Liberatione Scott of Mallenie

The Lord High Chancellour off Scotland (Conforme to ane act of the Lords of privie Councill Remitting to His Lordship to give warrand for Liberatione of such of the heretors of Midlothian prisoners for refusseing the oathe of alleadgeance and assureance as shall apply to his Lordship upon the accompt of sicknes or Indispositione and produce to him a Certificat of the same by physicians bearing expressly upon soull and Conscience They alwayes Finding Cautione acted in the books of privie Councill to Live peaceablie and appear3 the next Councill day after the warrand is granted under such penaltyes as his Lordship shall think fitt) haveing Considered the Certificat under the hand of Mr Robert Trotter doctor of medicine of the Indisposition of John Scott of Mallenie And that he is in hazard of his Lyfe If he be not allowed the Continowance of his oune house where he may be treatted as one in a fever Bearing expressly upon oath and Conscience The said Lord high Chancellour Conforme to the above remitt of Councill made to him does hereby give order and warrand to the Bailzies of Kirklistoun and keeper of the tolbooth thereoff to set at Libertie the said John Scott who is presently prisoner therein for refuseing the forsaid oath and assureance And that In respect And that In respect4 he hes found sufficient Cautione in the books of privie Councill That he shall Live peaceablie under the present government of there Majesties King William and Queen Mary And that he shall not act Consult or Contryve any thing in prejudice thereoff nor shall Converse nor Correspond with any rebells and that he shall appear befor the Lords of privie Councill when called for under the penalty of Ane Hundreth pound Sterling

[John Hay, earl of Tweeddale] the lord high chancellor of Scotland (conform to an act of the lords of privy council remitting to his lordship to give warrant for liberation of such of the heritors of Midlothian prisoners for refusing the oath of allegiance and assurance as shall apply to his lordship upon the account of sickness or indisposition and produce to him a certificate of the same by physicians bearing expressly upon soul and conscience, they always finding caution acted in the books of privy Council to live peaceably and appear the next council day after the warrant is granted under such penalties as his lordship shall think fit) having considered the certificate under the hand of Mr Robert Trotter, doctor of medicine, of the indisposition of John Scott of Malleny, and that he is in hazard of his life if he be not allowed the continuance of his own house where he may be treated as one in a fever, bearing expressly upon oath and conscience, the said lord high chancellor, conform to the above remit of council made to him, do hereby give order and warrant to the bailies of Kirkliston and keeper of the tolbooth thereof to set at liberty the said John Scott, who is presently prisoner therein for refusing the foresaid oath and assurance, and that in respect he has found sufficient caution in the books of privy council that he shall live peaceably under the present government of their majesties King William and Queen Mary, and that he shall not act, consult, or contrive anything in prejudice thereof, nor shall converse nor correspond with any rebels, and that he shall appear before the lords of privy council when called for under the penalty of one hundred pounds Sterling.
