Act Minister and Kirk Session of Abernethie for stipend

Anent the petition Given in to the Lords of there Majestyes privie Counsell be the Minister and Kirksession of Abernethie Shewing That whereas by express acts of parliament vacant stipends are appointed to be applyed for pious uses within the paroch and the Kirk of Abernethie being ruinous and there being no schooll house within the said paroch And the last half of the stipend Jaj vjc and Eightie Nyne being vacant and at the saids Lords there disposeall and there being no others pretending Right thereto And therefore Craveing to the effect underwreitten As the said petitione bears The saids Lords of there Majestyes privie Counsell having Considered this petition Given in to them be the above Minister and kirk session of Abernethie They hereby Allow to the petitioners the stipend of the Kirk of Abernethy for the last half of the Cropt and year of God Jaj vjc and Eightie Nyne And that for Repairing of the kirk of Abernethie and building ane schooll house within that paroch And Nominates and Appointes John Arnott of Pitgrunzies Easter and Wester to be factor for uplifting of the said half years stipend And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen for the said half year And ordaines Letters of horning at the factors Instance againest them for that effect he produceing adecreet of Locality And in case there be none ordaines these Lyable To make payment of there respective proportiones of the said half years stipend According as they shall be decerned be the Judge ordinarie In respect the said factor hes found sufficient Cautione acted in the books of privie Counsell that he shall Imploy the forsaid half years stipend upon the repairing of the said kirk and building of ane schooll house

Act minister and kirk session of Abernethy for stipend

Concerning the petition given in to the lords of their majesties’ privy council by the minister and kirk session of Abernethy, showing that whereas by express acts of parliament, vacant stipends are appointed to be applied for pious uses within the parish, and the kirk of Abernethy being ruinous and there being no school house within the said parish, and the last half of the stipend 1689 being vacant and at the said lords their disposal, and there being no others pretending right thereto, and therefore craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above minister and kirk session of Abernethy, they hereby allow to the petitioners the stipend of the kirk of Abernethy for the last half of the crop and year of God 1689, and that for repairing of the kirk of Abernethy and building a school house within that parish. And nominate and appoint John Arnott of Pitgrunzies Easter and Wester to be factor for uplifting of the said half year’s stipend, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, and others liable in payment of the same for the said half year. And ordain letters of horning at the factor’s instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions of the said half year’s stipend according as they shall be discerned by the judge ordinary, in respect the said factor has found sufficient caution acted in the books of privy council that he shall employ the foresaid half year’s stipend upon the repairing of the said kirk and building of a school house.
