Act Three of the Earle of Northesks tennents

Anent the petition Given in to the Lords of there Majestyes privie Counsell be David Earle of Northesk and his tennents Frances Rattray, John Raith and Robert Keith Shewing That whereas Captain Denholme and Captain Bruce Captaines of the Earle of Leven regiment haveing most unwarrantably and unjustly Caused seize upon Frances Rattray John Raith and Robert Keith, tennents in the Litle Loure Belonging to the Earle of Northesk haveing come upon them and taken them out of there houses in the night tyme and by force and violence Carryed them away and first brought them to Dundie And put them all in the Iron house and thereafter Carryed them away and put them on ship boord with the rest of the souldiers to goe to Flanders Albeit they did not take on to be souldiers nor did they consent to goe, But were by force and violence dragged from there houses as said is And were most Cruelly and barbarously used And tuo of the saids persones are in Captain Bruces And the other in Captain Denholmes Companyes And albeit the Earle of Northesk did send to the said Captains to set these three persones at Libertie as being his tennents yet they most Contemptuously and disdainefully Refused to doe it And therefore Craveing that there Lordships would be pleased to take the premises into there serious Consideratione and ordain the saids Captains to sett the saids three persones at Liberty Tennents to the Earle of Northesk And to delyver them to the Earle of Northesk there maister here at Edinburgh under such a Certification as there Lordships shall think fitt And alse to discharge the skippers In whose ships the said three men are to sett saill befor they be delyvered to the Earle of Northesk upon the skippers there highest perrill As the said petitione bears The saids Lords of there Majestyes privie Counsell having considered this petition Given in to them be the above Earle of Northesk They hereby Recomend to Sir Thomas Burnet of Leyes to goe to the toun of Burntisland In whose road2 the ship wherein the tennents abovenamed are put aboord is Lyeing and to take tryall of the above matter with power to the said Sir Thomas to cause sett at Liberty the persones abovenamed If he find that they are nether tinkers nor have Legally taken on as souldiers

Act three of the earl of Northesk’s tenants

Concerning the petition given in to the lords of their majesties privy council by David [Carnegie] earl of Northesk and his tenants Frances Rattray, John Raith, and Robert Keith, showing that whereas Captain Denholm and Captain Bruce, captains of [David Leslie] the earl of Leven’s regiment, having most unwarrantably and unjustly caused seize upon Frances Rattray, John Raith, and Robert Keith, tenants in the Little Lour Belonging to the earl of Northesk, having come upon them and taken them out of their houses in the night-time and by force and violence carried them away and first brought them to Dundee and put them all in the iron house, and thereafter carried them away and put them onboard ship with the rest of the soldiers to go to Flanders, albeit they did not take on to be soldiers, nor did they consent to go, but were by force and violence dragged from their houses as said is and were most cruelly and barbarously used. And two of the said persons are in Captain Bruce’s and the other in Captain Denholm’s company. And albeit the earl of Northesk did send to the said captains to set these three persons at liberty as being his tenants, yet they most contemptuously and disdainfully refused to do it, and therefore craving that their lordships would be pleased to take the premises into there serious consideration and ordain the said captains to set the said three persons at liberty, tenants to the earl of Northesk, and to deliver them to the earl of Northesk their master here at Edinburgh under such a certification as their lordships shall think fit. And also to discharge the skippers in whose ships the said three men are to sett sail before they be delivered to the earl of Northesk upon the skippers’ their highest peril as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above earl of Northesk, they hereby recommend to Sir Thomas Burnet of Leys to go to the town of Burntisland, in whose road the ship wherein the tenants abovenamed are put aboard is lying, and to take trial of the above matter, with power to the said Sir Thomas to cause set at liberty the persons abovenamed if he find that they are nether tinkers nor have legally taken on as soldiers.
