Act Mr James2 Hay for stipend

Anent the petition Given in to the Lords of there Majesties privie Counsell be Mr James Gaddorer minister Shewing That whereas the petitioner did for severall years Continow in the peaceable exercise of his Ministerie at Kilmalcolme And when violently thrust out of his Manse in March Jaj vjc and Eightie Nyne years yet did still Live in the Neighbourhood of the said paroch, frequently visite his pariochiners and exercise such parts of his ministrie as he wes allowed and Invited unto and at this verie tyme does remaine within his said paroch being in straitts and haveing no mean of subsistance But by the favour of his Noble patrone The Earle of Glencairne Who not only hes granted his Lordships Consent But also Recomended the petitioner to there Lordships favour for the stipend Jaj vjc and Eightie Nyne years And whereas Mr Hay wes not Legallie admitted to that charge till anno Jaj vjc and Nyntie And by the fyfth act of this Current parliament hes no right to any pairt of the year Jaj vjc and Eightie Nyne which the petitioner humbly Craves And there being never any Lybell or process Nor any sentence Civill or Ecclesiastical againest the petitioner who alwayes hes behaved himself peaceablie never refused submission to the present government and whose Condition supplicates for the favour there Lordships hes granted to others in such cases And therefore Craveing That there Lordships would grant warrand for the Jaj vjc and Eightie Nyne In favours of the petitioner and to ordaine payment thereof Conforme to his decreet of Locality. As the said petitione bears The saids Lords of there Majesties privie Counsell have Considered this petition Given in to them be the within Mr James Gaddorer with the Consent Mentioned therein and produced therewith with the ansuers given in thereto be the within Mr James Hay minister at Kilmalcolme tuo testificats produced in his favours The one thereof testifyeing that he wes ordained unto that paroch be the presbitry in the year Jaj vjc and Eightie Eight subscryved be the Moderator of the presbitrie daited the fyfteint day of September Jaj vjc and Nyntie one years And the other testifyeing that with the Consent of the presbitrie and upon a Call from the said paroch hes preached there the wholl year Jaj vjc and Eightie Nyne and Jaj vjc Nyntie Subscryved be the Moderator and Clerk of the presbitrie of paisley Together with the Replyes Given in for the petitioner They hereby Preferr the said Mr James Hay to the stipend of the above kirk of Kilmalcome the haill Cropt and year of God Jaj vjc and Eightie Nyne years And ordaines he to be readily ansuered obeyed and payed thereof be the heretors fewers wodsetters and others Lyable in payment of the samen And ordaines Letters of horning at his Instance for that effect He producing a decreet of Locality And in case there be none Ordaines these Lyable, To make payment to the said Mr James Hay of there respective proportiones of the said years stipend According as they shall be decerned be the Judge ordinarie And Discharges the said Mr James Gaddorer from troubleing or molesting of the said Mr Hay in the peaceable possession uplifting and disposeing of the forsaid stipend

Act Mr James Hay for stipend

Concerning the petition given in to the lords of their majesties’ privy council by Mr James Gaddorer, minister, showing that whereas the petitioner did for several years continue in the peaceable exercise of his ministry at Kilmacolm, and when violently thrust out of his manse in March 1689, yet did still live in the neighbourhood of the said parish, frequently visit his parishioners, and exercise such parts of his ministry as he were allowed and invited thereunto, and at this very time does remain within his said parish, being in straits and having no means of subsistence but by the favour of his noble patron [John Cunningham] the earl of Glencairn, who not only has granted his lordship’s consent but also recommended the petitioner to their lordship’s favour for the stipend [of] 1690. And whereas Mr Hay was not legally admitted to that charge till anno 1690 and by the fifth act of this current parliament has no right to any part of the year 1689 which the petitioner humbly craves, and there being never any libel or process, nor any sentence civil or ecclesiastical against the petitioner, who always has behaved himself peaceably, never refused submission to the present government, and whose condition supplicates for the favour their lordships have granted to others in such cases, and therefore craving that their lordships would grant warrant for the 1689 in favour of the petitioner and to ordain payment thereof conform to his decreet of locality, as the said petition bears. The said lords of their majesties’ privy council have considered this petition given in to them by the within Mr James Gaddorer with the consent mentioned therein and produced therewith, with the answers given in thereto by the within Mr James Hay, minister at Kilmacolm, two testificats produced in his favours, the one thereof testifying that he was ordained unto that parish be the presbytery in the year 1688, subscribed by the moderator of the presbytery, dated the fifteenth day of September 1691, and the other testifying that with the consent of the presbytery and upon a call from the said parish [he] has preached there the whole year 1689 and 1690, subscribed be the moderator and clerk of the presbytery of Paisley, together with the replies given in for the petitioner, they hereby prefer the said Mr James Hay to the stipend of the above kirk of Kilmacolm the whole crop and year of God 1689, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, and others liable in payment of the same, and ordain letters of horning at his instance for that effect, he producing a decreet of locality. And in case there be none, ordain those liable to make payment to the said Mr James Hay of their respective proportions of the said year’s stipend according as they shall be decerned be the judge ordinary, and discharge the said Mr James Gaddorer from troubling or molesting of the said Mr Hay in the peaceable possession, uplifting, and disposing of the foresaid stipend.
