Anent a Petitione given in to the Lords of their Majesties privy Councill be David Ross of Balnagoune John Ross of Auchnocloich shireff depute of Ross and others Shewing That quher the petitioners are charged be vertue of the saids lords letters of Laborrowes raised at the instance of Sir Donald Bayne of Tulloch to find Cautione in their books within six dayes with Certificatione as the charge heirwith produced would testifie, and seing the said Charge upon six dayes is not only Contrair to the act of Parliament being near two hundred myles distanct from Edinburgh besydes many ferries But also the said charge is meerly out of malice and prejudice against the petitioners being continually harassed by depredationes and still Imployed in Defence of their majesties government as wes weell knowen to some of the saids Lords number and In Respect the saids Lords Clerks alledges that they could not receive the petitioners Cautioners for one another without the saids Lords warrand Tho the petitioners humbly conceaved that the said David Ross of Balnagowen (who is not only knowen to be responsall for any such malicious charge Bot also of intire Loyaltie to their majesties and present government) as Cheiff of his Clann charged and comptable for them all ought to be received, They becomeing all bound Conjuctllie and severallie ex super abundantis offer one another, And Considering that it was Impossible for the petitioners to fulfill the will of the charge within such a short space And therfore humbly Craveing the saids Lords In Consideratione of the Premisses aither to order their Clerks to receive the said bond of Cautione therwith produced, The defect quherof is meerly the fault of the writter or to discharge the expeding of any letters of Captione upon the forsaid charge for six weeks or such a competent tyme as the saids Lords thought fitt to allow in such a great Storme to returne ane other bond of Cautionrie towards the procureing of a suspensione of the forsaid Lawborrowes as also to grant warrand to the Clerks to receive the petitioners Cautioners for one another and the said David Ross of Balnagowen as Cautioner for his oun tennents as the petitione bears The Lords of their majesties privy Councill haveing Considered this Petitione given in to them be above Ballnagowen and others, They heirby Discharge the Clerks of Councill to give out any Caption upon the above letters of Laborrowes Untill the […] day of […] and allowes the saids Clerks to receive the persones against whom the said Laborrowes Is raised each one of them Cautioner for another, and to receive the said Laird of Balnagowen Cautioner for his tennents Contained in the said Laborrowes
