Act Mr James Wilson for stipend

Anent the petitione Given into the Lords of there Majesties privie Councill be Mr James Wilson minister at the united churches of Cowend and Southwick Shewing That where in August Jaj vjc and Eightie Nyne The petitioner wes violently ejected from his church And he and his poor familie thereafter case out of the manse And else aneother Gentlemans house in the said paroch And on ane sabbath day abused in there persones And there wholl plenishing broken and destroyed And that by strangers out of other paroches And the petitioners cropt for the said year violentlie taken from him, In which paroch The petitioner hade Lived for severall years in peace and quyett And hade travelled in the exercise of the ministrie to the Content and satisfactione of his pariochiners As ane testificat under the hand of the wholl heretors of the said paroches Directed to the Duke of Queensberry as patrone produced with the said petitione hes appeared since which tyme The petitioner and his poor familie have been reduced to great straitts and wants And have expended not only the small means they hade But also have been necessitat to Contract debts for there Subsistance and Lyvelyhood And sieing That the Duke of Queensberrie His Grace patrone of the saids paroches Commiserating the present state and Conditione of the petitioner and his family is willing and desyrous that the petitioner should have the benefite of the stipend of the saids paroches Dureing the vacancie thereof viz the cropts and years of God Jaj vjc Eightie nyne Jaj vjc nyntie, Jaj vjc nyntie one, and Jaj vjc nyntie tuo years And that the Heretors and parochiners of the said paroch are readie willing to make payment to the petitioner of the samen As appears by the forsaid testificat And therefore Craveing that there Lordships would be pleased to Consider the present state and conditione of the petitioner and his familie And ordaines the heretors Lyfrenters tennents and others Lyable in payment of the said stipend To make payment to the petitioner of the samen for the cropts and years of God abovewreitten And that Letters may pass for payment thereof which will be ane act of great mercie done to the petitioner and his poor family As the said petitione bears The Saids Lords of there Majesties privie Councill Haveing considered this petitione Given in to them be the above Mr james Wilsone with the testificat under the hands of the heretors mentioned therein and produced therewith And that the Earle of Linlithgow declared in Councill That the Duke of Queensberrie is patrone of the above kirks of Cowend and Southwick And consented to the Granting of the petitione The Saids Lords doe hereby allow to the petitioner the stipend of the forsaids kirks of Cowend and Southwick for the Cropts and years of God Jaj vjc Eightie Nyne Jaj vjc and nyntie and Jaj vjc and nyntie one and ordaines him to be readily ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning under the signet of Councill at the petitioners Instance againest them for that effect He produceing a decreet of Locality And in case there be none ordaines these Lyable to make payment to the petitioner of there respective proportiones of the saids three years stipend according as they shall be decerned be the Judge ordinarie In respect the petitioner hes sworne and signed the oath of alleadgeance to there majesties King William and Queen Mary and signed the assureance prescryved be act of parliament And that before ane of the Lords of privie Councill.

Act for Mr James Wilson for stipend

Regarding the petition given in to the lords of their majesties’ privy council by Mr James Wilson, minister of the united churches of Colvend and Southwick, showing that where in August 1689 the petitioner was violently ejected from his church and he and his poor family thereafter cast out of the manse and of another gentleman’s house in the said parish and on a Sabbath day abused in their persons, and their whole goods broken and destroyed and that by strangers out of other parishes, and the petitioner’s crop for the said year violently taken from him, in which parish the petitioner had lived for several years in peace and quiet and had travelled in the exercise of the ministry to the contentment and satisfaction of his parishioners, as a certificate under the hand of all the heritors of the said parishes directed to the duke of Queensberry as patron produced with the said petition has appeared, since which time the petitioner and his poor family have been reduced to great straits and wants and have expended not only the small means they had but also have been necessitated to contract debts for their subsistence and livelihood, and seeing that the duke of Queensberry his grace, patron of the said parishes, commiserating the present state and condition of the petitioner and his family, is willing and desirous that the petitioner should have the benefit of the stipend of the said parishes during the vacancy thereof, viz: the crops and years of God 1689, 1690, 1691 and 1692, and that the heritors and parishioners of the said parish are ready and willing to make payment to the petitioner of the same, as appears by the foresaid certificate, and therefore craving that their lordships would be pleased to consider the present state and condition of the petitioner and his family, and ordain the heritors, liferenters, tenants and others liable for payment of the said stipend to make payment to the petitioner of the same for the crops and years of God above written, and that letters may pass for payment thereof which will be an act of great mercy done to the petitioner and his poor family, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Mr James Wilson with the certificate under the hands of the heritors mentioned therein and produced therewith, and that the earl of Linlithgow declared in council that the duke of Queensberry is patron of the above kirks of Colvend and Southwick, and consented to the granting of the petition, the said lords hereby allow to the petitioner the stipend of the foresaid kirks of Colvend and Southwick for the crops and years of God 1689, 1690 and 1691 and ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters and others liable for payment of the same, and they ordain letters of horning under the signet of council at the petitioner’s instance against them for that effect, he producing a decreet of locality, and in case there is none, they ordain those liable to make payment to the petitioner of their respective proportions of the said three years’ stipend according as they shall be discerned by the judge ordinary in respect the petitioner has sworn and signed the oath of allegiance to their majesties King William and Queen Mary and signed the assurance prescribed by act of parliament, and that before one of the lords of privy council.
