Liberatione Porterfield of Comistoun

Anent the petitione given in to the Lords of there majestyes privie Councill be Patrick Porterfield of Comistoun Shewing That the Supplicant being Lately comitted prisoner to the tolbooth of Edinburgh upon a representatione made be the petitioner to there Lordships of his Indisposition He wes sett at Liberty upon baill to appear this day And if the petitioners Indispositione should continow and be Instructed by Phisicians That in that case The petitioners enlargement wes Lykewayes to continow upon Cautione as before And sieing that it is but too nottour and hes appeared to the saids Lords by a testificat produced with the said petitione That the supplicants distemper at present is such That his being again comitted to prisone will in all probability Cutt the threed of his Lyfe and therefore Craveing the effect underwreitten As the said petitione bears The saids Lords of there Majestyes privie Councill haveing considered this petitione Given into them be the above Patrick Porterfield with the testificat under the phisicians hand mentioned therein and produced therewith They hereby Continow the petitioners Libertie untill the first Councill day in September next to come The petitioner first granting new bond subscryved be him as principal and Walter Porterfield apothecarie burges of the Canongate as Cautioner That he the said petitioner shall Live peaceablie and with all submissione to the present government of there majeties King William and Queen Mary And that he shall not act consult or contryve anything in prejudice thereof nor shall not converse or correspond with rebells And that he shall appear befor the saids Lords of Councill the said day under the penaltie of Fiftie pound sterling And upon the clerks receaveing of the new bond ordaines his former bond to be given up to him

Liberation Porterfield of Comiston

Concerning the petition given in to the lords of their majesties’ privy council by Patrick Porterfield of Comiston, showing that the supplicant being lately committed prisoner to the tolbooth of Edinburgh, upon a representation made by the petitioner to their lordships of his indisposition, he was set at liberty upon bail to appear this day, and if the petitioner’s indisposition should continue and be instructed by physicians that in that case the petitioner’s enlargement was likewise to continue upon caution as before. And seeing that it is but too notorious and has appeared to the said lords by a testificat produced with the said petition that the supplicant’s distemper at present is such that his being again committed to prison will in all probability cut the thread of his life and therefore craving the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given into them by the above Patrick Porterfield, with the testificat under the physician’s hand mentioned therein and produced therewith, they hereby continue the petitioner’s liberty until the first council day in September next to come, the petitioner first granting [a] new bond subscribed by him as principal and Walter Porterfield, apothecary burgess of the Canongate as cautioner, that he the said petitioner shall live peaceably and with all submission to the present government of their majesties King William and Queen Mary, and that he shall not act, consult, or contrive anything in prejudice thereof, nor shall not converse or correspond with rebels, and that he shall appear before the said lords of council the said day under the penalty of fifty pound Sterling. And upon the clerk’s receiving of the new bond, ordain his former bond to be given up to him.
