Liberatione for Sir Walter Seattoun

Anent the petition Given in to the Lords of there Majestyes privie Counsell be Sir Walter Seatton of Northbank Shewing That where the petitioner haveing been Incarcerat in the tolbooth of Edinburgh be vertue of Letters of Caption execute at the Instance of Walter Cornwall of Bonhard My Cousigne german off whose pretentions against me and my estate there is a process of reduction depending befor the Lords of Session which will result in ane accompt and reckoning upon the event whereof I hope there shall not be much resting to him But his severity againest me hes allarumed my other Creditors who have Lykewayes arrested me And altho I shall not say he hes any other designe but to keep me from attending my affairs and thereby to take his advantage yet Its Lyke to prove the occasion of my death I haveing Contracted many dangerous distempers which in the opinion of phisicians If I continow Longer in prisone may suddenly occasione my death as ane testificat and declaratione subscryved by Sir Robert Sibbald Mr William Blackadder and Mr Thomas Spens, doctors of medicine produced with the said petitione more fully to Informe there Lordshps And therefor humbly craveing there Lordships would be pleased to Grant warrand to the Goodman of the tolbooth of Edinburgh to allow the petitioner to goe out of prisone to any place in Edinburgh That he may have the benefite and use of means for the recovery of his health Not withstanding of the forsaid Captione or any arrestments of him in prisone upon the said petitioners Giveing bond to returne to the said prisone againest the […] day of […] In case his health shall allow As the said petitione bears The saids Lords of there Majestyes privie Counsell having considered this petitione Given in to them be the above Sir Walter Seatton with the testificat of the petitioners dangerous case under the hands of phisicians mentioned in and produced there with They hereby Give order and warrand to the Magistrats of Edinburgh and keeper of the tolbooth to sett the petitioner furth thereof In respect he hes found Sir John Foullis of Ravilstoun Cautioner That he shall Reenter the said prisone If he be alyve Betuixt and the first day of Apryll next to come or otherwayes that he and his said Cautioner shall make payment to the persons at whose Instance he is Incarcerat or arrested in the said tolbooth off the haill debts for which he is so Incarcerate or arreisted

Concerning the petition given in to the lords of their majesties’ privy council by Sir Walter Seaton of Northbank, showing that where the petitioner having been incarcerated in the tolbooth of Edinburgh be virtue of letters of caption executed at the instance of Walter Cornwall of Bonhard my cousin germane, of whose pretentions against me and my estate there is a process of reduction depending before the lords of session which will result in an account and reckoning upon the event whereof I hope there shall not be much resting to him, but his severity against me has alarmed my other creditors who have likewise arrested me, and although I shall not say he has any other design but to keep me from attending my affairs and thereby to take his advantage, yet it’s like to prove the occasion of my death, I having contracted many dangerous distempers which, in the opinion of physicians, if I continue longer in prison may suddenly occasion my death, as a testificat and declaration subscribed by Sir Robert Sibbald, Mr William Blackadder, and Mr Thomas Spens, doctors of medicine produced with the said petition more fully to inform their lordships. And therefore humbly craving their lordships would be pleased to grant warrant to the goodman of the tolbooth of Edinburgh to allow the petitioner to go out of prison to any place in Edinburgh that he may have the benefit and use of means for the recovery of his health, notwithstanding of the foresaid caption or any arrestment of him in prison, upon the said petitioner giving bond to return to the said prison against the […] day of […] in case his health shall allow, as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Sir Walter Seaton with the testificat of the petitioner’s dangerous case under the hands of physicians mentioned in and produced therewith, they hereby give order and warrant to the magistrates of Edinburgh and keeper of the tolbooth to set the petitioner forth thereof in respect he has found Sir John Foulis of Ravelston cautioner that he shall re-enter the said prison if he be alive between and the first day of April next to come or otherwise that he and his said cautioner shall make payment to the persons at whose instance he is incarcerated or arrested in the said tolbooth of the whole debts for which he is so incarcerated or arrested.
