Act Mr Archibald Borthwick for stipend

Anent the petitione Given in to the Lords of there Majestyes privie Councill be Mr Archibald Borthwick preacher of the gospell Shewing That whereas the petitioner at the appoyntment of the presbitry of Dalkeith did preach in the pariochine of Fala and other other places within the presbitry for the spring. and summer Jaj vjc nyntie one years And did preach constantly the wholl Last winter at the desyre of the Eldership and parochiners of the said paroch of Fala in the said pariochine And since that tyme hath preached in severall other vacancies within the said presbitry particularly in the pariochine of Newtoun And thereupon the said presbitry hath granted ane recomendatione to the saids Lords In favours of the petitioner for granting him ane right to ane years stipend of aither of the saids pariochines of Newtoun or Fala As the saids Lords should think fitt As the said presbitryes testificat and recomendatione produced with the said petitione hes testifyed and sieing the patrone of the of the2 Kirk of Newtoun is popish and thereby the vacant stipend at there Majesties gift and disposition And that the magistrats of Edinburgh as haveing the right of presentatione of the said kirk of Fala have consented to the premises as the consent subjoyned to the said testificat bears And therefore Craveing That the saids Lords would be pleased In consideratione of the premises To allow the petitioner the stipend of aither of the saids pariochines of Fala or Newtoun for this present cropt and year Jaj vjc nyntie tuo As there Lordships should think fitt And to ordaine the heretors and others Lyable in payment thereof To make payment of the same to the petitioner upon his recept As the said petitione bears The Saids Lords of there Majesties privie Councill haveing considered this petitione Given in to them be the above Mr Archibald Borthwick with the testificat recomendation and Consent mentioned therein and produced therewith They hereby allow the petitioner the stipend of the above Kirk of Fala and rent of the gleib thereof for the haill cropt and year of God Jaj vjc nyntie tuo years and ordaines him to be readily ansuered obeyed and payed thereof be the heretors Lyfrenters wodsetters and others Lyable in payment of the samen and ordaines Letters of horning under the signet of Councill at his Instance againest them for that effect He produceing a decreet of Locality And in Case there be none ordaines these Lyable To make payment to the petitioner of there respective proportiones of the said stipend and gleib for the said year according as they shall be decerned be the Judge ordinary In respect the petitioner hes sworne and signed the oath of alleadgeance and signed the assureance to there majestyes King William and Queen Mary prescrybed by the act of parliament And that in presence of one of the Lords of privie Councill.

Concerning the petition given in to the lords of their majesties’ privy council by Mr Archibald Borthwick. preacher of the gospel, showing that whereas the petitioner at the appointment of the presbytery of Dalkeith did preach in the parish of Fala and other other places within the presbytery for the spring and summer 1691, and did preach constantly the whole last winter at the desire of the eldership and parishioners of the said parish of Fala in the said parish. And since that time has preached in several other vacancies within the said presbytery, particularly in the parish of Newton. And thereupon the said presbytery has granted a recommendation to the said lords in favours of the petitioner for granting him a right to a year’s stipend of either of the said parishes of Newton or Fala, as the said lords should think fit, as the said presbytery’s testificat and recommendation produced with the said petition has testified, and seeing the patron of the kirk of Newton is Popish, and thereby the vacant stipend at their majesties’ gift and disposition, and that the magistrates of Edinburgh as having the right of presentation of the said kirk of Fala have consented to the premises, as the consent subjoined to the said testificat bears, and therefore craving that the said lords would be pleased in consideration of the premises to allow the petitioner the stipend of either of the said parishes of Fala or Newton for this present crop and year 1692 as their lordships should think fit, and to ordain the heritors and others liable in payment thereof to make payment of the same to the petitioner upon his receipt, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Mr Archibald Borthwick, with the testificat, recommendation, and consent mentioned therein and produced therewith, they hereby allow the petitioner the stipend of the above kirk of Fala and rent of the glebe thereof for the whole crop and year of God 1692, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, liferenters, wadsetters, and others liable in payment of the same. And ordain letters of horning under the signet of council at his instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment to the petitioner of their respective proportions of the said stipend and glebe for the said year according as they shall be discerned by the judge ordinary, in respect the petitioner has sworn and signed the oath of allegiance and signed the assurance to their majesties King William and Queen Mary prescribed by the act of parliament, and that in presence of one of the lords of privy council.
