Act The Countesses of Rothes and Weymes

Anent a Petition given in to the Lords of their Majesties privy Councill Be Margrat Countes of Rothes Margrat Countes of Weymes and other of the heritors and eldors of the parishin of Auchterderren Shewing That by the thretie thrid act of the 2d session of their majesties Current parliament It is Statute and ordained, That in caice of the vaccany of any particular church, The heritors and elders of the parish are to name and Choise the persone who shall be their minister and in caise of any debate or Competition, Tho presbitrie is to moderat and determine in the Call notwithstanding wherof […] Laird of Ballmountie and […] Laird of Kininmouth in manifast contempt and disobedience to the said act of Parliament intend to thrust in upon the saids Lords petitioners to the paroch Church of Auchterderren one […] Young sometyme minister at Culross without any legall call from the Plurality of the heritors and elders of the parish Which is necessarly Requyred by the act of Parliament Bot meerly of themselves without concurrance of any of the elders that of late have been legally Chosen and Constitute in order to the giveing of a Call to a minister and without Consent of the heritors of the parish, Or if ther be any of those alongst with them they are bot few and inconsiderable and not only informall and Illegall is any call given (Raither to be termed a violent in puting then a Call) Bot the persone to whome the said two gentlmen pretend to give a Call is altogither incapable of receiveing any Seing at present he Lyes under a sentance of deprivature by the saids Lords act of Councill for not giveing obedience to the sixteenth act of the estates of this kingdome appoynting publict prayers to be made for the king William and Queen Mary Bot the violent actings of these two persones not to be remeeded by the Presbytrie from which they take no rules are only to be restrained and stop put therto by the saids Lords And Therfore humbly Craveing the saids Lords by their authoritie to put a Stop to the violent proceding of these persones, and Discharge any farder procedur in that call Bot gave order that the same be done orderly according to the present Established Lawes with Consent of the Lords petitioners And that in the mean tyme the keyes of the Church may be ordained to be delivered up to the Presbytrie (who only can supplie the Church dureing the vacancy) And who are to moderat in any call that can be formally given as the petition bears The Lords of their majesties privy Councill Haveing Considered this petition given in to them be the above Countes of Rothes and Weymes they appoint the above Laird of Ballmouto and Laird of Kininmouth to be cited to Compeir before the saids Lords upon the thrid day of march next to ansuer to the points of the above petition and to hear and see such order and Course taken theranent as the saids Lords should think Just and Grants Warrand for Citeing of witnesses against the said day.
