Act Captain Alexander Hamilton of Grainge Against John Forbes

Anent the petitione Given in be Captain Alexander Hamiltone of Grainge to the Lords of there majestyes privie Counsell Shewing That the petitioner being come hither for recruits for his majestyes service And in order thereunto haveing taken on John Forbes formerly in the Late Earle of Marrs regiment who both took on voluntarly and receaved the Kings pay for three weeks as appears by ane testificat under the hand of the Ensigne of the Castle of Blackness where he remaines Yet the petitioner under standing that he hes made applicatione to the saids Lords as if he hade not willingly engadged albeit if read were Besydes the forsaid attestation It could be Instructed by witnesses that he willingly engadged and hes receaved the Kings pay accordingly And it is notourly knowen that for his gross misdemainers he wes disgracefully turned out of the Earle of Marrs regiment As appears by a letter under the hand of Sir Thomas Nicolsone his Captain produced with the said petitione And therefore Craveing that thesre Lordships would be pleased to refuse the desyre of the said John Forbes his petitione and to allow the petitioner to Continow him in his majetyes service Conforme to his engadgment As the said petitione bears The saids Lords of there Majestyes privie Counsell haveing considered this petitione given in to them be the above Captain Hamilton with the testificat or report under the hand of the Comanding officer of Blackness to whom there Lordships have remitted to take tryall of the grounds and method of the above John Forbes his Imprisonement with a missive Letter from the Laird of Tilliecultrie to the petitioner giveing accompt of severall miscarriadges and villainies Committed be the said John Forbes when he wes formerly in there Majestyes service They hereby Give order and warrand to the Governour of Blackness Castle And in his absence to the next comanding officer there to delyver the said John Forbes to the petitioner To be by him transported to Flanders as ane souldier in his Majestyes service there

Act Captain Alexander Hamilton of Grange against John Forbes

Concerning the petition given in by Captain Alexander Hamilton of Grange to the lords of their majesties’ privy council, showing that the petitioner being come hither for recruits for his majesty’s service, and in order thereunto having taken one John Forbes, formerly in the late [Charles Erskine] earl of Mar’s regiment, who both took on voluntarily and received the king’s pay for three weeks as appears by a testificat under the hand of the ensign of the castle of Blackness, where he remains. Yet the petitioner understanding that he has made application to the said lords as if he had not willingly engaged, albeit if read were beside the foresaid attestation it could be instructed by witnesses that he willingly engaged and has received the king’s pay accordingly. And it is notoriously known that for his gross misdemeanours he was disgracefully turned out of the earl of Mar’s regiment as appears by a letter under the hand of Sir Thomas Nicolson, his captain, produced with the said petition. And therefore craving that their lordships would be pleased to refuse the desire of the said John Forbes his petition, and to allow the petitioner to continue him in his majesty’s service conform to his engagement as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Captain Hamilton, with the testificat or report under the hand of the commanding officer of Blackness to whom their lordships have remitted to take trial of the grounds and method of the above John Forbes his imprisonment, with a missive letter from the laird of Tillicoultry to the petitioner, giving account of several miscarriages and villainies committed by the said John Forbes when he was formerly in their majesties’ service, they hereby give order and warrant to the governor of Blackness Castle, and in his absence to the next commanding officer there, to deliver the said John Forbes to the petitioner to be by him transported to Flanders as a soldier in his majesties’ service there.
