Act Mr John Lyon Minister for stipend of Kinetles

Anent the petition Given in to the Lords of there Majestyes privie Counsell be Mr John Lyon minister at Kinettles Shewing That where the petitioner hes supplyed the function and office of a Minister at the church of Kinetles in the shyre of Forfar for the space of tuo years and some moneths bypast viz since the beginning of Apryll Jaj vjc and nyntie untill this day the said church being vacant throw the deposition of Mr Alexander Tailzeor from the Ministerie of that church by the synod of St Andrews in the year Jaj vjc and Eightie Eight And upon Application to severall of the generall assembly Mr Alexander Pitcairne, Mr Hugh Kennedie and Mr John Spalding did upon the Fourteint of November Jaj vjc and Nyntie by there Letter to the heretors of the pariochine Recomend his condition and strait to them as most favourable So accordingly the heretors by there declaration subscryved with there hands daitted the Fourth day of september Jaj vjc Nyntie one years doe signifie there willingnes that the petitioner should have the stipend dureing the said space provydeing that he procure ane warrand from there Lordships for uplifting the samen And sieing the petitioner hes all along Complyed with the present government and is still willing to doe the samen But not being able Longer to subsist unless he have the said bygone stipend payed to him which is but very Small nor exceeding Fyve Hundreth merks yearly or thereby Likeas the former Ministers Relict and family still keeps possession of the manse and Gleib and will not remove unles compelled to the petitioners and the pariochoners great prejudice and Inconveniencie Notwithstanding the said minister was deposed as said is And therefore Craveing That there Lordships would be pleased to Interpose there authority and allow the heretors subscrybers and others who are willing to subscrybe To pay the petitioner the forsaid bygone stipend from Apryll Jaj vjc and nyntie years till this present tyme And to ordaine the Relict and family of the last minister to be removed from the manse and gleeb of the said kirk As the said petitione bears The saids Lords of there Majestyes privie Counsell haveing considered this petitione Given in to them be the above Mr John Lyon with the Ministers Letter and the heretors declaration mentioned therein and produced therewith They hereby allow to the petitioner the stipend of the above kirk of Kinetles from the moneth of Apryll Jaj vjc and Nyntie years to the terme of Mertinmes Last by past And ordaines him to be readiely ansuered obeyed and payed thereof for the said space be the heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning at the petitioners instance againest them for that effect He produceing a decreet of Locality And in case there be non ordaines these Lyable To make payment to him according as they shall be Decerned by the Judge ordinarie of there respective proportiones of the said stipend for the space forsaid And Refuses the desyre of the petition Concerning the Manse and Gleib.

Act Mr John Lyon minister for stipend of Kinnettles

Concerning the petition given in to the lords of their majesties’ privy council by Mr John Lyon, minister at Kinnettles, showing that where the petitioner has supplies the function and office of a minister at the church of Kinnettles in the shire of Forfar for the space of two years and some months bypast viz since the beginning of April 1690 until this day, the said church being vacant through the deposition of Mr Alexander Tailzeor from the ministry of that church by the synod of St Andrews in the year 1688, and upon application to several of the general assembly Mr Alexander Pitcairne, Mr Hugh Kennedy, and Mr John Spalding did upon the fourteenth of November 1690 by their letter to the heritors of the parish recommend his condition and strait to them as most favourable. So accordingly the heritors by their declaration subscribed with their hands dated the fourth day of September 1691 do signify their willingness that the petitioner should have the stipend during the said space, providing that he procure a warrant from their lordships for uplifting the same. And seeing the petitioner has all along complied with the present government and is still willing to do the same but not being able longer to subsist unless he has the said bygone stipend paid to him which is but very small nor exceeding five hundred merks yearly or thereby, like as the former minister’s relict and family still keep possession of the manse and glebe and will not remove unless compelled, to the petitioner’s and the parishioners’ great prejudice and inconvenience notwithstanding the said minister was deposed as said is. And therefore craving that their lordships would be pleased to interpose their authority and allow the heritors, subscribers, and others who are willing to subscribe to pay the petitioner the foresaid bygone stipend from April 1690 years till this present time, and to ordain the relict and family of the last minister to be removed from the manse and glebe of the said kirk as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Mr John Lyon with the minister’s letter and the heritors’ declaration mentioned therein and produced therewith, they hereby allow to the petitioner the stipend of the above kirk of Kinnettles from the month of April 1690 to the term of Martinmas last by past and ordain him to be readily answered, obeyed, and paid thereof for the said space by the heritors, feuers, wadsetters, and others liable in payment of the same. And ordain letters of horning at the petitioner’s instance against them for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment to him according as they shall be discerned by the judge ordinary of their respective proportions of the said stipend for the space foresaid, and refuse the desire of the petition concerning the manse and glebe.
