Act of Exoneration Lord Bailhaven and James Hamilton

Anent the petitione given in to the Lords of there majestyes privie Councill be John Lord Beilhaven one of the Late Comissioners appointed for exerceing the office of Clerk of register and James Hamilton wreitter to the signet Keeper of the register be vertue of ane Commission from the saids Commissioners for that effect Shewing That where the saids Lords of privie Councill by ane act of Councill of the date the tuenty first day of Maij Last bypast ordained the petitioners and also the remanent Commissioners who were appoynted to exerce the office of Clerk of register to depone befor a Comittee of there number If they hade Imbaizled or abstracted any of the registers or warrands in the Laigh parliament house the tyme that the same were under there care And to delyver up the keyes of the Laigh parliament house to the said Comittee And upon the tuenty sixt day of the said moneth of maij upon the petitioners oathes deponed that nether they nor any to there knowledge hade abstracted Imbaizled or putt away any of the registers wreitts or warrands that were in the Laigh parliament house dureing the haill space the samen were under there Care and farder that they hade putt in to the said Laigh parliament house the haill records and warrands of the Late meeting of Estates and of the three sessiones of there majesties current parliament which were gott up from the Clerks of session and that they abstracted none of them In maner fully contained in there depositiones As also the said tuenty sixt day of Maij The petitioners delyvered up the keyes of the said Laigh parliament house to the said Comittee of Councill who delyvered the same to the Viscount of Tarbatt present Lord Clerk register as the minutes signed be the said Comittee bears and the petitioners haveing given so exact obedience to the saids Lords there ordinance It is necessar and customarie that they should be exonered of so great a charge And therefore Craveing to the effect underwreatten As the said petitione bears The saids Lords of there Majestyes privie Councill Haveing Considered this petitione given in to them be the above Lord Beilhaven and James Hamilton with the act of Councill mentioned therein and depositiones of the petitioners befor the Comittee of Councill with the report of a Comittee Bearing that the petitioners have delyvered up the keyes of the Laigh parliament house to the Comittee which they delyvered to the Lord Viscount Tarbatt present Clerk Register The saids Lords of privie Council Have Exonered and hereby Exoner the said Lord Beilhaven as one of the Commissioners appointed for exerceing the the2 said office of Clerk of register and also the said James Hamilton as Keeper of the said registers be vertue of the above Commission from the haill Comissioners of the said office of Clerk register of the saids petitioners there respective trusts and charges Comitted to them and aither of them In keeping of the saids registers and warrands dureing the haill space the same wes under there charge and declares the said petitioners and aither of them free thereof, and from being called in question or troubled for the same in tyme comeing

Act of exoneration for Lord Belhaven and James Hamilton

Concerning the petition given in to the lords of their majesties’ privy council by John Lord Belhaven, one of the Late commissioners appointed for exercising the office of clerk register and James Hamilton writer to the signet, keeper of the register, by virtue of a commission from the said commissioners for that effect, showing that, where the said lords of privy council by an act of council of 21 May last ordained the petitioners and also the other commissioners who were appointed to exercise the office of clerk register to depone before a committee of their number if they had embezzled or abstracted any of the registers or warrants in the Laigh Parliament House at the time that the same were under their care and to deliver up the keys of the Laigh Parliament House to the said committee, and upon 26 May upon the petitioners’ oaths, deponed that neither they nor any to their knowledge had abstracted, embezzled or put away any of the registers, writs or warrants that were in the Laigh Parliament House during the whole space the same were under their care, and further that they had put in to the said Laigh Parliament House the whole records and warrants of the late meeting of estates and of the three sessions of their majesties’ current parliament which were got up from the clerks of session and that they abstracted none of them, in manner fully contained in there depositions, as also on the said 26 May the petitioners delivered up the keys of the said Laigh Parliament House to the said committee of council who delivered the same to the Viscount of Tarbat, present lord clerk register, as the minutes signed by the said committee bear and the petitioners having given so exact obedience to the said lords’ ordinance, it is necessary and customary that they should be exonerated of so great a charge, and therefore craving to the effect underwritten, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Lord Belhaven and James Hamilton with the act of council mentioned therein and depositions of the petitioners before the committee of council with the report of a committee bearing that the petitioners have delivered up the keys of the Laigh Parliament House to the committee which they delivered to the Lord Viscount Tarbat, present clerk register, the said lords of privy council have exonerated and hereby exonerate the said Lord Belhaven as one of the commissioners appointed for exercising the said office of Clerk of register and also the said James Hamilton as keeper of the said registers by virtue of the above commission from the whole commissioners of the said office of clerk register of the said petitioners there respective trusts and charges committed to them and either of them in keeping of the said registers and warrants during the whole space the same were under their charge, and declares the said petitioners and either of them free thereof, and from being called in question or troubled for the same in time coming.
