Act Grant Against Gordonstoune
Anent a Petition given in to the Lords of their majesties Privy Councill be Lodovick Grant of Freuchie ane of the saids Lords oun number Shewing That Sir Robert Gordon of Gordonstoune haveing pursued the petitioner and many of his men before the saids Lords upon ane most unjust and Calumnious Complaint bearing that some of his men hade been accessorie to a depredation committed upon some of his tenents in June Jaj vjc Eightie nyne and the saids Lords after hearing of parties haveing appointed Gordonstounes witnesses to be examined before a Comittie of the saids Lords number, and the said Committie haveing appoynted the saids witnesses not only to be examined upon Gordonstons Lybell But Lykwayes, upon the interrogators to be given in by the petitioner for Clearing of his oun and his mens Innocence, as to all the grounds of that Calumnious Complaint; Bot the said Sir Robert Finding that by his oun witnesses It could be proven that he and his men did all that was possible both for preventing the depredation and recovering back of the prey and Booty from the rebells and brocken men, and that all the goods Robbed and spulzied be them was actually recovered and brought back by the help and assistance of his Clann and descendents of his familly and the petitioner and their servants, The petitioner being in the feilds in ther majesties service at the tyme, The said Sir Robert Did only cause examine his oun Baillie and Chamberlane and other tuo or thrie Bot would not suffer the rest of the witnesses cited by himself to be examined Because he knew they would prove the petitioners defence in terminis And seing the petitioner hade raised ane exculpatione by way of Reconventione for clearing of his oun and his mens Innocencie of all that is Lybelled against the petitioner and that ther are thrie or four witnesses by Gordonstoun himself presently in toune who are not yet examined and Therfore Humbly Craveing the saids Lords To Recomend to the Comittie who examined the other witnesses to take and receive their depositiones upon the grounds of his exculpation and reconventione and to grant warrand to macers for citeing of them for that effect That the true matter of Fact and Haill Circumstances being proven and Laid out before the saids Lords They might proceid to administrat Justice and determine therin as they should think fitt, and in the mean tyme to stop the advyseing of the depositiones allready adduced by Gordonstoune as the petition bears The Lords of ther majesties privy Councill haveing Considered this petition given in to them be the Laird of Grant They heirby give order and warrand to the macers of Councill to cite such of the witnesses cited or adduced be the Laird of Gordonstone in the above proces of his instance against the petitioner as are presently within the toune of Edinburgh or suburbs therof viz William Grant of Alve Allan Grant in Debey and John Grant in […] To Compeir before the Lords of their majesties privy Councill or their Committie appoynted for examineing the witnesses in the above process within tuentie four hours after the charge To bear laufull and Suithfast witnessing upon the grounds of the above exculpation or Reconvention at the petitioners instance against Gordonstone and Recommends to the said Committie to receive the depositiones of the saids witnesses accordingly.
