Act anent Maxwell and other witnesses against a Halyburtoun and a Fraser

The Lords of there majestyes privie Counsell Doe hereby Recomend to the Lords Commissioners of there majestyes theasury to Cause payment be made to Leivetenent Maxwell Serjeant Sloss and James Wishart drummer all in the Earle of Levens regiment of foot (And who by former orders of Counsell are appointed to remaine at Edinburgh untill the second Thursday of march next untill the tryall of Halyburtoun and Fraser who were seized comeing from the Bass be over) Off Such competent soumes of money as there Lordships shall think reasonable for defraying the expenses of there entertainment dureing the space they shall be detained And also for defraying the charges of there voyadge from this place to Flanders untill they meet with the said regiment to which they belong And recomends to the Lord high Chancellour to signe a testificat In favours of the said Leivetennent Serjeant and drummer Declareing they are necessarly detained here, for there majesties speciall service and not throw any default of there oune And that they shall be quickly dispatched to follow the said regiment as soon as there is not necessary ground of there detainement And that therefor they may be mustered as effectuall men in the said regiment In respect there absence is not through there oune default bot for there majestyes service as said is

Act concerning Maxwell and other witnesses against a Halyburton and a Fraser

The lords of their majesties’ privy council do hereby recommend to the lord commissioners of their majesties’ treasury to cause payment [to] be made to Lieutenant Maxwell, Sergeant Sloss, and James Wishart, drummer, all in [David Leslie] the earl of Leven’s regiment of foot (And who by former orders of council are appointed to remain at Edinburgh until the second Thursday of March next until the trial of Halyburton and Fraser, who were seized coming from the Bass, be over) off such competent sums of money as their lordships shall think reasonable for defraying the expenses of their entertainment during the space they shall be detained, and also for defraying the charges of there voyage from this place to Flanders until they meet with the said regiment to which they belong. And recommends to the lord high chancellor to sign a testificat in favour of the said lieutenant, sergeant, and drummer, declaring they are necessarily detained here for their majesties’ special service and not through any default of their own, and that they shall be quickly dispatched to follow the said regiment as soon as there is not necessary ground of there detainment, and that therefore they may be mustered as effectual men in the said regiment, in respect their absence is not through their own default but for their majesties’ service as said is.
