Anent the petitione Given in to the Lords of there Majesties privie Councill be Mathew Latimer and James Johnstoun in Lochmaben paroch presently prisoners in the tolbooth of the Canongate Shewing That where the petitioners being about there Imployments as Countriemen were seized upon and brought to Edinburgh some moneths agoe for there haveing accession (as wes alleadged) to the proclameing of a paper at the croce of Sanquhar The petitioners being examined declared that they were not there at the tyme as there declarationes in the Clerks hands hes testifyed And yet altho others in the same Circumstances with the petitioners are Long agoe sett at Liberty And the petitioners for these severall dayes bygone so sick that they are tyed to there beds As if nead be is the Goodman of the tolbooth could Informe there Lordships of yet they are to this hour detained in prisone to th eoutter ruine of the petitioners and there small interests And therefore Craveing to the effect underwreitten as the said petitione bears The Saids Lords of there majesties privie Councill Haveing Considered this petitione Given in to them be the above Mathew Latimer and James Johnstoun They hereby give order and warrand to the magistrats of Edinburgh Bailzies of the Canongate and Keeper of there tolbooth To Sett the petitioners at Liberty furth thereof.

Liberation for Latimer and Johnston

Regarding the petition given in to the lords of their majesties’ privy council by Matthew Latimer and James Johnston in Lochmaben parish, presently prisoners in the tolbooth of the Canongate, shewing that where the petitioners being about their employments as countrymen were seized upon and brought to Edinburgh some months ago for their having accession (as was alleged) to the proclaiming of a paper at the cross of Sanquhar, the petitioners being examined declared that they were not there at the time as their declarations in the clerk’s hands have testified, and yet although others in the same circumstances as the petitioners are long ago set at liberty and the petitioners for several days past so sick that they are tied to there beds as if need be the goodman of the tolbooth could informe their lordships of, yet they are to this hour detained in prison to the utter ruin of the petitioners and their small interests, and therefore craving to the effect underwritten, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Matthew Latimer and James Johnston, they hereby give order and warrant to the magistrates of Edinburgh, bailies of the Canongate and keeper of their tolbooth to set the petitioners at liberty furth thereof.
