Act the heretors and Kirk session of the west kirk for stipend

Anent a petitione Given In to the Lords of their Majesties privy Councell Be The heretors and session of the west kirk with consent of Mr David Uilliamsone Minister ther Sheuing That wher the stipend of the second Minister of the said kirk is now setled by his Majesties gift and a decreit of the Commissione follouing theron Is vaccant for the year and Cropt Jaj vjc nyntie one and at his Majesties Disposall for pious uses He being patrone of the said kirk Lykeas tho Mr David Williamsone Did Supplie the functione of both first and second Minister the said year yet he is Content to forgive any claime he might pretend to it To the effect it might be applyed to the ends and uses aftermentioned And seing that the said Mr David was at all the expenses of procuring the new setlement and Augmentatione of the tuo stipends of the said kirk By raising summonds before the Commissione obtaining his Majesties Gift upon their reference Expeding the same in Exchequer and extracting the Commissions Decreit of Locality Conforme therto which ought to be reimbursed in the first place And that the kirk and manse being greatly indamaged by the standing out of the castle guairds being keeped ther were visited by their Lordships ordor and found to be damnified to the value of about tuelve Hundred merks which Cannot be more easily payed then by the Remainder of the said stipend And therfore Humblie Craving to the effect underwryten as the said petitione bears The saids Lords of their Majesties Privie Councell having Considered this petitione given Into them be the Heretors and session of the west kirk The[y] ordaines the stipend of the second minister of the said kirk to be payed to Adam Gairnes of Greenhill for the Cropt and year of god Jaj vjc nyntie one To be Imployed be him for the ends and uses aftermentioned And ordaines him to be readily ansuered obeyed and payed therof Be the Heretors fewars wodsetters Liferenters and others lyabl in payment of the samen And ordaines Letters of horning at the said Adams Instance Against them for that effect He producing a decreit of Locality And in case ther be none ordaines these Lyable to make payment of their respective proportiones of their said years stipend according as they shall be decerned by the Judge ordinary In respect the said Adam Gairnes Hath found sufficient Cautione acted in the books of privy Councell That he shall make payment of the soume of three Hundred merks of the said years stipend to the said Mr David Williamsone for the expenses of the setlement and augmentatione before mentioned and that he shall imploy the rest of the stipend for repairing of the said kirk and manse

Act for the heritors and kirk session of the West Kirk for a stipend

Concerning a petition given in to the lords of their majesties’ privy council by the heritors and session of the West Kirk with consent of Mr David Williamson, minister there, showing that where the stipend of the second minister of the said kirk is now settled by his majesty’s gift and a decreet of the commission following thereon is vacant for the year and crop of 1691 and at his majesty’s disposal for pious uses, he being patron of the said kirk, likewise though Mr David Williamson did supply the function of both first and second minister in the said year, yet he is content to forgive any claim he might pretend to it, to the effect it might be applied to the ends and uses after mentioned, and seeing that the said Mr David was at all the expenses of procuring the new settlement and augmentation of the two stipends of the said kirk by raising summons before the commission and obtaining his majesty’s gift upon their reference expediting the same in exchequer and extracting the commission’s decreet of locality conforming thereto, which ought to be reimbursed in the first place, and that the kirk and manse being greatly damaged by the standing out of the castle guards being kept there were visited by their lordships’ order and found to be lost to the value of about twelve hundred merks which cannot be more easily paid than by the remainder of the said stipend, and therefore humbly craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given into them by the heritors and session of the West Kirk they ordain the stipend of the second minister of the said kirk to be paid to Adam Gairns of Greenhill for the crop and year of God 1691 to be employed by him for the ends and uses after mentioned, and ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters, liferenters and others liable in payment of the same, and ordain letters of horning at the said Adam’s instance against them for that effect, he producing a decreet of locality, and in case there be none ordain those liable to make payment of their respective proportions of their said years stipend according as they shall be decerned by the judge ordinary, in respect the said Adam Gairns has found sufficient caution acted in the books of privy council that he shall make payment of the sum of three hundred merks of the said year’s stipend to the said Mr David Williamson for the expenses of the settlement and augmentation before mentioned and that he shall employ the rest of the stipend for repairing of the said kirk and manse.
