Act Leiutenant Collonell Olyphant to Goe to London

Anent a petitione Given In to the Lords of their Majesties privie Councell Be Leivtennant Collonell William Olyphant Sheuing That wherever since the surrender of the house and castle of Fodderet The petitioner hes been still detained prisoner while by their Lordships Act of Liberatione of the date the tuelvth day of November Jaj vjc nyntie one He was sett at Libertie upon the finding Cautione to Live peacably under the government and to appear when called And in respect the petitioner be the only prisoner In all the Capitulatione who during his Imprisonment hes not receaved one farding of aliment but Lived upon the remainder of any Litle fortune he had And that he hes not seen his wyfe nor family these thre years bypast who Live in Flanders And that his whole fortune is now altogither exhausted quherby he Cannot any longer Live or subsist having nothing heir but what he may expect to live upon by his wyfe in Flanders And therfore Humblie Craving their Lordships In consideratione of the premises uould be pleased to allow the petitioner to goe for Flanders And to Grant him their pass for himself and servants for that effect wherby he may not be reduced to Great difficulties or otherwayes That their Lordships would be pleased to allow him such ane aliment Competent as is aggreablie to his quality and statione as the said petitione bears The saids Lords of their Majesties privie Councell Having Considered this petitione Given In to them Be the said Leivtennant Collonell Olyphant Doe heirby allow the petitioner free libertie to pass from this to the city of London That he may repaire to his Majestie and use his Indeavoures for procuring his Majesties pass to Goe abroad to Forraigne Countries And Give ordor and warrand to the Clarks of privie Councell to delyver up to the said Leivtennant Collonell the bond of Cautionry formerly Given in subscribed be him and his Cautioner therin In respect he hath given new bond and found sufficient Cautione acted in the books of privie Councell That he shall returne againe to this place and present himself to the saids Lords of privy Councell or otherwayes that he shall report to the saids Lords a Certificat under the hand of the secretary of state signifying to their Lordships That he hes obtained his Majesties pass to the effect forsaid And that betuixt and the first day of May nixt to come under the penalty of Fiftie pounds sterline And declaires the extract heirof to be a sufficient pass to the petitioner for travelling from this to London and from thence hither againe without trowble or mollestatione He behaving himself peacably as becometh a Good subject

Act for Lieutenant Colonel Olyphant to go to London

Concerning a petition given in to the lords of their majesties’ privy council by Lieutenant Colonel William Olyphant showing that wherever since the surrender of the house and castle of Fodderate the petitioner has been still detained prisoner while, by their lordships’ act of liberation of the date 12 November 1691 he was set at liberty upon the finding caution to live peaceably under the government and to appear when called, and in respect the petitioner is the only prisoner in all the capitulation who during his imprisonment has not received one farthing of aliment but lived upon the remainder of any little fortune he had, and that he has not seen his wife nor family these three years bypast who live in Flanders, and that his whole fortune is now altogether exhausted whereby he cannot any longer live or subsist having nothing here but what he may expect to live upon by his wife in Flanders, and therefore humbly craving their lordships in consideration of the premises would be pleased to allow the petitioner to go for Flanders and to grant him their pass for himself and servants for that effect, whereby he may not be reduced to great difficulties or otherwise that their lordships would be pleased to allow him such an aliment competent as is agreeable to his quality and station as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the said Lieutenant Colonel Olyphant do hereby allow the petitioner free liberty to pass from this to the city of London that he may repair to his majesty and use his endeavours for procuring his majesty’s pass to go abroad to foreign countries, and give order and warrant to the clerks of privy council to deliver up to the said lieutenant colonel the bond of caution formerly given in subscribed by him and his cautioner therein in respect he has given new bond and found sufficient caution acted in the books of privy council that he shall return again to this place and present himself to the said lords of privy council or otherwise that he shall report to the said lords a certificate under the hand of the secretary of state signifying to their lordships that he has obtained his majesty’s pass to the effect foresaid, and that between now and 1 May next to come under the penalty of fifty pounds sterling, and declares the extract hereof to be a sufficient pass to the petitioner for travelling from this to London and from thence hither again without trouble or molestation he behaving himself peaceably as becomes a good subject.
