Liberation Logan of Burncastle

Anent the petitione Presented to the Earle of Tweddale Lord high Chancellour of Scotland To whom The Lords of privie [council] by there act of the date the eleaventh day of August Instant have remitted to give orders for Liberation of such of the heretors of Midlothian Imprisoned for refuseing the oath of alleadgeance and assureance as shall address to his Lordship for that effect and produce testificats under the hands of Phisicians (bearing upon soull and Conscience) of there sickness and Indispositione be George Logan of Burncastle Shewing That the petitioner being Conveened before his Lordship and the Lords of privie Councill anent takeing the oaths of alleadgeance and assureance wes Comitted to the prisone of Edinburgh where he hes Continowed these Eight weeks prisoner whereby the petitioner is reduced to such ane badd state of health That he hes Contracted ane dangerous sickness and his Lyfe is in great hazard As ane testificat under the hand of his phisician produced with the said petitione hes made appear And therefore Craveing And therefore Craveing3 to the effect underwreitten as the said petitione bears which Petition with the testificat of the petitioners dangerous sickness under the hand of William Lauder Doctor of medicine produced therewith being Considdered be the said Lord Chancellour His Lordship does hereby give order and warrand to the magistrats of Edinburgh and Keeper of there tolbooth to sett the said George Logan of Burncastle at Liberty furth thereoff In respect he hes given bond and found sufficient Cautione acted in the books of privie Councill that he shall appear befor the saids Lords of privie Councill when called under the penaltie of Ane Hundreth pound sterling.

Concerning the petition presented to [John Hay] the earl of Tweeddale, lord high chancellor of Scotland, to whom the lords of privy [council] by their act of the date 11 August instant have remitted to give orders for liberation of such of the heritors of Midlothian imprisoned for refusing the oath of allegiance and assurance as shall address to his lordship for that effect and produce testificats under the hands of physicians (bearing upon soul and conscience) of their sickness and indisposition by George Logan of Burncastle, showing that the petitioner being convened before his lordship and the lords of privy council concerning taking the oaths of allegiance and assurance was committed to the prison of Edinburgh where he has continued these eight weeks prisoner, whereby the petitioner is reduced to such a bad state of health that he has contracted a dangerous sickness, and his life is in great hazard, as a testificat under the hand of his physician produced with the said petition has made appear, and therefore craving to the effect underwritten as the said petition bears. Which petition with the testificat of the petitioner’s dangerous sickness under the hand of William Lauder, doctor of medicine, produced therewith, being considered by the said lord chancellor, his lordship does hereby give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth to set the said George Logan of Burncastle at liberty forth thereof, in respect he has given bond and found sufficient caution acted in the books of privy council that he shall appear before the said lords of privy council when called, under the penalty of one hundred pounds Sterling.
