Act Adam Drumond of Mcginsh

Anent a Petitione given in to the Lords of their majesties Privy Councill be Adam Drumond of Meginsh shewing That quheras the heritors and others of the Paroch and kirk session of Erroll haveing lawfullie called Mr Samuell Nairne to be their minister and procured him to be transported from the Kirk of Menzie to the kirk and parish of Erroll and the Presbytrie of Pearth haveing observed all legall methods Did solemnly admitt him to be minister at the said kirk ther being nothing legally objected against him by any persone neither did any person Compeir when they returned and Called his edict as the instrument taken upon his admission therwith produced bears As also that by many express acts of Parliament and particulally by the tuentie seventh act Eleventh Parliament King James 6th and severall subsequent acts of Parliament the molesters and disturbers of the worshop of god should be severallie punished and the saids Lords by their act of the date the Eleventh day of June last have Discharged all persones upon their highest perrill to molest or trouble any minister allowed by the Presbytrie of Pearth to Preach in the kirk of Erroll notwithstanding of all which Mr Francis Rait pedagogue to the Laird of Kinairds Childrein does in manifast Contempt of the saids Lawes and acts of Parliament and the saids Lords act of Councill and of the present established government ordinarly everie Lords day within the said kirk In presence of the congregatione hindering divyne worshop, not only protest against the said Mr Nairn But upon express designe to frustrat his ministrie and to prejudicat the people reads most Calumnious Lybells against him and particullarly upon the seventeenth day of January last haveing brought Togither to the said kirk a great number of People quherof many out of nighburing parichins, with purpose to make Disturbance in a most Insolent and Irreligious maner entered the said kirk and in tyme of divine Service Did not only most Imprudently and Arrogantly interupt the same by his accustomed protestationes in face of the wholl Congregation Bot also by most approbrious speeches and high mannaces against the said Mr Nairne Requyred him to forbear preaching and desert his ministerie ther And Concluded all by calling to the people to desert and Disoun him, as him self would doe, upon which he and these Convocat by him made great tumult and Confusion in the Church Rushing to and froe Did violently dryve a great many out of doors to the great profination of the Sabbath the scandall of Religion and high Contempt of authoritie and lawes of this natione as ane instrument taken therupon therwith produced at more leanth bears By Which abuse not only the said Mr Nairne would be disencouradged in the exercise of his ministrie Bot the people might be involved in Dangerous Tumults, unles the saids Lords would provyde tymeous remeed And Therfore Humbly Craveing the saids Lords In Consideratione of the premisses to appoint the said Mr Francis Rait to be cited before the saids Lords to underlye the Law for such gross and inacomptable abuse and to discharge him and all others from giveing any Disturbance to the said Mr Nairne in the exercise of his ministrie at the said Church and within the said Parish in time comeing underwhat Certificatione the saids Lords should be pleased to name and to appoint the same to be duely intimat that non might pretend Ignorance as the Petitione bears The Lords of their Majesties privy Councill haveing Considered this petitione given in to them be the be the above Adam Drumond of Mcginsh with the instruments and other writtes produced therwith They heirby Grant warrand for raiseing and prosecuting a proces before their Lordships against the above Mr Francis Rait, To answer for the gross abuses and high Crymes Laid to his charge And Grants warrand for citeing of witnesses and straitly prohibits and peremptorly Discharges the said Mr Francis Rait and all other persones quhatsomever from hindering molesting troubling or any maner of way Disturbing the said Mr Samuell Nairne in the peacable exercise of his ministrie at the within the kirk of Erroll or within the paroch therof In all tyme comeing as they will be answerable at their highest perrill and ordaines the reader to read and intimat their presents from his leitteron upon a Sabboth day after the forenoons sermon that non may pretend Ignorance.
