Act

Address and Act anent a regiment of men be the toun of Edinburgh.

Anent the petition Given in to the Lords of there majestyes privie Councill be the Lord proveist Bailzies and Councill of the burgh of Edinburgh for themselves and the Community of the said burgh Shewing That where the petitioners hade therewith presented there most Loyall and Humble address to there Majestyes Containing the offer of there Lyves and fortunes for there majestyes service And have undertaken and are Engadged to raise a full and Compleat regiment of men to be maintained upon there oune charges and expenses dureing the present Exigence And to serve therein by the saids Lords there order For proscuteing of which resolutiones It may be necessarie that the petitioners have a further provisione of amunition and armes then there present state and Conditione Can furnish And therefor Humbly Craveing that the saids Lords would be pleased to allow and authorize the petitioners as to the raising and modelling of the forsaid regiment But Lykewayes to ordaine them to be ansuered out of the publict magazines for such quantityes of amunitione and armes as may be Judged neadfull at the sight and by the order of Sir Thomas Livingstoun Comandant upon there bond and security to restore the same As the said petitione bears The Saids Lords of there Majestyes privie Councill Haveing Considered this petitione Given in to them be the proveist and Bailzies and Councill of Edinburgh for themselves and the Comunity of the said burgh with the address above Mentioned And haveing called in the provist Bailzies and toun Councill who appeared at the barr And the proveist haveing declared in name of the toun That they offered the regiment abovementioned over and above fencible men in the burgh and humbly Craved that they might be allowed to choise there oune officer The Lord Chancellour In Name of the Councill did returne them heartie thanks for there Most Loyall address and humble offer And the saids Lords of privie Councill declared that they would take care that the forsaid address from the Good toun shall be transmitted to there Majesties Royall hands with a most favourable representatione as it deserves And allowes and authorizes the raising and modelling of the above regiment over and above the fenciblemen of the burgh And Lykewayes allowes the saids Magistrats and toun Councill to nominate such persones to Comand and be officers of the said regiment as they know to be well affected to there majestyes and the government And recomends to the Lords Comissioners of there Majesties theasurie to Cause furnish the Good toun with such quantityes of amunition and armes as there Lordships finds can be spared out of the publict magazines for the necessar use of the said regiment upon such termes as there Lordships shall think fitt.

Address and act concerning a regiment of men be the town of Edinburgh.

Regarding the petition given in to the lords of their majesties’ privy council by the lord provost, bailies and council of the burgh of Edinburgh for themselves and the community of the said burgh, showing that where the petitioners had therewith presented their most loyal and humble address to their majesties, containing the offer of their lives and fortunes for their majesties’ service, and have undertaken and are engaged to raise a full and complete regiment of men to be maintained upon their own charges and expenses during the present exigency and to serve therein by the said lords’ order, for prosecuting of which resolutions it may be necessary that the petitioners have a further provision of ammunition and arms than their present state and condition can furnish, and therefore humbly craving that the said lords would be pleased to allow and authorize the petitioners as to the raising and modelling of the foresaid regiment, but also to ordain them to be provided out of the public magazines with such quantities of ammunition and arms as may be judged necessary at the sight and by the order of Sir Thomas Livingston, commandant, upon their bond and security to restore the same, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the provost and bailies and council of Edinburgh for themselves and the community of the said burgh with the address above mentioned, and having called in the provost, bailies and town council who appeared at the bar, and the provost having declared in name of the town that they offered the regiment abovementioned over and above fencible men in the burgh and humbly craved that they might be allowed to choose their own officer, the lord chancellor in name of the council returned them hearty thanks for their most loyal address and humble offer, and the said lords of privy council declared that they would take care that the foresaid address from the good town shall be transmitted to their majesties royal hands with a most favourable representation as it deserves, and they allow and authorize the raising and modelling of the above regiment over and above the fencible men of the burgh, and likewise allow the said magistrates and town council to nominate such persons to command and be officers of the said regiment as they know to be well-affected to their majesties and the government, and they recommend to the lords commissioners of their majesties treasury to furnish the good town with such quantities of ammunition and arms as their lordships find can be spared out of the public magazines for the necessary use of the said regiment upon such terms as their lordships shall think fit.
