Act Mr Andrew Meldrum minister for stipend

Anent the petition Given in to the Lords of there Majestyes privie Counsell be Mr Andrew Meldrum Minister at Mertoun Shewing That whereas the petitioner being Minister at Mertoun did Continow in the exercise of his Ministeriall function after the Late revolution and submitted to the Lawes which enjoyned ministers to pray for there present Majestyes And would have Continowed so to doe Bot in respect he who wes minister of the said kirk in anno Jaj vjc and sixtie tuo years did come to the said kirk and preached that tuo sabbath dayes in the moneth of August Jaj vjc and Nyntie years the petitioner (Conceaveing that the said Minister might have returned to his functione of his ministerie there as he might have done by Law) out of a peaceable dissolution did thereafter forbear to preach at the said kirk Bot In regaird It doeth so appear that the said minister haveing a Charge else where did not returne to his function at the said place And that no other Incumbent hath since discharged the duetyes of minister there nor Claimed any right to the stipend there of and that the King hath right to the patronadge of the said kirk and that the petitioner hath ane Numerous and necessitous familie And that the stipend for the year Jaj vjc and Nyntie one is not uplifted Nor disposed of by his Majestie or there Lordships In favours of any other persone And therefor Craving That there Lordships would be pleased In respect of the petitioners peaceable disposition and the necessityes of his poor family To Grant warrand to the petitioner for uplifting of the said stipend for the year Jaj vjc and Nyntie one, and to grant him Letters for that effect againest the heretors and others Lyable in payment thereof The saids Lords of there Majestyes privie Counsel Haveing considered this petition Given in to them be the within Mr Andrew Meldrum They hereby allow the petitioner the stipend of the above kirk of Mertoun for the first half of the Cropt and year of God Jaj vjc Nyntie one And ordaines him to be readily ansuered obeyed and payed thereof be the heretors fewers wodsetters Lyferenters fermerers titulars tacksmen of teynds tennents possessors and others Lyable in payment of the said stipend for the said half year And ordaines Letters of horning to be direct thereon at the petitioners instance againest them for that effect He produceing a decreet of Locality And in case there by non ordaines the heretors and others forsaids Lyable in payment of the saids stipend To make payment thereof to the petitioner for the said half year According as they shall be decerned be the Judge ordinarie

Concerning the petition given in to the lords of their majesties’ privy council by Mr Andrew Meldrum, minister at Mertoun, showing that whereas the petitioner being minister at Mertoun did continue in the exercise of his ministerial function after the late revolution and submitted to the laws which enjoined ministers to pray for their present majesties, and would have continued so to do but in respect he who was minister of the said kirk in anno 1662 did come to the said kirk and preached that two sabbath days in the month of August 1690, the petitioner (conceiving that the said minister might have returned to his function of his ministry there as he might have done by law) out of a peaceable dissolution did thereafter forbear to preach at the said kirk. But in regard it does so appear that the said minister having a charge elsewhere did not return to his function at the said place, and that no other incumbent has since discharged the duties of minister there, nor claimed any right to the stipend thereof, and that the king has right to the patronage of the said kirk, and that the petitioner has a numerous and necessitous family, and that the stipend for the year 1691 is not uplifted nor disposed of by his majesty or their lordships in favour of any other person, and therefore craving that there lordships would be pleased in respect of the petitioner’s peaceable disposition and the necessities of his poor family to grant warrant to the petitioner for uplifting of the said stipend for the year 1691, and to grant him letters for that effect against the heritors and others liable in payment thereof. The said lords of their majesties’ privy council having considered this petition given in to them by the within Mr Andrew Meldrum, they hereby allow the petitioner the stipend of the above kirk of Mertoun for the first half of the crop and year of God 1691, and ordain him to be readily answered, obeyed, and paid thereof by the heritors, feuers, wadsetters, liferenters, fermerers, titulars, tacksmen of teinds, tenants, possessors, and others liable in payment of the said stipend for the said half year. And ordain letters of horning to be directed thereon at the petitioner’s instance against them for that effect, he producing a decreet of locality. And in case there by none, ordain the heritors and others foresaid liable in payment of the said stipend to make payment thereof to the petitioner for the said half year according as they shall be decerned be the judge ordinary.
