaines Letters of horning under the signet of Councill to be direct hereon upon productione of a decreet of Locality And in case there be none ordaines these Lyable in payment to the said factor as they shall be decerned be the Judge ordinarie In respect the said factor hes found sufficient Cautione acted in the books of privie Councill That he shall Imploy the saids stipends and rent of the glebe for the ends forsaids

Act for the heritors of Anstruther Wester for stipend

Regarding the petition given in to the lords of their majesties’ privy council by Mr Robert Wemyss of Grangemuir, patron of the parish kirk of Anstruther Wester and the other heritors and gentlemen of the said parish, and bailies and council of the burgh of Anstruther Wester, showing that where the said kirk is still vacant by the deposition of Mr Thomas Auchinleck, late minister there in anno 1689, and the said kirk being old and ruinous in the roof and walls and the manse quite ruined, and with all the landward parish very small and inconsiderable and the burgh altogether impoverished and few inhabitants therein in respect of the total decay of trade and commerce, the heritors are unable to repair and rebuild the said old kirk and manse unless they would use upwards of two years’ rent of their lands in the parish, which would be very hard, and the petitioners being unanimously willing and desirous to have the kirk and manse repaired and planted, they are desirous to bestow the small stipend and rent of the glebe which is the smallest within the presbytery of St Andrews, for the vacant crops 1690, 1691 and 1692 for the said repairs and other pious uses within the said parish which will be most charitable works, and although by law patrons are allowed to dispose of vacant stipends for pious uses within the parish with consent of the heritors, yet the petitioner the said patron would not take on him to do anything therein without the said lords’ authority and approval, and therefore craving to the effect underwritten, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given into them by the above Mr Robert Wemyss and others, they hereby allow the stipend of the above kirk of Anstruther Wester and rent of the glebe for the years 1690. 1691 and 1692 to be employed for repairing the said kirk and manse and other pious uses within the said parish And nominates and appointed Mr Robert Smith of Gibliston to be factor for up lifting the said three years’ stipends and rent of the glebe during the said years, and ordain the present heritors, wadsetters, liferenters, possessors and others liable for payment of the said stipends and the possessors of the said glebe and intromitters with the rent thereof during the said year to make payment to the said factor of the same, and ordain letters of horning under the signet of council to be directed hereon upon production of a decreet of locality, and in case there is none, they ordain those liable for payment to the said factor as they shall be discerned by the judge ordinary, in respect that the said factor has found sufficient caution acted in the books of privy council that he shall employ the said stipends and rent of the glebe for the ends foresaid.
