Act Laird of Grant for stipend

Anent the petitione Given in to the Lords of there Majesties privie Counsell be Lodovick Grant of Freuchie one of the saids Lords there Number Shewing That there being three Ministers within the Countrie of Strathspey who did not obey the Law in prayeing for there present majestyes They were thereupon depryved a beneficio by the saids Lords of privie Counsell there Sentence about Mertinmess Jaj vjc and Eighty Nyne And there paroches viz The paroches of crombdaill and abernethie and Lands thereto united As also the united paroches of Glencharuicle and Rothiemurcus having Lyen vacant for the haill years Jaj vjc and Nyntie, and Jaj vjc and Nyntie one years The petitioner as patrone of these three pariochines And being Lykewayes heretor of the greatest pairt of the Lands within the samen Is Resolved to Imploy the tuo years stipend of the saids three kirks upon good security for Having the annualrent thereof furthcomeing in all tyme hereafter as a maintenance for tuo schoollmaisters within the Countrey of Strathspey for teaching of young children which the petitioner Conceaves to be a most pious and necessarie use use2 There never having been any schooll formerly setled for Instructing of youth in that countrie And therefor Craveing to the effect underwreitten As the said petitione bears The saids Lords of there Majestyes privie Counsell having Considered this petitione Given in to them be Lodovick Grant of Freuchie They hereby allow to the petitioner the stipends of the above kirk of Combdaill Abernethie and lands thereto united And of the united paroches of Glencharuch and Rothiemurcus for the year Jaj vjc and Nyntie one To be by him Imployed upon good security for having the annualrent thereof Furthcomeing in all tyme hereafter as ane mantenance for tuo Schooll maisters within the Countrie of Strathspey for teaching of young Children And ordaines the heretors Lyfrenters titulars tacksmen of teynds and others Lyable in payment of the saids stipends to make payment to him of the samen And ordains Letters of horning to be direct at the petitioners Instance againest the persones forsaids for payment thereof he first produceing a decreet of Locality And in case there be no decreet of Locality Appoints and ordaines the persones forsaids to make payment of there respective proportiones according as the samen shall be decerned be the Judge ordinarie In Respect the petitioner hath enacted and obleidged himself in the books of privie Counsell that he shall Imploy the above stipends upon good security for the end and use above appointed And that he shall report the said security to the saids Lords of privie Counsell

Concerning the petition given in to the lords of their majesties’ privy council be Ludovick Grant of Freuchie, one of the said lords their number, showing that there being three ministers within the country of Strathspey who did not obey the law in praying for their present majesties, they were thereupon deprived of their benefices by the said lords of privy council their sentence about Martinmas 1689, and there parishes viz the parishes of Cromdale and Abernethy and lands thereto united, as also the united parishes of Glencharuicle and Rothiemurchus having lain vacant for the whole years 1690 and 1691, the petitioner as patron of these three parishes and being likewise heritor of the greatest part of the lands within the same is resolved to employ the two years’ stipend of the said three kirks upon good security for having the annualrent thereof forthcomeing in all time hereafter as a maintenance for two schoolmasters within the country of Strathspey for teaching of young children, which the petitioner conceives to be a most pious and necessary use, there never having been any school formerly settled for instructing of youth in that country, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them be Ludovick Grant of Freuchie, they hereby allow to the petitioner the stipends of the above kirk of Cromdale, Abernethy, and lands thereto united, and of the united parishes of Glencharuch and Rothiemurchus for the year 1691 to be by him employed upon good security for having the annualrent thereof forthcoming in all time hereafter as a maintenance for two schoolmasters within the country of Strathspey for teaching of young children. And ordain the heritors, liferenters, titulars, tacksmen of teinds, and others liable in payment of the said stipends to make payment to him of the same. And ordain letters of horning to be directed at the petitioner’s instance against the persons foresaid for payment thereof, he first producing a decreet of locality. And in case there be no decreet of locality, appoint and ordain the persons foresaid to make payment of their respective proportions according as the same shall be discerned be the judge ordinary, in respect the petitioner has enacted and obliged himself in the books of privy council that he shall employ the above stipends upon good security for the end and use above appointed, and that he shall report the said security to the said lords of privy council.
