Act Sir John Forbes for stipends of Keith and Inch

Anent the petitione given in to the Lords of there majestyes privie Councill be Sir John Forbes of Craigivar Shewing That whereas by the Constant practice of this natione and acts of parliament made anent vacant stipends particularly by the tuenty third act of the second sessione of this current parliament patrones are Impowered to Imploy vacand stipends upon pious uses within the respective paroches where the saids vacancies happen And now sieing the Church of Keith within the Dyocie of Murray hath vaicked the years Jaj vjc nyntie and Jaj vjc and nyntie one years And the Church [of Inch] in the Dyocie of Aberdeen hath vaicked all the saids years Jaj vjc nyntie one and Jaj vjc nyntie tuo, off both which Churches the petitioner is patrone and there Lordships haveing alreadie disposed of the stipend of the said church of Keith for the year Jaj vjc and nyntie To be Imployed on the reparatione of the said Church and manse which hath been accordingly applyed thereto And it being verie convenient and advantagious that a schooll for the Instructione of youth be encouradged at the said Church of Keith the place being in the mouth of the Highlands and great accomodation therein for the same so that it is very proper the vacand stipend of the said Church of Keith for the year Jaj vjc and nyntie one and Jaj vjc nyntie tuo be Imployed as a fond for the mantenance of a schoollmaister at the said church And at the said Church of Insch there being a publict mercat place To which there is no access in badd weather for want of bridges upon tuo waters hard by the said place The Applyeing the vacand stipend of the said Church for the years Jaj vjc and nyntie one and Jaj vjc nyntie tuo for building of tuo bridges upon the said waters would be a work verie pious and Comendable And sieing the petitioner is satisfyed to find Cautione to Imploy the saids vacand stipends upon the forsaid pious uses or any other the saids Lords shall Judge more proper And therefore Craveing that there Lordships would be pleased to Consider the premises And to give order and warrand to the petitioner to uplift the vacand stipends of the said tuo churches for the years Jaj vjc and nyntie one and Jaj vjc nyntie tuo In order to Imploy them on the saids pious uses As the said petitione bears The Saids Lords of there Majestyes privie Councill haveing Considered this petition Given in to them be the above Sir John Forbes of Craigivar They In respect of the petitioners right Doe hereby allow the stipend of the above Kirk of Keith for the haill year Jaj vjc nyntie one and first half of the year Jaj vjc and nyntie tuo to be Imployed for erecting a schooll at the said kirk of Keith And Lykewayes allowes the stipend of the above kirk of Insch for the said haill year Jaj vjc nyntie one and first half of the year Jaj vjc and nyntie tuo To be Imployed for building of bridges upon the above tuo waters And nominates and appoints Patrick Forbes of Foullis to be factor for uplifting the stipends forsaids of both the saids kirks And ordaines him to be readily ansuered obeyed and payed thereof be the heretors Lyfrenters wodsetters titulars tacksmen of teynds tennents possessors and others Lyable in payment of the same And ordaines Letters of horning to be direct at his Instance againest them for that effect He produceing a decreet of Locality And in case there be no decreit of Locality ordaines these Lyable to make payment to him of there proportiones as the samen shall be decerned be the Judge ordinary and appoints the petitioner to take sufficient Caution from the said factor that he shall Imploy the stipends for the ends forsaids.

Act for Sir John Forbes for stipends of Keith and Inch

Concerning the petition given in to the lords of their majesties’ privy council by Sir John Forbes of Craigievar shewing that, whereas by the constant practice of this nation and acts of parliament made concerning vacant stipends, particularly by the twenty-third act of the second session of this current parliament, patrons are empowered to employ vacant stipends upon pious uses within the parishes where the said vacancies happen, and now seeing the church of Keith within the diocese of Moray has been vacant in 1690 and 1691, and the church [of Inch] in the diocese of Aberdeen has been vacant for the said years 1691 and 1692, of both which churches the petitioner is patron, and their lordships having already disposed of the stipend of the said church of Keith for 1690 to be employed on the repair of the said church and manse which has been accordingly applied thereto, and it being very convenient and advantageous that a school for the instruction of youth be encouraged at the said church of Keith, the place being in the mouth of the Highlands and great accommodation therein for the same so that it is very proper the vacant stipend of the said church of Keith for 1691 and 1692 be employed as a fund for the maintenance of a schoolmaster at the said church; and at the said church of Inch there being a public market place to which there is no access in bad weather for want of bridges upon two waters hard by the said place, applying the vacant stipend of the said church for 1691 and 1692 for building two bridges upon the said waters would be a work very pious and commendable; and seeing the petitioner is satisfied to find caution to employ the said vacant stipends upon the foresaid pious uses or any other the said lords shall judge more proper, and therefore craving that their lordships would be pleased to consider the premises and give order and warrant to the petitioner to uplift the vacant stipends of the said two churches for 1691 and 1692 on order to employ them on the said pious uses, as the said petition bears. The said lords of their majesties’ privy council, having considered this petition given in to them by the above Sir John Forbes of Craigievar, they in respect of the petitioner’s right, hereby allow the stipend of the above kirk of Keith for the whole of 1691 and the first half of 1692 to be employed for erecting a school at the said kirk of Keith, and likewise they allow the stipend of the above kirk of Inch for the said whole of 1691 and first half of 1692 to be employed for building of bridges upon the above two waters, and they nominate and appoint Patrick Forbes of Foulis to be factor for uplifting the foresaid stipends of both the said kirks, and they ordain him to be readily answered, obeyed and paid thereof by the heritors, liferenters, wadsetters, titulars, tacksmen of teinds, tenants, possessors and others liable in payment of the same, and they ordain letters of horning to be directed at his instance against them for that effect, he producing a decreet of locality, and in case there is no decreet of locality, they ordain those liable to make payment to him of their proportions as the same shall be discerned by the judge ordinary, and appoints the petitioner to take sufficient caution from the said factor that he shall employ the stipends for the ends foresaid.
