Act

Act to the heritors of Liberton for Mr Gideon Jack

Concerning a petition given in to the lords of their majesties’ privy council by the heritors of Liberton showing that where Mr Gideon Jack did at the call of the last general assembly (who thought fit to order letters to ministers and preachers of the Gospel out of the kingdom to invite them home to serve in this church) transport himself from England where he was settled minister of the city of Rochester in Kent and competently provided to serve in this church and having come to this kingdom about the middle of August last was immediately desired to preach in their kirk in order to a call which they having given to him unanimously he was by the presbytery admitted and settled to be their pastor shortly after Michaelmas last, and seeing his foresaid transport and since transporting his wife, children and servants to this kingdom has been very expensive to him, and that he has also been at charges in putting the manse in order for settling of his family, and that the stipend of the crop and year 1691 being vacant, and the kirk of the king’s patronage the petitioners are very well content, and humbly desire that the stipend be given to him in consideration of his foresaid extraordinary charges, likewise they have solicited the presbytery’s concurrence by their recommendation on his behalf, there being in effect no more pious and pressing use in their parish at this time, and therefore humbly craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to the them by the above heritors of Liberton with the recommendation of the presbytery mentioned in and produced therewith, together with another petition given in by Mr Alexander Cumming craving the above stipend, they refuse the desire of Mr Cumming’s petition and allow to the said Mr Gideon Jack the stipend of the said kirk of Liberton for the whole crop and year of God 1691, and ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters and others liable in payment of the same, and ordain letters of horning at his instance against them for that effect, he producing a decreet of locality, and in case there be none ordain those liable to make payment to him of their respective proportions of the said year’s stipend, according as they shall be decerned by the judge ordinary.
