Act the Lord Ruthven for stipend of Forgandunie

Anent a petitione Given In to the Lords of their Majesties privie Councell Be David Lord Ruthven Sheuing That wher by the express Acts of parliament vaccant stipends are appoynted to be applyed for pious uses uithin the paroch and that the manse and kirk and kirkyeard dyke of Forgandunie being both ruinous and the water of May running neer by the said church which in tymes of raine is very rapide and proves daingerous to passengers passing to and from the said Church And the stipend of the said kirk being at their Lordships disposall for the Cropt Jaj vjc nyntie one And the kirk being vaccant and their Majesties patrones therof And therfore Humblie Craving to the effect underwryten as the said petitione Bears The Saids Lords of their Majesties privie Councell having Considered this petitione Given In to them Be the said David Lord Ruthven They heirby appoynte the stipend of the above kirk of Forgandinnie For the Cropt and year of God Jaj vjc nyntie one To be Imployed for the uses abovementioned And nominats and appoints Uilliam Ogilvie servant to the said David Lord Ruthven To be factor for uplifting of the said years stipend And ordaines him to be readilie ansuered obeyed and payed therof Be the Heretors Fewers wodsetters Liferenters Fermers titulars tacksemen of teynds tennents possessors and others lyable in payment of the said stipend for the said year Jaj vjc And ordaines Letters of horning to be direct heiron at the Instance of hte said Factor He alwayes producing a decreit of Locality And In case the[re] be none ordaines the Heretors and others forsaids Lyable in payment of the said stipend To make payment therof to the said Factor for the said year According as they shall be decerned by the Judge ordinary In respect the said Factor Hath found sufficient Cautione acted In the books of privie Councell That he shall Imploy the forsaid years stipend upon the pious uses and ends abovementioned

Act for the Lord Ruthven for stipend of Forgandenny

Concerning a petition given in to the lords of their majesties’ privy council by David Lord Ruthven showing that whereby the express acts of parliament vacant stipends are appointed to be applied for pious uses within the parish and that the manse and kirk and kirkyard dike of Forgandenny being both ruinous and the water of May running near by the said church which in times of rain is very rapid and proves dangerous to passengers passing to and from the said church, and the stipend of the said kirk being at their lordships’ disposal for the crop of 1691, and the kirk being vacant and their majesties patrons thereof, and therefore humbly craving to the effect underwritten as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the said David Lord Ruthven they hereby appoint the stipend of the above kirk of Forgandenny for the crop and year of God 1691 to be employed for the uses abovementioned, and nominates and appoints William Ogilvie, servant to the said David Lord Ruthven, to be factor for uplifting of the said year’s stipend, and ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, wadsetters, liferenters, fermers, titulars, tacksmen of teinds, tenants, possessors and others liable in payment of the said stipend for the said year 1691, and ordain letters of horning to be directed hereon at the instance of the said factor, he always producing a decreet of locality, and in case there be none ordain the heritors and others foresaid liable in payment of the said stipend to make payment thereof to the said factor for the said year according as they shall be decerned by the judge ordinary, in respect the said factor has found sufficient caution acted in the books of privy council that he shall employ the foresaid year’s stipend upon the pious uses and ends abovementioned.
