Act anent persones in rebellion allowed to stay at home in Scotland

The Lords of there Majestyes privie Councill being Informed by the Laird of Grant one of there oune number That some persones who were Lately in rebellione in the Highlands with Majors Generalls Buchan and Cannan and who are Comprehended in the Capitulatione made with these persones By the termes of which Capitulatione they are all to be transported abroad over sea’s are desyrous rather to remaine at home in this countrey If the Councill will allow them And because these persones are not clear to swear the publict oathes Therefor they are Content to find sufficient surety for there peaceable behaviour and appearance when called for under such penaltyes as the Councill shall think fitt The saids Lords of privie Councill doe hereby declare that they will allow such persones to remaine at home within this Kingdome upon there finding sufficient Cautione acted in the books of privie Councill under such penaltyes as the Councill shall appoint That they shall Live peaceablie under the government of there majestyes King William and Queen Mary And that they shall not act consult nor contryve any thing in prejudice thereof And that they shall not converse with rebells and shall appear when ever called for each of the persones forsaids being obleidged first to make particular applicationes to the Lords of privie Councill by petitiones for obtaining the forsaid favour befor the same be granted

Act concerning persons in rebellion allowed to stay at home in Scotland

The lords of their majesties’ privy council being informed by [Ludovic Grant] laird of Grant, one of their own number, that some persons who were lately in rebellion in the Highlands with Major Generals Buchan and Cannon and who are comprehended in the capitulation made with these persons by the terms of which capitulation they are all to be transported abroad overseas are desirous rather to remain at home in this country if the council will allow them. And because these persons are not clear to swear the public oaths, therefore they are content to find sufficient surety for their peaceable behaviour and appearance when called for under such penalties as the council shall think fit, the said lords of privy council doe hereby declare that they will allow such persons to remain at home within this kingdom upon their finding sufficient caution acted in the books of privy council under such penalties as the council shall appoint that they shall live peaceably under the government of their majesties King William and Queen Mary, and that they shall not act, consult nor contrive anything in prejudice thereof, and that they shall not converse with rebels and shall appear whenever called for, each of the persons foresaid being obliged first to make particular application to the lords of privy council by petitions for obtaining the foresaid favour before the same be granted.
