Act My Lord Aberuchill and Mr Roderick Mckenzie to geting their bond

Anent the petitione Given in to the Lords of there majestyes privie Councill be Sir Coline Campbell of Aberuchill ane of the senators of the Colledge of Justice and Mr Roderick Mckenzie of Prestonhall Shewing That the petitioners being Cautioners for the Earle of Sieforth his peaceable Liveing and appearing when called under the penalty of Tuo Thousand pounds Stirling in ane bond granted to the saids Lords of the date the Seventh day of Januarij Jaj vjc nyntie one years The petitioners being charged upon the Earle his escape for payment of the said penaltie The petitioners did upon Saturday last Give in ane bill of suspensione of the said charge upon the reasone That the Earle haveing been by order of the saids Lords made prisoner befor his escape, The petitioners his Cautioners are by Law Liberate And the Earle being now retaken and actually prisoner in the Castle of Edinburgh There can be no ground of debate thereanent And therefore Craveing that the saids Lords would be pleased to discharge the said charge And to appoint there Clerks to give up the ground and warrands of the said charge And to exhoner the petitioners. As the said petitione bears The Saids Lords of there majesties privie Councill haveing considered this petitione Given in to them be the above Sir Coline Campbell and Mr Roderick Mckenzie They Inrespect the said Earle of Sieforth is presently prisoner in the Castle of Edinburgh Doe hereby Give order and warrand to the Clerks of privie Councill to delyver up to the petitioners the bond of Cautionrie granted be them And to cause Cancell the horning raised thereon And recalls the former warrand of Councill granted for registrateing the said bond and raising horning upon the same.

Act Lord Aberuchill and Mr Roderick MacKenzie to get their bond

Concerning the petition given in to the lords of their majesties’ privy council by Sir Colin Campbell of Aberuchill, one of the senators of the college of justice, and Mr Roderick MacKenzie of Prestonhall, showing that the petitioners being cautioners for [Kenneth MacKenzie], earl of Seaforth’s peaceful living and appearing when called under the penalty of £2,000 sterling in a bond granted to the said lords of 7 January 1691, the petitioners being charged upon the earl’s escape for payment of the said penalty, the petitioners did on Saturday last give in a bill of suspension of the said charge for the reason that the earl having been by order of the said lords made prisoner before his escape, the petitioners his cautioners are by law freed and the earl being now retaken and actually prisoner in the Castle of Edinburgh there can be no ground of debate, and therefore craving that the said lords would be pleased to discharge the said charge and appoint their clerks to give up the ground and warrants of the said charge and to exonerate the petitioners, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Sir Colin Campbell and Mr Roderick MacKenzie, they in respect that the said earl of Seaforth is presently a prisoner in the Castle of Edinburgh, hereby give order and warrant to the clerks of privy council to deliver up to the petitioners the bond of caution granted by them and to cancel the horning raised thereupon, and they recall the former warrant of council granted for registering the said bond and raising horning upon the same.
