Act Doctor James Weems for stipend

Anent the petition Given in to the Lords of there majestyes privie Counsell be Doctor James Weems late principall of St Leonards Colledge in St Andrews Shewing That where the petitioner haveing been Laid asyde from his station about the end of September Jaj vjc and Nyntie years The said place did clearly vaick for the year Jaj vjc and Nyntie one the same not being filled up till after Michaellmess las, That Mr Tilliedaff wes entered thereto And sieing the wholl provision of the forsaid effect alswell that of the Kirk of St Leonards as of the parsonadge of Kinkell will not exceed one thousand tuo Hundreth and Fiftie merks And that the petitioner is Informed others in the Lyke Circumstances with the petitioner have gotten donationes of the vaicant stipends of the places wherein they served And therefore Craveing that there Lordships would be pleased to allow the petitioner to be ansuered for the said years vacant stipend Jaj vjc and Nyntie one alswell for the kirk of St Leonards as for the parsonadge of Kinkell and what else wes in use to be payed to the petitioner as principall And to ordaine the persones Lyable in payment of the samen To make payment thereof to the petitioner As the said petitione bears The saids Lords of there Majestyes privie Counsell haveing Considered this petitione Given in to them be the above Doctor James Weems They allow the petitioner the stipend of the Kirk of Ecclisgreig for the haill cropt and year of God Jaj vjc and Nyntie (In place of the above stipend of St Leonards) And ordains him to be readiely ansuered obeyed and payed thereof be the heretors fewers Lyfrenters titulars tacksmen of teynds tennents possessors and others Lyable in payment thereof And ordaines Letters of horning to be direct hereon at the petitioners Instance Againest them for that effect upon production of adecreet of Locality And In case there be none ordaines these Lyable To make payment of there respective proportiones according as the samen shall be decerned be the Judge ordinarie And discharges Mr James Melvill of Cassengray from troubleing or mollesting the petitioner in the peaceable uplifting and disposeing of the said stipend

Concerning the petition given in to the lords of their majesties’ privy council by Doctor James Weems, late principal of St Leonards college in St Andrews, showing that where the petitioner having been laid aside from his station about the end of September 1690, the said place did clearly become vacant for the year 1691, the same not being filled up till after Michaelmas last, that Mr Tilliedaff was entered thereto, and seeing the whole provision of the foresaid effect as well as that of the kirk of St Leonards as of the parsonage of Kinkell will not exceed one thousand two hundred and fifty merks, and that the petitioner is informed others in the like circumstances with the petitioner have got donations of the vacant stipends of the places wherein they served, and therefore craving that their lordships would be pleased to allow the petitioner to be answered for the said year’s vacant stipend 1691 as well for the kirk of St Leonards as for the parsonage of Kinkell and what else was in use to be paid to the petitioner as principal, and to ordain the persons liable in payment of the same to make payment thereof to the petitioner as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Doctor James Weems, they allow the petitioner the stipend of the kirk of Ecclesgreig for the whole crop and year of God 1690 (in place of the above stipend of St Leonards), and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, liferenters, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment thereof. And ordain letters of horning to be directed hereon at the petitioner’s instance against them for that effect upon production of a decreet of locality. And in case there be none, ordain those liable to make payment of their respective proportions according as the same shall be discerned be the judge ordinary. And discharge Mr James Melville of Cassengray from troubling or molesting the petitioner in the peaceable uplifting and disposing of the said stipend.
