Act Mr Andrew Auchinlect for stipend

Anent the petitione given in to the Lords of there Majesties privie Councill be Mr Andrew Auchinleck Shewing That whereas the petitioner gave in a bill which wes read In presence of there Lordships Representing that the petitioner being presented by the noble Earle of Louthian and Legally Institute to the Church of Newbotle and did serve the Cure there at untill three dayes befor the terme of Whitsonday Jaj vjc and Eightie Nyne and therefore humbly craved that the saids Lords would grant warrand to the petitioner to uplift that first half years stipend of the forsaid year It being materially Just and that which the saids Lords have granted to severall Ministers in the Lyke Circumstances, Notwithstanding It wes given to ane other, Altho the petitioner did what duetyes were Incumbent as a minister for the space of Eight moneths that year As also representing that the petitioner hath bestowed above Fyve Hundreth merks upon the reparation of the Manse and yaird dyckes so that Considering the premisses And what he hes spent at Law in seeking what he thought right There will be in all Fyve Hundreth merks due to the petitioner And therefore Craveing that the saids Lords would be pleased seriously to Consider the petitioners condition and that of his Numerous family And to allow him a share of that same bountie and goodnes they have bestowed on ministers in his Circumstances Especially Considering that the petitioner hath receaved no stipend since the year Jaj vjc and Eighty Eight And to grant warrand out of vacand stipends particularly out of the Church and paroch of Eckfoord in Tiviotdaill To which the saids Lords did unanimously condescend alreadie about Martimes Last and that for ane year and ane half of the said stipend But now there is more vacant, mean tyme Humbly Layeing all at the saids Lords there feet to grant more or Less as there Candor and Charity Inclynes them Haveing full power to dispose of it, The King being patrone As the said petitione bears The saids Lords of there majestyes privie Councill Haveing considered this petitione given in to them be the above Mr Andrew Auchinleck for the stipend of the kirk of Eckfoord, with ane other petitione given in be the Dutchess of Buccleugh and a third petition given in be Mr Robert Spotswood both for the same stipend or the Stipend of Hopekirk They refuse the desyre of the Dutchess her petitione and alse the desyre of Mr Robert Spotswoods petition In so farr as Concerns the Stipend of Eckfoord And they hereby allow the said Mr Andrew Auchinleck the stipend of the kirk of Eckfoord for the haill cropt and year of God Jaj vjc and Nyntie and first half of the Cropt and year of God Jaj vjc and nyntie one And ordaines him to be readily ansuered obeyed and payed thereof be the heretors fewers wodsetters fermorers titulars tacksmen of teynds tennents possessors and others Lyable and in use and wont of payment of of2 the same And ordaines Letters of horning at the said Mr Andrew his instance againest them for that effect he produceing a decreet of Locality And in case there be none ordaines these Lyable and in use and wont of payment of the said stipend To make payment to him of there respective proportiones of the same for the said haill cropt Jaj vjc and Nyntie and first half of the cropt and year of God Jaj vjc nyntie one according as they shall be decerned be the Judge ordinarie And that In respect the said Mr Andrew Auchinleck hes upon the Eleavent day of Maij Last Given in ane obleidgement under his hand obleidgeing himself That how soon and whensoever he shall preach He shall pray for there majestyes King William and Queen Mary as King and Queen of this Realme.

Act for Mr Andrew Auchinleck for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr Andrew Auchinleck shewing that, whereas the petitioner gave in a bill which was read in presence of their lordships, representing that the petitioner being presented by the noble earl of Lothian and legally instituted to the Church of Newbattle and did serve the cure thereat until three days before the term of Whitsun 1689 and therefore humbly craved that the said lords would grant warrant to the petitioner to uplift that first half year’s stipend of the foresaid year, it being materially just and that which the said lords have granted to several ministers in the like circumstances, notwithstanding it was given to another, although the petitioner did what duties were incumbent as a minister for the space of eight months that year; as also representing that the petitioner has bestowed above 500 merks upon the repair of the manse and yard dykes so that considering the premises and what he has spent at law in seeking what he thought right, there will be in all 500 merks due to the petitioner, and therefore craving that the said lords would be pleased seriously to consider the petitioner’s condition and that of his numerous family and allow him a share of that same bounty and goodness they have bestowed on ministers in his circumstances, especially considering that the petitioner has received no stipend since 1688, and to grant warrant out of vacant stipends particularly out of the church and parish of Eckford in Teviotdale to which the said lords did unanimously condescend already about Martinmas last and that for one year and a half of the said stipend, though there is more vacant now; humbly laying all at the said lords’ feet to grant more or less as their candour and charity inclines them, having full power to dispose of it, the king being patron, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Mr Andrew Auchinleck for the stipend of the kirk of Eckford, with another petition given in by the duchess of Buccleuch and a third petition given in by Mr Robert Spotswood, both for the same stipend or the stipend of Hopekirk, they refuse the desire of the duchess’ petition and also the desire of Mr Robert Spotswood’s petition in so far as concerns the stipend of Eckford, and they hereby allow the said Mr Andrew Auchinleck the stipend of the kirk of Eckford for the whole crop and year of God 1690 and first half of the crop and year of God 1691, and they ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters, lessees, titulars, tacksmen of teinds, tenants, possessors and others liable and in use and wont of payment of the same, and ordains letters of horning at the said Mr Andrew’s instance against them for that effect, he producing a decreet of locality, and in case there is none they ordain those liable and in use and wont of payment of the said stipend to make payment to him of their respective proportions of the same for the said whole crop 1690 and first half of the crop and year of God 1691 according as they shall be discerned by the judge ordinary and that, since the said Mr Andrew Auchinleck has upon the eleventh of May last given in an obligation under his hand obliging himself that as soon and whenever he shall preach he shall pray for their majesties King William and Queen Mary as king and queen of this realm.
