Act

Act for Mistress Landells for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Janet Landells, widow of Mr David Laing minister at Tynron, showing that where the supplicant’s husband, having been thrust from the possession of his church and manse by a company of strangers and violently dispossessed by them to the loss of all his furniture and that without any sentence from any judicature whatsoever, by which sudden and illegal ejection the supplicant and her husband were reduced to great straits and extreme necessity, and the petitioner’s husband now being dead has left the petitioner altogether destitute of any means of subsistence so that the supplicant is compelled to apply to the said lords that it may please their lordships out of the charity and innate justice shown by the said lords to distressed people in the supplicant’s circumstances to allow the supplicant some means of entertainment and for supplying the supplicant, she humbly represents that that stipend being at the said lords’ gift for 1690 and no person being presented to the said church or the vacant stipend thereof gifted to any other, the giving of the same to the supplicant would be an extraordinary act of charity and would prejudge no other person, and therefore craving the said lords would be pleased in consideration of the premises and of the petitioner’s great straits that the supplicant is under and that the vacant stipend of the said church is yet undisposed of, to allow the supplicant the said one year’s vacant stipend and to ordain the heritors and others liable in payment of their several proportions to make payment thereof to the supplicant which would be an act of charity and justice, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Janet Landells, widow of Mr David Laing, they hereby allow to the petitioner the stipend of the above kirk of Tynron for the last half of the crop and year of 1690 and ordain her to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters and others liable in payment of the same, and they ordain letters of horning at her instance for that effect upon production of a decreet of locality and in case there is none they ordain those liable to make payment to the petitioner of their respective proportions of the said stipend for the said half year as the same shall be discerned by the judge ordinary.
