Act

Act for Captain Lindsay

Concerning the petition given in to the lords of their majesties’ privy council by Captain James Lindsay one of the captains of my Lord Angus’s regiment, shewing that by the council’s act of 19 May 1692, the council ordained the petitioner not to remove from Edinburgh, in respect of the then necessity and paucity of officers, without warrant from their lordships, whereby he has been detained all this time from repairing to the Lord Angus’s regiment with the recruits which were destined for the same, and seeing now by the blessing of God the hazard is apparently over in this place and that it is necessary for the petitioner to repair to the said regiment with all expedition and that he will inevitably be at considerable loss and charge by his being detained here so long, and likewise that there is more then £5,000 sterling due upon the account of the said regiment preceding 1 August 1690, and therefore humbly craving that the said lords would grant warrant to the petitioner for repairing to the said regiment and for his dispatch therein to recommend him to the lords of treasury that they may order present payment to him of the sum of 500 merks in part of his bygone arrears and to cause pay to him £25 sterling for defraying his expenses while here and his expenses in going to the regiment, without which the petitioner is rendered incapable either to go or serve, as the said petition bears. The said lord of their majesties’ privy council, having considered this petition given in to them by the above Captain Lindsay, they hereby take off the restraint laid upon the petitioner by their lordships, and grant warrant and liberty to the petitioner to repair to the Lord Angus’s regiment to which he belongs, and they recommend to the lords commissioners of their majesties treasury to cause payment be made to the petitioner of such competent allowance as they shall think fit on account of the petitioner’s being detained at this place by virtue of the above order of council given for that effect.
