Act The Heretors off Colmonell and Ballentrae for Stipend

Anent the petitione given in to the Lords of there majestyes privie Councill be the heretors of the paroch of Colmonell and Ballentrae Shewing That the Church of Colmonell is quytt ruined and must have ane new roof So that tuo years stipend of the said paroch will scarce repair the same And Ballentrae church will at least take half ane years stipend to repair it And the Lord Bargenie who is patrone of the saids Churches being willing that the vacand stipends of the saids paroches be Laid out upon so pious ane use as the reparatione of the churches aforsaid And therefore Craveing that the saids Lords would be pleased conforme to the act of parliament anent vacand stipends to ordaine the vacand stipend of Colmonell for the year Jaj vjc and Eightie Nyne, and Jaj vjc and Nyntie years to be Collected for reparation of the said church And the half of the stipend Jaj vjc and Eightie Nyne for reparation of Ballentrae church to be collected by such persones as the patrone and heretors shall think fitt As the said petitione bears The Saids Lords of there Majestyes privie Councill recommend considered this petitione Given in to them be the heretors of the paroch of Colmonell and Ballentrae subscryved be the Lord Bargenie patrone of the saids paroches They hereby allow the heretors of Colmonell the stipend of that kirk for the haill cropts and years of God Jaj vjc and Eighty Nyne and Jaj vjc and Nyntie years And they allow the heretors of Ballentrae the half of the cropt and year of God Jaj vjc and Eighty Nyne And that for repairing of the kirks of Colmonell and Ballantrae and they hereby nominate and appoint […] to be factor for uplifting of the saids tuo years and ane halfes stipends And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning at the said factors instance against them for that effect He produceing adecreet of Locality And in case there be none ordaines these Lyable to make payment to him of there respective proportiones of the saids tuo years and halfes stipends According as they shall be decerned be the Judge ordinary The said factor always first befor extracting hereof Finding sufficient caution acted in the books of privie Councill that he shall Imploy the saids tuo years stipend of Colmonell and the half stipend of Ballentrae hereby appointed to be uplifted by him upon the repairing of the saids tuo kirks off Colmonell and Ballentrae

Act for the heritors of Colmonell and Ballantrae for stipend

Concerning the petition given in to the lords of their majesties’ privy council by the heritors of the parish of Colmonell and Ballantrae showing that the church of Colmonell is quite ruined and must have a new roof so that two years’ of stipend of the said parish will scarcely repair the same and Ballantrae church will at least take half a year’s stipend to repair it, and [John Hamilton], lord Bargany who is patron of the said churches being willing that the vacant stipends of the said parishes be laid out upon so pious a use as the reparation of the churches aforesaid, and therefore craving that the said lords would be pleased conform to the act of parliament concerning vacant stipends to ordain the vacant stipend of Colmonell for the year 1689 and 1690 to be collected for reparation of the said church, and the half of the stipend 1689 for reparation of Ballantrae church to be collected by such persons as the patron and heritors shall think fit as the said petition bears. The said lords of their majesties privy council recommend [and] considered this petition given in to them be the heritors of the parish of Colmonell and Ballantrae subscribed by the Lord Bargany, patron of the said parishes, they hereby allow the heritors of Colmonell the stipend of that kirk for the whole crop and years of God 1689 and 1690, and they allow the heritors of Ballantrae the half of the crop and year of God 1689, and that for repairing of the kirks of Colmonell and Ballantrae, and they hereby nominate and appoint […] to be factor for uplifting of the said two years and a half stipends and ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters and others liable in payment of the same and ordain letters of horning at the said factor’s instance against them for that effect, he producing a decreet of locality, and in case there be none ordain those liable to make payment to him of their respective proportions of the said two years and a half stipends according as they shall be decerned by the judge ordinary, the said factor always first before extracting hereof finding sufficient caution acted in the books of privy council that he shall employ the said two years’ stipend of Colmonell and the half stipend of Ballantrae hereby appointed to be uplifted by him upon the repairing of the said two kirks off Colmonell and Ballantrae
