Act Mr William Lindsay for stipend

Anent the petitione given in to the Lords of there Majestyes privie Councill be Mr William Lyndsay minister at Alba Shewing That whereas the petitioner wes removed from his charge at Alba only by the act of parliament restoreing the ministers outted in the year Jaj vjc sixtie one And be vertue of the said act depryved of a years stipend he actually served for And his predicessor who took possession voluntarly removeing himself and setleing in aneother charge befor Michaellmes last And the petitioner called and Intreatted by the patrone heretors elders and wholl maisters of familyes to serve the Cure at the said Kirk of Alba And that he hath actually done it And Continowes so to doe And moreover that in the said call The patrone with consent of the wholl2 paroch above mentioned hath bestowed the Locall modifyed stipend upon the petitioner from the removeall of his predicessor dureing his serving the cure at the said church And therefor Craveing that the saids Lords would be pleased to give warrand that these Lyable (which they are most willing to doe) may pay the said stipend to the petitioner from Michaellmess last That is to say the second half of the year Jaj vjc nyntie one and the present year Jaj vjc nyntie tuo the termes of payment being first come and by gone and for the tyme to come what the saids Lords in there Justice and wisdome shall think fitt As the said petitione bears The Saids Lords of there majestyes privie Councill haveing considered this petitione Given in to them be the above Mr William Lindsay and call produced therewith They allow the petitioner the stipend of the above Kirk of Alba for the last half of the Cropt and year Jaj vjc and nyntie one and first half of the cropt and year Jaj vjc nyntie tuo And ordaines him to be readiely ansuered obeyed and payed thereof be the heretors fewers Lyfrenters titulars tacksmen of teynds tennents possesers and others Lyable in payment of the samen the termes of payment being first come and bygone and ordaines Letters of horning to be direct at his Instance againest them for that effect upon production of a decreet of Locality And in case there be none ordaines these Lyable to make payment of there respective proportiones according as the samen shall be decerned be the Judge ordinary In respect the petitioner hes signed ane obleidgment Binding and obleidgeing himself That for the future he shall pray for there majestyes King William and Queen Mary as King and Queen of this Realme

Act for Mr William Lindsay for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr William Lindsay, minister at Alva, shewing that whereas the petitioner was removed from his charge at Alva only by the act of parliament restoring the ministers ousted in the year 1661 and by virtue of the said act deprived of a year’s stipend he actually served for, and his predecessor who took possession voluntarily removing himself and settling in another charge before Michaelmas last, and the petitioner called and entreated by the patron, heritors, elders and whole masters of families to serve the cure at the said kirk of Alva, and that he has actually done it and continues to do so, and moreover that in the said call the patron with consent of the whole parish above mentioned has bestowed the local modified stipend upon the petitioner from the removal of his predecessor during his serving the cure at the said church, and therefor craving that the said lords would be pleased to give warrant that those liable (which they are most willing to do) may pay the said stipend to the petitioner from Michaelmas last, that is to say the second half of 1691 and the present year 1692, the terms of payment being first come and gone, and for the time to come what the said lords in their justice and wisdom shall think fit, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr William Lindsay and the call produced therewith, they allow the petitioner the stipend of the above kirk of Alva for the last half of the crop and year 1691 and first half of the crop and year 1692, and they ordain him to be readily answered, obeyed and paid thereof by the heritors, feuars, liferenters, titulars, tacksmen of teinds, tenants, possessors and others liable in payment of the same, the terms of payment being first come and gone and they ordain letters of horning to be directed at his instance against them for that effect upon production of a decreet of locality, and in case there is none, they ordain those liable to make payment of their respective proportions as the same shall be discerned by the judge ordinary, in respect the petitioner has signed an obligation binding and obliging himself that for the future he shall pray for their majesties King William and Queen Mary as king and queen of this realm.
