Act The shirreff deput and shireff Clerk of Aberdeen anent oathes of alleadgeance

Anent the petition Given in to the Lords of there Majesties Counsell be Andrew Fraser of Kinmoundie shirreff deput of Aberdeen and Thomas Hay shirreff Clerk thereof Shewing That the petitioners did duely and tymously returne to there Lordships Clerks ane exact List of those who took the oath of alleadgeance to there Majestyes befor the petitioners for obtaining the benefite of there majesties Indemnity which List wes attested by the petitioners and found by there Lordships to be formall and exact But in respect there were some other Lists in to there Lordships by other shirreffs and the Clerks not so formall And wherewith the Lords were not satysfyed There Lordships were therefore pleased to emitt ane act ordaining all shirreffs, shirreff clerks etc to transmitt to there Lordships Clerks the principall oathes of alleadgeance taken befor them to the effect it aught appear that the samen were duely and tymously taken and in the termes of the act of parliament and that betuixt the […] day of Februarij instant In obedience to which act The petitioners produced with the said petitione ane book Containing the principall oathes of alledgeance of the severall persones taken befor them And sieing the petitioners have given out severall extracts to the persones who took the said oath of alleadgeance to the effect they might have the benefite of there Majestyes Indemnity It is necessarie both upon the accompt and for the petitioners Exoneration of there trust and duety so faithfully and diligeantly discharged by them That the petitioners get back from their Lordships Clerks the Just double of the said List formerly transmitted to them with the saids Clerks there attestation that they have receaved in them And therefore Craveing to the effect underwreitten As the petitione bears The Lords of there Majestyes privie Counsell aforsaid Haveing Considered this petition Given in to the them be the above shirreff deput and shirreff Clerk of Aberdeen They hereby Give order and warrand to there Clerks of Counsell to Returne to the petitioners a Just double of the List of those who took the oath of alleadgeance before them In respect the principall oathes are given in to the Counsell or there clerks In obedience and Conforme to the proclamationes of Counsell Emitted thereanent

Act the sheriff depute and sheriff clerk of Aberdeen concerning oaths of allegiance

Concerning the petition given in to the lords of their majesties council by Andrew Fraser of Kinmundy, sheriff depute of Aberdeen, and Thomas Hay, sheriff clerk, thereof, showing that the petitioners did duly and timeously return to their lordships’ clerks an exact list of those who took the oath of allegiance to their majesties before the petitioners for obtaining the benefit of their majesties indemnity, which List was attested by the petitioners and found by their lordships to be formal and exact. But in respect there were some other lists in to their lordships by other sheriffs and the clerks not so formal, and wherewith the lords were not satisfied, there lordships were therefore pleased to emit an act ordaining all sheriffs, sheriff clerks etc to transmit to their lordships’ clerks the principal oaths of allegiance taken before them to the effect it ought appear that the same were duly and timeously taken, and in the terms of the act of parliament, and that between the […] day of February instant. In obedience to which act the petitioners produced with the said petition an book containing the principal oaths of allegiance of the several persons taken before them, and seeing the petitioners have given out several extracts to the persons who took the said oath of allegiance to the effect they might have the benefit of their majesties indemnity, it is necessary both upon the account and for the petitioners’ exoneration of their trust and duty, so faithfully and diligently discharged by them, that the petitioners get back from their lordships’ clerks the just double of the said list formerly transmitted to them with the said clerks their attestation that they have received in them, and therefore craving to the effect underwritten as the petition bears. The lords of their majesties’ privy council aforesaid having considered this petition given in to them by the above sheriff depute and sheriff clerk of Aberdeen, they hereby give order and warrant to their clerks of council to return to the petitioners a just double of the list of those who took the oath of allegiance before them, in respect the principal oaths are given in to the council or their clerks, in obedience and conform to the proclamations of council emitted thereanent.
