Act requiring Lists and originall subscriptiones of these that have taken the Indemnity to be transmitted to the Clarks of the Councell

Forasmuchas By a printed Act of Councell of the date the tuelvth day of Janwary Instant The shirreffs principalls of the severall shires of this Kingdome their Deputes and Clarks are ordained to transmitt to the Clarks of privie Councell Not only the Lists of the persones who have taken the benefite of their Majesties gracious Indemnity but Lykewayes the oathes already suorne and signed by the takers therof with their originall subscriptiones And that before the persones and in the precise termes mentioned in the said Act betuixt and the tuenty fifth day of January Instant for such as are on this syde of the river of Tay and the tenth day of February nixt for those on the other syde therof And the Lords of their Majesties privy Councell Considering That the present state of their Majesties affaires does requyre That the forsaids Lists and oathes uith the originall subscriptiones be transmitted to the Clarks of Councell before the dayes above sett doune Therfore they heirby Requyre and Command the saids shirreffs principalls and their deputes and Clarks Instantly upon their receaving of a printed Coppie of this Act To transmitt to the saids Clarks of Councell without any delay the saids Lists and oathes with the originall subscriptiones And appoyntes their Majesties Sollicitor or his assistants Immediatly to dispatch expresses to the severall shyres with Coppies of this Act to the shirreff Clarks of the severall shires To be by them Intimat to their shirreffs principalls and shirreff deputes Uith Certificatione to such as shall faillzie In not Giving punctuall obedience to this Act That the same shall be accounted a malversatione in their office and shall Inferr the punishment of Deprivatione and they shall be depryved accordingly And ordaines these presents to be printed

Act requiring lists and original subscriptions of those that have taken the Indemnity to be transmitted to the clerks of the council

Forasmuch as by a printed act of council of the date 12 January instant the sheriff principals of the several shires of this kingdom, their deputes and clerks are ordained to transmit to the clerks of privy council not only the lists of the persons who have taken the benefit of their majesties’ gracious Indemnity, but likewise the oaths already sworn and signed by the takers thereof with their original subscriptions, and that before the persons and in the precise terms mentioned in the said act between and 25 January instant for such as are on this side of the river of Tay, and 10 February next for those on the other side thereof, and the lords of their majesties’ privy council considering that the present state of their majesties’ affairs does require that the foresaid lists and oaths with the original subscriptions be transmitted to the clerks of council before the days above set down, therefore they hereby require and command the said sheriff principals and their deputes and clerks instantly upon their receiving of a printed copy of this act to transmit to the said clerks of council without any delay the said lists and oaths with the original subscriptions. And appoints their majesties’ solicitor or his assistants immediately to despatch expresses to the several shires with copies of this act to the sheriff clerks of the several shires to be by them intimated to their sheriff principals and sheriff deputes with certification to such as shall fail in not giving punctual obedience to this act that the same shall be accounted a malversation in their office and shall infer the punishment of deprivation and they shall be deprived accordingly, and ordain these presents to be printed.
