Act Mr George Gray for stipend

Anent the petitione Given in to the Lords of there majestyes privie Councill be Mr George Gray minister at Beath Shewing That whereas the petitioner haveing in due forme of Law been institute minister at the said church of Beath in Junij Jaj vjc and Eightie Eight with consent of and approbatione of the patrone2 heretors and others and Continowed the exercise of his ministerie to there edification and satisfaction untill Januarij Jaj vjc Nyntie one that some of the present presbitry of Dumfermling being dissatisfyed with the petitioner meerly because of his entry albeit unblameable and beyond all Just Censure and for that and other necessary Causes the petitioner wes necessitate to withdra to Edinburgh for his safety and protection And the present Incumbent not haveing been Institute till after whitsonday Jaj vjc nyntie one as is notourly knowen and is not Contraverted by himself The petitioner humbly conceaves he hes right to the whitsondayes stipend Jaj vjc and Nyntie one have served the Cure Long efter michaelmes preceeding and near to that terme And to which terme the present Incumbent Cannot have the Least pretence Haveing been Institute as said is Long after whitsonday Jaj vjc nyntie one And the petitioner and his familyes present Circumstances requyreing supplie towards which the forsaid half years stipend will Contribute And that the patrone heretors and others Lyable in payment are well satisfyed to make payment to the petitioner of the samen upon the saids Lords there warrand And have given there consent thereto under there hands which is produced with the said petitione And therefore Craveing3 to the effect under wreitten As the said petitione bears The Saids Lords of there majestyes privie Councill haveing Considered this petition given in to them be the above Mr George Gray with the Consent of the patrone and heretors produced therewith They allow to the petitioner the stipend of the above kirk of Beath for the first half of the year Jaj vjc and nyntie one And ordaines him to be readily ansuered obeyed and payed thereof be the Heretors fewers Lyfrenters titulars tacksmen of teynds tennents possessors and others Lyable in payment of the samen And ordaines Letters of horning to be direct at the petitioners instance Againest them for that effect upon production of a decreet of Locality And in case there be none ordaines these Lyable to make payment of there respective proportions according as they shall be decerned be the Judge ordinary

Act for Mr George Gray for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr George Gray, minister at Beath, shewing that whereas the petitioner having, in due form of law, been instituted as minister at the said church of Beath in June 1688 with consent of and approval of the patron, heritors and others and continued the exercise of his ministry to their edification and satisfaction until January 1691, that some of the present presbytery of Dunfermline being dissatisfied with the petitioner merely because of his entry, albeit unblameable and beyond all just censure, and for that and other necessary causes the petitioner had to withdraw to Edinburgh for his safety and protection, and the present incumbent not having been instituted till after Whitsun 1691 as is well known and not controverted by himself, the petitioner humbly conceives he has right to the Whitsun stipend 1691 having served the cure long after Michaelmas preceding and near to that term, and to which term the present incumbent cannot have the least pretence, having been instituted as said is long after Whitsun 1691, and the petitioner and his family’s present circumstances requiring supply towards which the foresaid half year’s stipend will contribute and that the patron, heritors and others liable in payment are well satisfied to make payment to the petitioner of the same upon the said lords’ warrant and have given their consent thereto under their hands which is produced with the said petition, and therefore craving to the effect underwritten, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Mr George Gray with the consent of the patron and heritors produced therewith, they allow to the petitioner the stipend of the above kirk of Beath for the first half of the year 1691, and they ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, liferenters, titulars, tacksmen of teinds, tenants, possessors and others liable in payment of the same, and they ordain letters of horning to be directed at the petitioner’s instance against them for that effect upon production of a decreet of locality, and in case there is none, they ordains those liable to make payment of their respective proportions as they shall be discerned by the judge ordinary.
