Act Johnstoun and Wauch Against Kirkwood Linlithgow

Anent a Petition given in to the Lords of their majesties privy Councill be James Wauch Cordinar And James Johnston merchant both burgesses of Linlithgow Shewing That quherin the actione raised at the instance of Mr James Kirkwood before the saids Lords against the magistrats as being of the Council of the said burgh ware cited But throw reasone of their infirmity and old age could not keep the day, and now seing that the petitioners are come in to present themselves before the saids Lords befor any sentance given in the said matter And Therfore Humbly Craveing the saids Lords to Discharge the certificatione past against them and to repone them theranent as the petitione bears. The Lords of their majesties privy Councill haveing Considered this petition given in to them be the above James Johnston and James Wauch They heirby Repone the petitioners against the Certification pronunced in the process before the Councill at the instance of Mr James Kirkwood against them And Declares them free therof and of any hazard may follow theron as if the same had never been given nor pronunced.
